A RESOLUTION: WHEREAS, Section 9A-6 of the Leesburg Zoning Ordinance requires the planting of street trees along new public streets in all zoning districts except single family detached residential districts; and WHEREAS, the adopted Town Plan encourages landscaping and tree planting in all new developments; and WHEREAS, street trees in single-family residential neighborhoods substantially contribute to the quality of life by providing shade, habitats for urban wildlife and a more attractive streetscape; and WHEREAS, an amendment of Section 9A-6 to eliminate the exclusion of single family detached districts from street tree planting requirements will further the objectives of the Town Plan and is in the best interest of the public necessity, convenience, general welfare, and good zoning practice: THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. An amendment of the Leesburg Zoning Ordinance is initiated to revise Section 9A-6 as follows: 9A-6. APPLICABILITY. Street tree planting is required any time a public street is constructed, extended or widened. This requirement shall apply to all zoning districts :::cc-_ -: ~ ~ ~ ~""~ -~"~-~] ~. In general street trees shall be planted in the public right-of-way and maintenance of these trees shall be the responsibility of the Town of Leesburg. Where parking lots abut public street rights-of-way the requirements of Section 9A-9(c) shall apply. SECTION II. A public hearing on this amendment shall be held at 7:30 p.m. on July 26, 1988, in the Council Chambers, 10 West Loudoun Street, PRESENTED July 12~ 1988 88-123 ADOPTED July 12~ 1988 INITIATING A ZONING ORDINANCE AMENDMENT REGARDING STREET TREES ZONING ORDINANCE AMENDMENT REGARDING STREET TREES 2 Leesburg, Virginia. In accordance with Section 15.1-431 of the Code of Virginia, this hearing shall be a joint hearing of both Planning Commission and Council. The clerk shall give notice of this hearing on July 13 and July 20, 1988, and shall advise the Planning Commission of the purpose, time and date of the hearing. SECTION III. The Planning Commission shall report its recommendation to the Town Council on the proposed amendment on July 26, 1988 following the public hearing.
