A RESOLUTION: AUTHORIZING A REVISED TERMS OF AGREEMENT FOR UTILIZATION OF
THE FARMERS' MARKET
WHEREAS, Town Council Resolution number 88-63 cancelled the agreement
with Market Square Associates to manage the town's farmers' market; and
WHEREAS, the Loudoun County Economic Development Department surveyed
local producers to generate interest in participating the market; and
WHEREAS, several producers have responded; and
WHEREAS, a generic terms of agreement form should be signed by each
producer and the town prior to authorization of participation in the market:
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia
as follows:
The town manager is authorized to use the attached terms of agreement
to contract with producers utilizing the town's farmers' market.

1. The Town of Leesburg Farmers' Market is available for producers to
market their own produce. Farmers selling goods that they have purchased
must obtain a business license from the town finance department. Previous
participants who qualify under the Terms of Agreement will be given first
priority for stall space. Products to be sold include vegetables, fruits,
plants, herbs, flowers, baked goods, honey, cider, preserves, eggs, wool or
or'her goods specifically approved by the town.
2. The Market will operate on Fridays from 9 a.m. ,,-til 8 p.m. and on
Satuxdays from 9 a.m. until 6 p.m. No mandatory participation is required.
3. Producers should be set up each day 15 minutes before market opening
time and should have their stalls and adjoining area completely cleaned up
within 30 minutes after Market closing. Producers must keep their stalls
filled by replenishing their supplies from trucks, etc. Any stall not
occupied within 30 minutes after Market opening may be assigned to another
registered producer.
4. Products must comply with Virginia Food Laws and must be fresh and
attractive.
5. The general objective of the Market is to provide stalls for as many
different qualified producers as possible. Up to three producers may
share a stall, but each must submit an application and one of the three
shall be' assigned responsibility for the rules and regulations of the
Market. If the permit of the responsible producer is terminated,
participation of producers sharing the stall may also be terminated.
Authorization for use of the market shall entitle the producer to the
stall area and that area extending east and west of the stall to -the drip
lille of the Market structure. The use of the area on the sidewalk side of
the stall shall allow for pedestrian circulation under cover.
6. The Town of Leesburg has the responsibility and authority to approve
or deny applications, to manage daily Market operations, and to revoke any
producer's permit for violation of the Market Terms of Agreement. The Town
may impose additional regulations for efficient operation of the Market so
long as they do not conflict with these Terms of Agreement.
7. No personal equipment may be used at the Market, including counters,
refrigerators, radios, etc., unless approved by the Town.
8. Signs may be attached to the Market structure when approved by the
Town.

9. Producers are responsible for keeping their stalls neat and clean.
Trash must be placed in designated receptacles. No perishables may be
stored under counters. Stalls, adjacent area and storage below stalls must
be empty and clean within 30 minutes after closing on each Market day%
10. Proper dress including shoes and shirts is required for producers and
their representatives at the Market.
11. Each producer must have available her or his signed permit each day of
Market participation.
12. Each producer must adhere to the State Code as it applies to the
collection of sales tax.

The Leesburg Farmers' Market is scheduled for operation from June 1 to
September 15. Because of special events, the Market will not operate on up
to five (5) weekend days. You will be advised of specific dates three
weeks in advance.

I have read the above Terms of Agreement. I understand that if I fail to
abide by the above rules and regulations, permission for me to participate
in the Leesburg Farmers' Market can and will be withdrawn. I understand
that these policies are subject to change by the Town of Leesburg and that
I am required to comply with all rules in order to continue my
participation in the Market.
