CITY COUNCIL REGULAR MEETING
IONA CITY HALL
AUGUST 15,2023—7:00 P.M.
PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael
Thompson, Council Member Peter Wadsworth, Council Member Evan Mann, Public Works
Director Zech Prouse, City Attorney Andrew Rawlings and City Clerk/Treasurer Keri West.
ABSENT: None.
VISITORS: Ryan Walker, Katy Fetzer and Vince Greco.
Mayor Gubler welcomed everyone and led the Pledge of Allegiance. A roll call was taken by
Clerk West to open the meeting.
CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of July 18,
2023, were reviewed. Council reviewed the finance reports for the period ending July 31, 2023
(83% of the fiscal year elapsed). The City had $2,856,209.11 in the bank and routine bills had
been paid, "Exhibit A".
Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the
consent agenda as presented. Council Member Mann seconded the motion. All in favor. Motion
carried.
ITEMS OF BUSINESS:
Public Hearing, Approval of Fiscal Year 2024 Annual Appropriations Ordinance (Ord.
290-08-23) — Mayor Gubler stated this is a Public Hearing regarding the annual budget for the
City of Iona for the upcoming fiscal year. He stated this ordinance shows the anticipated General
Fund Expenses as $1,635,533 and the Water Fund Expenses as $1,074,160, for a total of
$2,709,693. Mayor Gubler stated the City has a good record of remaining in the black on the
budget and does not remember a time the City finances were in the red on the annual audit.
Mayor Gubler then asked if anyone in the audience would like to address the Council on this
agenda item. No comments made. Mayor Gubler then closed the Public Hearing portion of this
agenda item.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve
Ordinance No. 290-08-23, an Ordinance entitled the Annual Appropriation Ordinance for the
Fiscal Year beginning October 1, 2023, and ending on September 30, 2024, appropriating the
sum of $2,709,693 to defray expenses and liabilities of the City of Iona for said fiscal year,
authorizing a levy of a sufficient tax upon the taxable property and specifying the objects and
purpose for which said appropriation is made. Council President Geray also made a motion to
dispense with the rule of reading the proposed ordinance in full and on three separate occasions.
Council Member Wadsworth seconded the motion. A roll call vote was taken:

Public Hearing, Approval of Ordinance to Enact a New Section § 10-1-24 of the Iona City
Code; adding Open Park Space requirements for new subdivisions (Ord. 291-08-23) —
Mayor Gubler stated the intent of this ordinance is to require developers to include open green
space in their developments. He continued and stated this proposed code includes the specifics of
how much green space is required based on the total size of the development.
Mayor Gubler stated this is a Public Hearing and asked if anyone in the audience would like to
address the Council on this agenda item. No comments made. Mayor Gubler then closed the
Public Hearing portion of this agenda item and moved to Council deliberation.
Mayor Gubler stated the Council has been working on this enactment for a few months and
asked if there was anything else to discuss on this item. No comments made.

Ordinance No. 291-08-23, an Ordinance of the City of Iona, Idaho; enacting a new Section 10-1-

Public Hearing,Ordinance to Amend Iona City Code§ 11-14-2, clarifying requirements for
Variances (Ord. 292-08-23) —Council President Geray stated the current code is very restrictive
on variances, requiring a hardship to be proven to give the Council the ability to approve it. He
continued and stated after many applications had been presented to Council over the years, he
felt it was appropriate to give the Council latitude to approve variances without a hardship.
Council President Geray stated he sought a balance between the code being too subjective and
too restrictive. He continued and stated if a resident wants to improve their property in a way that
varies from the code and can prove their proposal meets the underlying goal of the code, he
thinks the Council should have the latitude to approve it. Council President Geray emphasized
the City Council should support residents that choose to improve and beautify their property as
desired, if the other requirements are met. Attorney Rawlings stated the Council has gone
through a few versions of this amendment and the previous version was deemed too subjective.
He continued and stated this version includes the option for Council approval if there is
sufficient basis for the variance which requires a benefit or improvement to the City, community
and neighbors. Attorney Rawlings stated the applicant needs to provide documentation to show
how the variance satisfies the purposes of the zoning ordinance by matching or exceeding the
functionality the code requires.
Mayor Gubler stated this is a Public Hearing and asked if anyone in the audience would like to
address the Council on this agenda item. No comments made. Mayor Gubler then closed the

Council President Geray asked Director Prouse if he approves of the language in the amendment.

Ordinance No. 292-08-23, an Ordinance of the City of Iona, Idaho; amending Section 11-14-2 of
the Iona City Code; clarifying requirements for Variances; providing methodology; preserving
prior ordinances in each instance; providing for severability; and establishing an effective date.

Public Hearing, Ordinance to Amend Iona City Code § 8-2-2 and § 8-2-24, modifying
definitions and clarifying the calculation of the Water System Connection Fee (Ord. 293-08-
23) — Mayor Gubler stated every few years the City goes through the process to determine the
cost of the water connection fee for the City of Iona. He continued and stated this amendment is
to fine-tune the methodology used to determine the value of the water system and to clarify how
the water system connection fee is calculated. Mayor Gubler requested Attorney Rawlings
explain the major differences in this amendment. Attorney Rawlings stated one thing that has
been removed from this amended version based on the Council's recommendation is the
escalator clause, which allowed the City to increase water system values by the inflation index
over time, from the base line value that was established in 2017. He continued and stated he has
reviewed the case law that was pertinent when this original ordinance was enacted and concluded
the"equity buy-in"method is the most feasible way to value a municipal utility system. Attorney
Rawlings summarized this method as the "total system value = cost of duplicating the
improvements—the depreciation+the value of the land". He continued and stated there has been
a lot of discussion amongst the Council about the developed water rights and whether those
values should be added to the total value of the system. He stated under Idaho law, water rights
are considered real property by deed, just like land and he believes they should be included in
this equation. Attorney Rawlings stated the more the City strays from this methodology that has
been upheld by Idaho law, the more they risk litigation. He continued and stated the amendment
captures this methodology of determining the gross and net water system value. Attorney
Rawlings continued and stated another element that he found in the case law is that to determine
the connection fee, the total system value should not be divided by the number of system users
currently,but by the total system capacity.
Council President Geray requested further clarification and asked Attorney Rawlings if this
methodology includes the value of all water rights, including those that were not purchased by
the City but were developed by the City, in the "gross system value". Attorney Rawlings
reiterated that based on case law and the definition in the Iona City Code for"system assets", all
water rights' values would be included in the"gross system value", whether they were purchased
or developed. Council President Geray confirmed and clarified Attorney Rawlings'
recommendation is to include all water rights values as assets towards the "gross system value".
He then asked how the City can determine the value of the existing water rights. Attorney
Rawlings stated according to case law, the City can use the current cost to purchase the water
rights today as a valuation basis. Attorney Rawlings confirmed that will greatly increase the total
value of the system, but when the City adjusts the divisor as the total system capacity, it will
make the connection fee more reasonable and justifiable. Council Member Wadsworth agreed.

Mayor Gubler recommended passing this amendment, but suggested waiting to change the
connection fee until the City has gone through the City Engineer selection process and the actual
values are determined.
Attorney Rawlings stated the City also has the option of adding back in the escalator clause to
regularly value the system based on inflation. Council President Geray suggested in the future
adding a compromise to update the total value every 3-4 years based on inflation and every 10-
12 years doing a full valuation from scratch. Council President Geray asked if the City needs to
include in this amendment the method for valuing the developed water rights. Attorney Rawlings
stated he does not believe that is necessary. Council President Geray then asked if the code
should include the methodology to determine the total system capacity. Attorney Rawlings stated
the City Code currently defines "total system capacity" and states that it will be determined by
"Generally Accepted Engineering Practice (GAEP)". He continued and stated he believes that
value can be determined by the City Engineer at the time of valuation. Council President Geray
understood.
Mayor Gubler stated this is a Public Hearing and asked if anyone in the audience had any
comments or questions. No comments made. Mayor Gubler closed the Public Hearing portion of
this agenda item to allow for Council deliberation.
Council Member Mann confirmed the new engineer will need to quantify the total system
capacity before the City can determine the new connection fee. Mayor Gubler and Attorney
Rawlings agreed.

Public Hearing, Resolution Reserving Forgone Amount for Fiscal Year 2024 (Res. 2023-02)
—Mayor Gubler stated the City is required to pass a resolution reserving any forgone amount to
use for future use. He continued and stated this year the City Council chose not to take the full
3% increase that is allowed, so the remaining amount will be added to the forgone balance.
Council President Geray asked if the amount on the resolution is a cumulative amount, or if it is
only for this fiscal year. Clerk West confirmed the resolution only specifies the amount that is
being reserved for this fiscal year and stated it is added to the City's total forgone balance.
Mayor Gubler stated the amount they are reserving for this fiscal year is $6,729. Clerk West
confirmed that is the amount they are reserving from this year, but the total amount the City has
in the forgone account is approximately $88,000. Mayor Gubler explained to the audience the

history of forgone and that each City is allowed to take a 3% increase in their property taxes,
without requiring a vote. He further explained the forgone is the difference between the 3%
allowed and the actual increase the City elects to receive. Council Member Wadsworth asked
how the City can receive the forgone if needed. Clerk West stated the City would elect to
withdraw forgone funds on the annual property tax levy sheet, the "L-2". Those funds would
then be added to the total amount due on each resident's tax bill and the City would receive the
funds with the monthly property tax revenue checks from Bonneville County.
Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve
Resolution No. 2023-02, a Resolution of the City Council of the City of Iona, Idaho, reserving
the Forgone amount for Fiscal Year 2024 for potential use in subsequent years as described in
Idaho Code § 63-802, in the amount of $6,729. Council Member Thompson seconded the
motion. All in favor. Motion carried.
Approval of Additional Funds for Dump Truck and Accessories —Director Prouse stated the
City Council had approved $200,000 initially towards the purchase of a new dump truck and
snow removal equipment. However, the contract came in to lock the price and there is an
overage of$38,691.22 for the truck, which includes the truck chassis, dump body, hydraulics,
controls, and plow. Director Prouse also stated the City is utilizing the Sourcewell contract that
was also approved by the City Council, which produced savings on the truck of approximately
$70,000. He continued and stated the truck is an International product. Director Prouse stated
even with locking in the price now, the truck will not be available until the summer of 2024.
Mayor Gubler stated the City tried contacting multiple companies and International was the only
one that would move forward with a lock in date. He continued and stated the other companies
had nothing available in the foreseeable future.
Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the
additional funds for the dump truck and accessories in the amount of $38,691.22. Council
Member Wadsworth seconded the motion. All in favor. Motion carried.
Approval of Sander Bed for new Dump Truck — Director Prouse stated he would like to
purchase the sander bed for the new dump truck at a cost of $29,645. Council Member Mann
asked if the City already has a sander. Director Prouse stated the City currently has two trucks
with sanders, so this will be a third truck equipped for snow removal and sanding. Council
President Geray stated this is necessary as the City continues to grow.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve the
sander bed for the new dump truck in the amount of$29,645. Council Member Mann seconded
the motion. All in favor. Motion carried.
Discussion of City Events — Clerk West distributed financial reports that were completed by
City Events Coordinator, Rylea Farrens, that illustrate the revenue and expenses for the 2023
events. She stated the City has worked hard to use the excess revenue over the past few years to
purchase items that are reusable, reducing the amount needed to bring in each year. Clerk West
stated Rylea has brought in a total of$35,197.35 this fiscal year, which also includes all vendor
and race fees that were collected for Iona Days. She continued and stated the City does allocate
an additional $5,000 from the General Fund to be used for City events. Clerk West stated Rylea

would like to use some of those funds to purchase items for next year, since the sponsorship
revenue doesn't start coming in until January. Mayor Gubler stated the last two events for the
year would be the Halloween Carnival and the Veterans Day program. Clerk West confirmed
and stated those events are technically on the next fiscal year,but if there are still funds available
on the current budget, Rylea would like to use those funds for these events. Mayor Gubler stated
the City typically does a small treat or gift for local veterans on Veterans Day. He continued and
stated this year they considered giving American flags, but the cost to purchase them from a
vendor in the United States was too high. Mayor Gubler stated the City has decided to do a hat
that says "Veteran" on it. He continued and stated he and Council President Geray both agreed
an embroidered hat would be a good gift. Clerk West stated the City has approximately 60
veterans on the list, but we typically buy more gifts than that to accommodate the additional
veterans that attend the program at Iona Elementary.
Council President Geray expressed his appreciation for the events and specifically the firework
show at Iona Days. He continued and stated it was a great show and was impressed that the
fireworks only cost $5,000. Mayor Gubler stated the City did purchase additional products for
the fireworks, such as timers and launchers that will not need to be purchased again next year.
Council President Geray asked if the City would continue to host "Movies in the Park". Clerk
West stated this event will be discontinued. She continued and stated the cost to purchase the
rights to the movies and the logistics of having employees or volunteers here that late was too
significant for the small attendance.
Discussion of Public Right of Way Permit# 2023-01 for Fybercom, LLC — Mayor Gubler
stated this agenda item was listed on both the Work Meeting agenda and this Regular Meeting
agenda. He confirmed this discussion took place at the Work Meeting preceding this meeting.

residents in "Zone 1" have been connected to fiber and are already using their services. Council
Member Thompson stated the splicing is the most time consuming part of the process.
STAFF REPORTS: Clerk West reported that Randy Homer, the previous City Recreation
Director left earlier this month and the City has hired a new Recreation Director, Shane
Oliverson. Mayor Gubler stated the City has also hired Jonathan Bailey to fill the Public Works
open position. Clerk West reported Iona Days was a success and expressed appreciation for
everyone's hard work. Clerk West also reported City elections are coming up and there will be
two Council seats up for election. She continued and stated the filing window for candidates is
August 28—September 8.
Director Prouse reported during his daily inspections of the facilities last week he noticed a
severe vibration occurring at Well#2. He continued and stated he had American Pump come out

to assess the situation and they made the decision to take Well #2 offline. Director Prouse stated
the tank is still online, as well as the new tank and well. He continued and stated there should not
be an issue providing enough water, but he did request to have irrigation & sprinkler water
reduced as much as possible. He then stated the repairs should be completed in time to have the
well back online as of this Friday. Council President Geray stated he was under the impression
that the new tank and well could support the City's complete water usage. Director Prouse stated
demand is much higher during the summer and he is being cautious with the capacity.
Deputy Davies reported the calls for service in July were about average with July of last year. He
did state the traffic stops have increased. Council Member Mann asked where most of the traffic
stops are taking place. Deputy Davies stated he tries to make stops all over the City, including
55th East, Iona Road, Rockwood, etc. Mayor Gubler expressed his appreciation to Deputy
Davies.
Council Member Wadsworth stated Iona Days and the fireworks were awesome. He continued
and stated he appreciates working with the City.
Council Member Mann expressed appreciation for the "No Smoking" signs being installed at the
City Park. He continued and asked about the City BBQ taking place on September 9th. Clerk
West confirmed there is a City Employee BBQ that will take place at the City Park on September
9th for all employees, Council Members, Planning & Zoning Commission, and their families.
Council Member Mann also asked if the City will be doing a Christmas event this year. Clerk
West confirmed there will not be any Christmas events hosted by the City this year. She
continued and stated the City did an event for Christmas the last two years and they were not
well attended. However, the City did purchase lights for those events that will still be used to
decorate this year. Mayor Gubler stated the Mayor's Youth Advisory Council (MYAC) has done
a Christmas fundraising event in the past and may do that again this year. Clerk West confirmed
the City will still do the Angel Tree and the food drive during the month of December. Council
Member Mann then reported he will be participating in the Mayor's Walking Challenge to raise
funds,just as he did last year. Clerk West explained that challenge is done by Blue Cross and if
our representative walks 10,000 steps per day for the month of October, the City receives a
$1,000 grant.
Council Member Thompson expressed his appreciation to everyone involved with Iona Days. He
then asked Clerk West what time the Special Meeting will take place on Thursday, September 7th
to review the City Engineer proposals. Discussion took place and the decision was made to have
the meeting begin at 6:00pm.
Council President Geray stated the annexation situation is going to be difficult and encouraged
the Council and staff to be patient and understanding when having those discussions. He
continued and stated there will be those that are willing to listen and we need to be professional
in those conversations. Council Member Thompson agreed and stated he met with the
Homeowners Association(HOA)President of Green Valley last week and they were able to have
a productive conversation to discuss the pros and cons of annexation. Clerk West asked what the
Council's next steps are for the annexation process. Council President Geray recommended
waiting until after the election to move forward with the Annexation Plan. Mayor Gubler agreed
and stated individually the Council can send ideas to Attorney Rawlings of things that should be

added to the written Annexation Plan, but he does not think it needs to be discussed again in a
meeting until after the election is done.
Mayor Gubler reported the fuel storage tank for the new water tank will be installed in February
2024. He continued and stated the water tank itself does still have a few minor issues that are
being sorted out. Mayor Gubler stated the City is still holding money back until all of these
repairs are completed. Mayor Gubler then expressed his appreciation for all the work that went
into Iona Days. He continued and stated it was a fantastic event. Mayor Gubler also reported the
Bonneville County Commissioners held their Public Hearing today for the Area of Impact
Agreement. He continued and stated it was a good meeting, but their process is not to make
decisions until after the Public Hearing is held. Mayor Gubler stated they told the City we would
expect to hear something back from them within the next 2 weeks.
SUGGESTED AGENDA ITEMS: Clerk West requested to add a discussion on changing the
City Council dates to next month's meeting. She also requested to add a discussion on increasing
the fees for City Building rentals.
