Home My Public Portal About19-028 - Amending Resolution No. 16-141 to Reduce the Membership of the Community Civic EngagementRESOLUTION NO. 19-028 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, AMENDING RESOLUTION NO. 16-141 TO REDUCE THE MEMBERSHIP OF THE COMMUNITY CIVIC ENGAGEMENT BOARD TO FIVE MEMBERS AND NO ALTERNATE MEMBERS, AND SETTING THE TERM OF THE MEMBERS PRESENTLY SERVING ON THE BOARD. WHEREAS, the City Council of the City of Carson ("City Council"), a charter City ("City"), has broad authority under state law and the City's Charter ("Charter") to establish and appoint boards, commissions and committees as part of the sub -government of the City, and to modify the characteristics of such bodies, including their membership composition; and WHEREAS, by adoption of Resolution No. 11-070 in 2011, the City Council created the City of Carson's Community Civic Engagement Board ("Board") to, among other duties and responsibilities, advise and recommend to the City Council, City Manager, and the commissions, boards and officers of the City on all matters involving City programs, projects or activities that will showcase the active participation of the people who live and work in Carson in pursuing specific, measurable, attainable and time -bound social, economic, political, and cultural objectives for the benefit of the people of Carson; and WHEREAS, the City Council amended the duties, functions and composition of the Board by adoption of Resolution No. 16-141 in 2016; and WHEREAS, the Board, as established and currently constituted, is comprised of eleven (11) members, with no alternate members; and WHEREAS, the City Council has determined that it is in the best interest of the City to amend the membership composition of the Board to reduce the number of regular member positions from eleven to five, with no alternate members, and now sees fit to do so; and WHEREAS, at the November 6, 2018 election, the City's electors voted for the City to become a Charter City by voting in favor of adoption of the Charter; and WHEREAS, on January 17, 2019, the Secretary of State, Business Programs Division, Special Filings Unit, accepted the Charter for filing and approved it for publication in the Statutes of 2019, thereby rendering the Charter effective as of January 17, 2019; and WHEREAS, Section 602(C) of the Charter provides that the members presently serving on the City's appointive boards, committees and commissions on the effective date of the Charter shall continue until the termination of their current terms; and WHEREAS, the City Council desires to set the current terms of the members presently serving on the Board such that they shall expire on March 22, 2019, although such members shall continue to serve on the Board until their respective successors are appointed and qualified. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: RESOLUTION NO. 19-028 Page 1 of 4 01007,0001/531698.9 SECTION 1. The above recitals are true and correct and incorporated herein by this reference. SECTION 2. Section 2 of Resolution No. 16-141 is hereby amended to read in its entirety as follows (new text is identified in bold & italics, deleted text is identified in stFike *Feugh): "The Community Civic Engagement Board shall consist of d five (5) members, each of which shall be appointed by the Mayor of the city of Carson and confirmed by a vote of the entire city council at a duly noticed regular or special meeting of the same. There shall be up to five (5) general members, up to two (2) California State University Dominguez Hills (CSUDH) representatives recommended by the university, up to one (1) specified youth member, up to one (1) specified senior member, up to one (1) specified community special needs advocate, and up to one specified person having a physical, developmental, or visual disability; each of whom resides or works in the city of Carson. The Mayor shall have discretion in making appointments from among the foregoing classifications, and is encouraged, but not required, to appoint members so as to ensure that at least one CSUDH representative serves on the Community Civic Engagement Board at all times. (a) General Members. Subject to the provisions of this sub -section f, hereinafter, the first term of office for three (3) of the general members appointed after the effective date hereof shall expire April 30, 2012. The first term of office for the remaining three (3) general members shall expire on April 30, 2013. Thereafter, all general members shall be appointed biennially for two (2) year terms expiring at midnight on April 30th. (b) CSUDH Representatives. The tie -members will be recommended by the CSUDH President. The first term of office for one (1) of these the two initial members appointed after the effective date of Resolution No. 11-070 will expire on April 30, 2012. The first term of office for the other initial member will expire on April 30, 2013. Thereafter, ball CSUDH members shall be appointed biennially for two (2) year terms expiring at midnight on April 30th. (c) Youth Member. A aR maximum of one (1) youth member shall be appointed for a term of one (1) year, expiring at midnight on April 301" of each year. The youth member shall meet all of the following qualifications: (1) Youth member shall be between the ages of 16-23 years old at the time of the appointment and shall represent all such ages; (2) Youth member shall have maintained at least a 2.0 grade point average in the previous school year, if in school; and (3) Youth member shall have an expressed interest in civic engagement issues and concerns. (d) Senior Member. The first term of office for the senior member appointed after the effective date hefeof Resolution No. 11-070 shall expire on April 30, 2013. RESOLUTION NO. 19-028 Page 2 of 4 01007.0001/531699.9 Thereafter, each senior member shall be appointed biennially for two (2) year terms expiring at midnight on April 30'". The senior member shall meet the following qualification: (1) Senior member shall be at least 55 years of age at the time of appointment. (e) Special Needs Advocate Member. The first term of office for the special needs advocate member appointed after the effective date #ei:eof Resolution No. 11- 070 shall expire on April 30, 2012. Thereafter, each Special Needs Advocate member shall be appointed biennially for two (2) year terms expiring at midnight on April 30'". (f) Member with Physical, Developmental, or Visual Disability. The first term of office for the member with a physical, developmental, or visual disability shall expire on April 30, 2018. Thereafter, each member with a physical, developmental, or visual disability shall be appointed biennially for two (2) year terms expiring at midnight on April 30th. (g) Termination, Vacancies, Voting. Any member of the Board shall be subject to removal at the pleasure of the Mayor, at any time, provided the same is ratified by a vote of the entire City Council at a duly noticed regular or special meeting of the same. Each Board member shall continue to serve until a successor has been appointed, confirmed, and has qualified for service, unless the City Council declared the position to be vacant. Should any vacancy exist, or be created by removal, on the Board, the appointment of a replacement Board Member, to conclude the unexpired term of the vacancy, shall be made by the Mayor of the city of Carson and confirmed by a vote of the entire City Council at a duly noticed regular or special meeting of the same." SECTION 3. The tenure (i.e. current term) of each member serving on the Community Civic Engagement Board as of the effective date of this Resolution shall expire at 11:59 p.m. on March 22, 2019. Notwithstanding the foregoing, such members shall continue to serve until their respective successors are appointed and qualified. SECTION 4. This Resolution shall be effective immediately upon its adoption. SECTION S. The City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
