HomeMy Public PortalAboutM2006-0530-CC_SpLYNWOOD CITY COUNCIL SPECIAL MEETING MAY 30, 2006 The City Council of the City of Lynwood met in a special meeting in the Council Chambers, 11330 Bullis Road on the above date at 5:06 p.m. Mayor Vasquez presiding. Council Members Byrd, Johnson, Pedroza, Santillan, and Vasquez answered the roll call. Also present were City Manager Martinez, City Attorney Beltran, and City Clerk Hooper. City Treasurer Pygatt was absent. City Clerk Hooper announced that the Agenda had been duly posted in accordance with the Brown Act. PUBLIC ORAL COMMUNICATIONS (Regarding Agenda Items Only) Miguel Alvarez spoke on item #13 -CLOSED SESSION. He believes that taxpayers should not pay for attorneys to represent Council Members. Irene Garcia spoke on item #6 -OPPOSITION TO SENATE BILL 1778. She said to simply obey the law. On item #9 -REQUEST FOR PROPOSALS FOR ELECTRONIC DATA PROCESSING & MAILING SERVICES, she questions if the City is going to eliminate positions? On item #10 -REQUEST FOR PROPOSALS FOR COMPREHENSIVE FINANCIAL SERVICES, she questions why more consultants? She said its abuse of taxpayer's monies. On item #12 -SELECTION OF A CONSULTANT TO CONDUCT AN EXECUTIVE SEARCH FOR THE POSITION OF ASSISTANT DIRECTOR OF PUBLIC WORKS, she questions why not search in house for qualified employees to do the work in house. On item #13 -CLOSED SESSION, she requests Council Members pay the attorneys fees out of own their own pocket. Alex Landeros spoke on item #13 -CLOSED SESSION. He commented that Council Members should resolve the SELAC issue. He also commented that if Council Members get in trouble they should pay for their own attorney not the City pay the bill. PUBLIC ORAL COMMUNICATIONS The following individuals were electioneering on~behalf of Mayor Leticia Vasquez: Dorothy Smith, Irene Gonzalez, Eugene Jackson, Lorna Hawkins, Tony Miranda, Jack Kean, Margie Harper, Donald Dove, Piercy Brown, Frank Calderon, Zelda Hutchinson, Pearline Calderon, Lorene Reed, Irene Garcia, Dr Hanan Islam, Naomi Salazar, Julio Salazar, Will Wright, Serena Ramirez, and Jimmy Bass. Miguel Figueroa and Alex Landeros commented that they would also like to see an investigation. r- CONSENT CALENDAR i --' l ~, All matters listed under the Consent Calendar will be acted upon by one motion affirming the action recommended on the agenda. There will be no separate discussion on these items prior to voting unless members of the Council or staff request specific items to be removed from the Consent Calendar for separate action. It was moved by Council Member Byrd, seconded by Mayor Pro Tem Johnson, to adopt the following resolutions: Item #6 OPPOSITION TO SENATE BILL 1778 RESOLUTION NO. 2006.094 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING OPPOSITION TO SB 1178 (ALARCON) ON LANDFILL COVER AND ESTABLISHING A POLICY TO OPPOSE MEASURES THAT WOULD LIMIT LOCAL JURISDICTIONS DISCRETION AS HOW TO BEST ACHIEVE AB 939 DIVERSION GOALS. Item #7 REQUEST FOR PROPOSALS FOR CITY PROSECUTOR SERVICES RESOLUTION NO. 2006.095 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING STAFF TO ISSUE A REQUEST FOR PROPOSALS FOR CITY PROSECUTOR SERVICES FOR CODE ENFORCEMENT. Item #8 REQUEST TO SOLICIT BIDS FOR HARDWARE, SOFTWARE, AND RELATED EQUIPMENT NECESSARY FOR THE CITY'S NEW FINANCIAL MANAGEMENT SYSTEM RESOLUTION NO. 2006.096 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE RELEASE OF THE REQUEST FOR PROPOSALS (RFP) TO SOLICIT BIDS FOR HARDWARE, SOFTWARE AND RELATED EQUIPMENT FOR THE CITY OF LYNWOOD'S NEW FINANCIAL MANAGEMENT SYSTEM. Item #9 REQUEST FOR PROPOSALS FOR ELECTRONIC DATA PROCESSING & MAILING SERVICES RESOLUTION NO. 2006.097 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING STAFF TO SEND OUT A REQUEST FOR PROPOSALS FOR ELECTRONIC DATA PROCESSING & MAILING SERVICES. Item #10 REQUEST FOR PROPOSALS FOR COMPREHENSIVE FINANCIAL SERVICES RESOLUTION NO. 2006.098 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING REQUEST FOR PROPOSALS FOR AUDIT, CONSULTATION, ECONOMIC ANALYSIS, AND DATA SERVICES RELATED TO THE SALES AND USE TAX, UTILITY USERS TAX, PROPERTY TAX, AND BUSINESS LICENSE TAX. Item #11 AWARD OF THE LONG BEACH BLVD. WATER MAIN IMPROVEMENT PROJECT, PROJECT NUMBER: 05-5300 RESOLUTION NO. 2006.099 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AWARDING A CONTRACT TO CEDRO CONSTRUCTION INC., IN THE AMOUNT OF $966,530 FOR THE LONG BEACH BLVD. WATER MAIN IMPROVEMENT PROJECT, (MARTIN LUTHER KING, JR. BLVD. TO TWEEDY BLVD.), PROJECT NUMBER: 05-5300, AND AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT. Item #12 SELECTION OF A CONSULTANT TO CONDUCT AN EXECUTIVE SEARCH FOR THE POSITION OF ASSISTANT DIRECTOR OF PUBLIC WORKS RESOLUTION NO. 2006.100 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH CPS EXECUTIVE SEARCH TO CONDUCT AN EXECUTIVE SEARCH FOR THE POSITION OF ASSISTANT DIRECTOR OF PUBLIC WORKS. ROLL CALL AYES: COUNCIL MEMBERS BYRD, JOHNSON, PEDROZA, SANTILLAN, AND VASOUEZ NOES: NONE ABSTAIN: NONE ABSENT: PEDROZA CLOSED SESSION Item #13 City Attorney Beltran stated with respect to every item of business to be discussed in Closed Session Pursuant to Section 54956.9 A. CONFERENCE WITH LEGAL COUNSEL-ANTICIPATED LITIGATION Significant exposure to litigation pursuant to subdivision (b) of Section 54956.9: Three (3) Cases It was moved by Mayor Pro Tem Johnson, seconded by Council Member Byrd, and carried to recess to Closed Session at 6:40 p.m. Council reconvened at 8:45 p.m. City Attorney Beltran stated that Council met on the aforementioned matters and with respect to the following: A. CONFERENCE WITH LEGAL COUNSEL-ANTICIPATED LITIGATION Significant exposure to litigation pursuant to subdivision (b) of Section 54956.9: Three (3) Cases 1) City Attorney Beltran reported that only he and the Council were present during the discussion of this item. They addressed the possibility of the City initiating litigation or preparation for the same. After discussion the Council reached consensus (5-0) to solicit a letter of engagement to a firm to assess this item. This item will be brought back to Council at its next regular Council meeting. 2) City Attorney Beltran reported that only he and Council were present during the discussion of this item. They addressed the prospect of exposure to litigation and engaging a firm to represent the City. After discussion consensus was reached (4-1-0, Santillan NO). ~. ,~ 3) City Attorney Beltran reported that only he and Council were present during the discussion of this item. No new action was taken other than direction was given to staff to retain the services of Special Counsel. Consensus was reached (5-0). Upon his return from closed session and. after the vote was taken Council Member Pedroza indicated that he wanted the record to reflect that he votes NO on item #8. CITY COUNCIL ORAL AND WRITTEN COMMUNICATION Council Member Pedroza thanked Council for a brief meeting. He said every decision they do is for the betterment of the community. Council Member Byrd commented they had heated discussions but it all turned out Okay. Council Member Santillan encouraged residents to continue to come to Council meetings. Mayor Pro Tem Johnson commented that they had heated discussions. He thanked Council Members for getting through the meeting and mentioned there are many great projects in the works. Mayor Vasquez thanked residents for coming to the Council meeting.
