ITEM #2: Zoning Request a) Town of Hillsborough to zone newly annexed 48.7 ac. south of Cornwallis Hills R-15 (TM 4.42.C.1) ITEM #3: Rezoning Requests (approx. 7:10) a) Wesley Cook to rezone 4.2 ac. on the north side of Tuscarora Drive from AR to R-20 (20,000 square foot min. lot)(TM 4.37.C.3 part). b) Various owners to rezone 14 residential properties on the south side of Cornelius St. from NB and R-10 to General Commercial (TM 4.13.A.15a,19,25; 4.14.A.1-4,7,8,10-12, and 4.14.D.3) ITEM #4: Zoning Ordinance Text Amendments (approx. 7:30) a) Amend Section 3.4 and 4.33 -requirements for telecommunications towers. b) Amend Section 5.22 -outdoor lighting requirements. C) Amend Section 4 -conditional use permit requirements for parks. Box 429 a Hillsborough, North Carolina 27278 919-732-2104 • Fax. 919-644-2390 MINUTES JOINT PUBLIC HEARING January 23; 1996 PRESENT: Mayor Pro Tempore Richard Simpson, Evelyn Lloyd, Catherine Martin, Ken Chavious, Wendy Olson (PB chair), Richard Bradford, Ed Gill, Jack Hughes, Louise Long, George Sagar, John Taylor, Doreen Tuell PUBLIC: John Wright, Jo Soulier, David Cates, Jack Payne, Tony Whitaker, John Peter, Sam & Jane Byrd, Wesley Cook, L.W. Walker, Alonzo Kenion, Rob Weintraub, Irvin Davis, Eric Swanson, Margaret Hauth ITEM #1: Commissioner -Simpson called the meeting to order and passed the gavel to Planning Board Chair Olson. She explained the basic hearing process. ITEM #2: Hauth briefly introduced the zoning request of the Old 86 Limited Partnership to zone 48.7 acres southwest of the existing Cornwallis Hills subdivision from R-3 a county zoning designation, to R-15 the most similar town zoning district. She added that the property has recently been annexed by the town and indicated its location on a map. Whitaker spoke as the owner's representative. He explained the owner's desire to develop this area in a fashion similar to the existing subdivision. Soulier spoke on behalf of the Cornwallis Hills home owners association. She passed around copies of a letter from the board of directors in support of the proposed development plans they reviewed. ITEM #3a: Hauth briefly introduced Cook's rezoning request for 4.2 ac. on Tuscarora Drive to change from AR to R-20. She indicated the property's location on the map and the zoning of surrounding lots. Lloyd asked how many lots could be developed with the rezoning. Hauth said a maximum of 9. Cook described his proposal. He noted that the rear portion of the lot is floodplain and steep slopes and it is his intention to create 6 lots. HeF added that he will extend Tuscarora Drive to this property and build a cul-de-sac north into the subdivision. J. Byrd spoke about the request. She said she is an adjacent property owner. She added that while she believes Cook will develop the land as he described, she wanted to express he concern about the proposed increase in density, changing from multiple acre to half acre lots and the related increase in traffic that will generate. Peter spoke against the request. He said he too is concerned about the increase in density, especially giver the size of the lots existing along the river. He said the smallest lot existing on the river is at least 2 acres and the introduction of smaller lots, will devalue the existing large lots. Cates spoke against the request. He said he is not opposed to R-20 zoning in general, in large part because his property is zoned R-20. He said his concern is that the properties adjacent to the river have a different character than the rest of the neighborhood and that character should be maintained with large lots. ITEM #3b: Hauth introduced the rezoning request affecting 14 properties on the south side of Cornelius Street. She indicated the lots included in the request, noting that she only included those lots owned by signers of the petition that was submitted with the rezoning application. Wright spoke on behalf of the applicants. He said the petitioners came together to make a joint request for rezoning because of the predominant commercial zoning in the area. Sagar asked which lots are commercially zoned. Hauth said that those on the north side of Cornelius from NC 86 to Hill Street are all commercially zoned. She added that Wright's property is zoned Neighborhood Business and the three lots east of the Revere Rd intersection on the south side are zoned General Commercial. Wright noted that the commercial development and new truck route have and will JPH 1/23/96, page 2 continue to reduce the value of these properties for residential use. Lloyd asked if everyone was asked to sign the petition. Wright said he only contacted those owners who live on the property. She asked if those contacted signed the petition and he said they did. Martin asked about the owner of the large tract of land. Wright said he didn't ask that owner to sign because Wright felt that the setback of that owner's house limited the impact to that owner from activities on Cornelius Street. Kenion spoke regarding the proposal. He said he is the owner of the large tract of land and he currently did not desire commercial zoning. He said he had not intended to speak at the hearing, but wanted to clarify some of the information provided by Wright with his viewpoint. He explained the history of the area and the zoning pattern based on his recollection from having lived on the site for 60+ years. He said he and his brother intent to continue to live on the site. Davis spoke, noting that some of his family's property was included and some was not. He asked for the opportunity to amend which lots would 'be affected. Payne spoke, requesting that his property not be included in the request. He said he signed the petition in support of Wright's rezoning, not to request rezoning for his own. He questioned how many of the petition signers understood the tax impact of requesting commercial zoning. He added that he still supports Wright's request, but does not want his property included. ITEM #4a: Hauth introduced the text amendments changing the Conditional Use Permit requirements for telecommunication towers. She added that the current ordinance has no provision to allow towers to exceed the height limit in the zoning district, which essentially prohibits the construction of towers. She said that this text is very similar to text under consideration in Orange County for tower development. Having similar requirements will help share the burden of tower development. There were no public comments on this text. ITEM #4b: Hauth introduced text amendments to Section 5.22, amending outdoor lighting requirements. She said this has been a Planning Board priority, in response to concern about excess lighting in non- residential developments. Olson noted that the language attempts to balance security and light trespass issues. Sagar asked about enforcement, since the ordinance does not specify a glare or trespass limit. Hauth said the town will purchase a light meter and take intensity measurements on the adjacent property. Based on the average intensity required for the use and the light meter measurement, a determination will be made by staff of what constitutes glare. Taylor asked Hauth to provide lighting levels currently existing lighting levels for a few sites could be provided to serve as reference points. There were no comments by the public. ITEM #4c: Hauth introduced the text amendments adding requirements for parks which are conditional uses. She noted that with the recent amendments establishing , 5 types of parks and designating some as conditional uses in some districts, the requirements fok an applicant needed to be added. There were no comments by the public. ITEM #5: Olson closed the public hearing and returned the gavel to Commissioner Simpson. He adjourned the meeting at 8:10 pm.
