Chairman Kiefer called the Plan Commission meeting to order at 7:00 p.m. and led the pledge to the flag.
ROLL CALL: Commissioners Heinen, Minnis, Renzi, Ruane, Seggebruch, Womack, and Chairman
Kiefer were present.

APPROVAL OF MINUTES
The Minutes of the Plan Commission meeting held on March 2, 2021 were approved as amended.
PUBLIC COMMENTS
Chairman Kiefer stated one public comment was received via email. Mr. Proulx summarized the email
regarding the proposed Pavillion Subdivision (see attached).
DEVELOPMENT REPORT
Mr. Proulx provided an update on the following items: Sign variance for 15715 S. Route 59, Fence
variance for 25321 W. Ryan Ln., and Lansdowne Final Plat Phase 2.
Chairman Kiefer received unanimous consent to hear the New Business agenda items first, then the Old
Business item.

Mr. Ding stated the applicant is seeking approval of a final plat for the Willow Run subdivision, formerly
known as Willow Tree Farm. On August 13, 2018, the Village Board of Trustees reviewed an earlier
concept plan for Willow Tree Farms Development submitted by the developers at the Committee of the
Whole meeting. The annexation, the special use for development, and the preliminary plat for Willow
Tree Farms Development were approved in August 2019. On March 1, staff sent a formal letter which
includes final plat review feedback to the applicant. The applicant has agreed to complete all the changes
that are listed in the letter. However, due to limited remaining time before the March 16 Plan
Commission, the applicant requests to present the current version of submittals and conduct a thorough
update to all submittals after the March 16 Plan Commission meeting. The feedback letter package is
attached in the staff packet.
Mr. Ding reviewed the staff report dated March 16, 2021. Mr. Ding concluded staff finds that the
proposed Final Plat for Unit 1 of the Willow Run subdivision is mostly consistent with the preliminary
plat, annexation agreement, and Village requirements. Subject to discussion by the Plan Commission,
staff recommends approval of the final plat, subject to the noted stipulations.
Chairman Kiefer swore in Caitlin Csuk, attorney; Matt Goodsite, V3 Companies; and Greg Collins, M/I
Homes. Ms. Csuk did a brief presentation on the development which included a history for the
development, where they are in the review process, and explained the changes made since preliminary
plat approval. Ms. Csuk stated they will comply with staffs’ revision requests they received.

Commissioner Heinen stated all the changes made are a positive. Commissioner Heinen asked if the lots
on the eastside of the subdivision match up with existing subdivision. Ms. Csuk indicated it appears they
do lineup. Commissioner Heinen asked what the width and height on landscape berm along Drauden Rd.
Mr. Goodsite stated three-foot berm, which meets Village code, and they are in the process of updating
the landscape plan to meet the key and through lot requirements. Commissioner Heinen suggested an
underlying berm as well. Commissioner Heinen asked the applicant to explain the architecture of the rear
of the homes. Mr. Collins stated there will be enhancements to the rear elevations on Drauden Rd.
Commissioner Heinen asked the applicant to pay special attention to the rear elevations along Drauden
Rd.
Commissioner Minnis asked the applicant to identify the areas that will be dedicated to the Park District.
Ms. Csuk stated Outlots B, E, and the playground area. Commissioner Minnis asked if the path was a
new addition to the plan. Ms. Csuk stated the path was incorporated to help with getting children to a bus
stop until unit 2 is developed.
Commissioner Renzi asked the applicant if they are willing to comply with street directions on the plat.
Ms. Csuk stated the applicant is willing to fully comply with the Village’s formal letter which includes
final plat review feedback. Commissioner Renzi asked what the street name for Creekside Circle will be,
since the Village is requesting it be changed. Mr. Collins stated the proposed name is Willow Run Circle.
Commissioner Renzi asked if the feedback from the Village will be incorporated into the plat that will go
before the Village Board. Commissioner Renzi asked if they are comfortable with the key & through lots
proposed by staff in the letter. Mr. Csuk stated yes that they will make sure they are complying with the
Village code and the annexation agreement. Commissioner Renzi asked if the agree to provide the
Village Unit 1 lots’ information in Excel format, and a final list of bulk and density relief. Ms. Csuk
agreed they will comply with the request.
Commissioner Ruane was happy to see a reduction in density. Commissioner Ruane asked if the
recapture will include pedestrian access along Drauden Rd. Mr. Ding stated on the eastside of Drauden
Rd. there is an existing multi-use path and on the westside of Drauden a sidewalk is planned.
Commissioner Ruane stated the walk will stop at the residential property, so the recapture will not include
a signalized crossing at Drauden Rd. Mr. Proulx stated the section at the corner is not included in the
annexation, so they do not have the right to improve that property and explained what is included in the
annexation agreement. Mr. Proulx stated there are no current provisions that would call for
improvements to the property that is not part of the subdivision. Commissioner Ruane asked if the fence
will be on the eastside of berm and if the berm will be maintained by the HOA. Mr. Collins confirmed
and explained the fence they typically install. Commissioner Ruane asked if all the homes will have
basements. Mr. Collins confirmed there will be basements.
Commissioner Seggebruch asked for clarification that there will be a fence installed along the Drauden
Rd. lots. Mr. Collins stated a fence will not be installed by the developer, there will be specific
requirements with the HOA Covenants specifying the fence materials and height for those lots.
Commissioner Seggebruch is worried that homeowners may try to encroach into the berm with gardens,
etc. and asked the developer to keep that in mind. Commissioner Seggebruch is concerned that the HOA
will be maintaining a lot of common areas and how that will affect the HOA fees. Mr. Collins stated
there is a lot of the area that will be low maintenance, per what is proposed on the landscape plan. Mr.
Collins stated there will be a Special Service Area. Commissioner Seggebruch asked for the base price of
a home. Mr. Collins stated starting at $330,000s up to high $400,000s and they currently have 10 home
plans they can build.

Commissioner Womack asked if the school district provided input on the path for bus service. Ms. Csuk
stated she believes it was at the request for the school district the path was added. Mr. Proulx confirmed
Ms. Csuk statement the school district has reviewed the plan thoroughly. Mr. Proulx stated there is a
requirement for the HOA to manage snow removal for that path in the winter months. Commissioner
Womack asked if the plan for the future south connection off on Easton will be constructed. Mr. Collins
stated yes. Mr. Proulx clarified that the south extension is intended to provide future access to the triangle
parcel to the south and will not tie into the unimproved Rowley Rd.
Commissioner Ruane made a motion to recommend approval of the Final Plat for Unit 1 of the Willow
Run subdivision, subject to the following four (4) stipulations:
1. Compliance with the requirements of the Village Engineer;
2. Compliance with the requirements of the Plainfield Fire Protection District;
3. Compliance of the provisions of the Annexation Agreement; and
4. Payment of appropriate recapture fees.
Second by Commissioner Heinen. Vote by roll call: Minnis, yes; Renzi, yes; Seggebruch, yes; Womack,
yes; Heinen, yes; Ruane, yes; and Kiefer, yes. Motion carried 7-0.

Mr. Ding stated the applicant is seeking final plat approval for Phase 8 of Chatham Square. Phase 8 will
include sixty-two (62) single-family units, Outlots O, P, S, and R, and the construction of several roads to
provide access to the home sites. The total area of Phase 8 is 27.451 acres. The Board originally
approved the Annexation Agreement for Chatham Square in February of 2005. Following amendments to
the annexation agreement in late-2006, the final plat for Unit 1 of Chatham Square was approved in
February of 2006, consisting of 12 single-family-detached home lots primarily for the builder’s proposed
model court area. The Final Plat for Phase 2 was approved in June of 2006, with 48 single-family-
detached home lots and 32 townhome units. The Final Plat for Unit 3 was approved in May of 2007 and
included thirteen (13) single-family-detached lots, and the Final Plat for Phase 4 was approved on
February 4, 2008, consisting of thirty-six (36) single family units. The Phase 5 Final Plat including 66
single-family detached lots, was originally approved on March 3, 2008, and reapproved on September 15,
2016. On March 3, 2008, the Final Plat of Phase 6 with 65 single-family detached lots was approved. It
was reapproved on July 15, 2019. Overall, the 145-acre Chatham Square project will have a total of 322
residential units, including 238 single-family detached homes and 84 townhome units.
Mr. Ding reviewed the staff report dated March 16, 2021. Mr. Ding concluded Staff finds that the
proposed Phase 8 final plat is generally consistent with the Concept Plan contained in the approved
annexation agreement, as well as the approved preliminary plat. Furthermore, the final plat meets the
requirements of the Subdivision Code and the Zoning Code. Subject to discussion by the Plan
Commission, staff recommends approval of the final plat subject to noted stipulations.
Chairman Kiefer swore in Greg Collins, M/I Homes. Mr. Collins explained their progression through
Chatham Square and added they have made no changes to the final plat from when it was originally
proposed years ago.
Commissioner Womack asked if all the homes will be single-family homes and if there are any multi-
family lots in the subdivision. Mr. Collins stated phase 8 is all signal-family lots and there is some multi-
family north of phase 8 and there is an undeveloped land to the north of that. Commissioner Womack

asked if the applicant will provide staff with the side yard setbacks. Mr. Ding asked the applicant to
provide the side yard setback since it was not in the annexation agreement. Mr. Collins stated it is on the
final plat under the lot condition. Chairman Kiefer asked Jon if he can confirm the side yard setback. Mr.
Proulx stated he will research and ensures that this will be resolved before it goes the Village Board.
Commissioner Womack appreciates that the applicant is continuing with the larger lot sizes.
Commissioner Seggebruch asked how Phase 8 will work with the proposed park development approved
by the Village Board a couple of years ago. Mr. Proulx explained the location of the park in relation the
subdivision. Mr. Collins added the park property is will be owned and maintained by the Oswegoland
Park District. Commissioner Seggebruch asked if the lots adjacent to the proposed park will be buffered
from the park. Mr. Collins stated typically that they do not screen from common area such as parks and
parks typically have landscaping. Commissioner Seggebruch asked if there is a current path. Mr. Collins
stated they will continue the path to Outlot O. Commissioner Seggebruch asked if they have received
feedback from Oswegoland Park District regarding this Phase. Mr. Collins confirmed that they are in
communication with the park district. Commissioner Seggebruch asked if the product offering in Phase 8
will be like what they are proposing in Willow Run. Mr. Collins indicated that the homes will be 3,000
sqft or larger and will continue the build the same plans they are building now.
Commissioner Ruane stated he likes that this subdivision offers different product types, which would
allow for example grandparents to move closer to grandchildren. Commissioner Ruane asked how M/I is
handling the current lumber situation. Mr. Collins indicated that the supply chains are having issues.
Commissioner Renzi asked if the side yard setback clarification needs to be addressed in the motion. Mr.
Ding stated that the 3rd Annexation Amendment adjusted the side yard setback to 7 feet. Chairman Kiefer
asked for clarification that there will not need to be a stipulation. Mr. Ding confirmed.
Commissioner Minnis thanked M/I Homes for keeping the larger lots and for all the development they are
doing in the Village.
Commissioner Heinen thanked M/I Homes for continuing the build in the Village.
Commissioner Renzi made a motion to recommend approval of the Final Plat for the Chatham Square
Phase 8 Final Plat of Subdivision, subject to the following two (2) stipulations:
1. Compliance with the requirements of the Village Engineer; and
2. Compliance with the requirements of the Plainfield and Oswego Fire Protection Districts.
Second by Commissioner Minnis. Vote by roll call: Heinen, yes; Ruane, yes; Seggebruch, yes; Womack,
yes; Minnis, yes; Renzi, yes; and Kiefer, yes. Motion carried 7-0.
1916-031121.SPR PLAINFIELD SMALL
BUSINESS PARK
VILLAGE OF
PLAINFIELD
Mr. Melrose stated in partnership with Northern Builders, Inc., the Village of Plainfield is proposing to
construct a 14,950 SF Plainfield Emergency Management Agency (PEMA) building at the Plainfield
Small Business Park. The project site is currently zoned I-1 Industrial District P.U.D. (rezoned to I-1 in
2017) and the proposed office/warehouse uses is considered a permitted use in the subject zoning district.
Mr. Melrose reviewed the staff report dated March 16, 2021. Mr. Melrose concluded the site plan is in
conformance with the Village Zoning Ordinance and is one of the key goals to the private-public

partnership with Northern Builders, Inc. and the Village of Plainfield to construct new facilities for the
Plainfield Emergency Management Agency.
Chairman Kiefer asked if Jake Melrose will be representing the applicant. Mr. Melrose confirmed.
Commissioner Heinen asked if there are loading docks and what are the purpose of them. Mr. Melrose
stated that larger vehicles will be stored in the building. Commissioner Heinen asked if all large vehicle
will be stored indoors only. Mr. Melrose confirmed. Commissioner Heinen asked if there are a lot of
visitors that come to a facility like this. Mr. Melrose stated there could be moment when volunteers are
needed during an emergency situation. Commissioner Heinen asked if the floodplain has been studied for
this area. Mr. Melrose confirmed.
Commissioner Minnis asked if there will be any enhancements made to the exterior of the building and
will there be signage. Mr. Melrose explained the building materials and the enhancements that will be
made and confirmed that there will be signage. Commissioner Minnis suggested that the building have
some enhancements.
Commissioner Renzi agreed that there building needs some exterior enhancements, and suggested
emergency lighting, and the addition of bollards or some security measures. Mr. Melrose stated the Chief
of Police is the lead on the design of the building and there is some design aspect of the building the Chief
is still working through, such as signage and safety features. Commissioner Renzi asked if tower on the
northwest side of the property is the allowable height per code, so no variance will be needed. Mr.
Melrose confirmed and added that it is for public use for transmission purposes. Commissioner Renzi
would like to tower be secure. Mr. Proulx indicated the agencies that were involved with reviewing the
site plan for the building and why tower is located where it is on the site plan.
Commissioner Ruane agreed with the comments regarding adding enhancements for the exterior of the
building. Commissioner Ruane indicated that a chain link fence is not an appropriate fence for a facility
that will possibly have outdoor storage and asked if there will be a gating system. Mr. Melrose stated he
is not aware if there will be a gating system and stated that enhanced landscaping and a privacy fence
recommendation will be taken into consideration. Commissioner Ruane suggested moving the garbage
enclosure so it is screened more and asked staff to investigate adding berm around the site for additional
protection.
Commissioner Seggebruch asked how tall the radio tower will be. Mr. Melrose stated the he does not
have that information at this time, but there are allowances for radio tower heights in I-1 zoning.
Commissioner Seggebruch suggested a sliding security gate and agreed with adding a berm around the
site. Commissioner Seggebruch asked what will happen to the existing building once the new building is
completed. Mr. Melrose stated that he is not aware what will happen to the building.
Commissioner Womack asked if we required Perlow Steel to construct a sidewalk on the eastside of
Wood Farm Rd. Mr. Melrose stated the Village will be reconstructing Wood Farm Rd., which will
include sidewalks. Commissioner Womack asked for clarification regarding if there will be outdoor
storage. Mr. Melrose stated he thinks the storage marked is for a garbage enclosure. Commissioner
Womack agreed that the fence should be more enhanced then chain link and suggested if a generator is
need onsite to have it located at the east end of the building. Commissioner Womack asked if the vehicles
are only deployed for community emergency situations. Mr. Melrose confirmed.

Commissioner Womack made a motion to recommend approval of the proposed site plan review for the
project known as the PEMA Site Plan at the Plainfield Small Business Park, subject to the following two
(2) stipulations:
1. Compliance with the requirements of the Village Engineer;
2. Compliance with the requirements of the Plainfield Fire Protection District;

OLD BUSINESS
1906-123020.TA TEXT AMENDMENTS TO THE
ZONING CODE
VILLAGE OF
PLAINFIELD
Mr. Melrose stated Village staff has initiated this proposed text amendment to various sections of the
Village of Plainfield Zoning Ordinance. The amendments cover Article II General Provisions Permitted
obstructions in required yards and Mobile Food Units; Article VI Table II.1 Permitted and Special Uses;
Article XI Signs of Chapter 9 – Zoning; Article XVI Definitions; and other miscellaneous amendments of
the Village of Plainfield Code of Ordinances.
Staff reviewed the staff report dated March 16, 2021. Staff concluded these proposed amendments are
being presented pursuant to Village Board direction. If approved, the changes would not prohibit any of
these uses, while giving the Board of Trustees additional control over their approval and placement.
Commissioner Seggebruch asked why banquet use was mentioned in the agricultural district.
Commissioner Seggebruch wants to make sure the changes to the truck & trailer parking language is more
stringent then what is currently in the code. Commissioner Seggebruch questioned why the use table for
Beauty/Nail Salon and Body Art Services is being changing. Commissioner Seggebruch is unclear if
staff is trying to make it easier for Food Trucks, since the changes were not clear to him. Mr. Melrose
stated the change to the non-accessory parking lot will still be in the code but the non-accessory parking
lot for semi-trucks and trail parking lot was added as an additional use and will prohibit semi-truck and
trail parking in all zoning districts, except with a Special Use in I-1 & I-2. Mr. Melrose explained that
staff looked at the Body Art services from a planning perspective and there have been several special uses
for them, so that caused staff to look at the code for changes. Commissioner Seggebruch wants to make
sure we are not lowering our standards for Body Art uses. Mr. Ding explained that most banquet uses are
currently in the B zoning districts and staff will consider a special use to agricultural district.
Commissioner Renzi asked for clarification if a banquet hall does not have a fully equipped kitchen is not
considered a banquet hall per the proposed changes. Mr. Ding stated the current banquet facilities in the
Village are able to provide dinning. Commissioner Renzi stated all banquet facilities would be able to
provide dining with or without a kitchen because they could have a catering service and suggested
striking the full kitchen language so there could be more compliance for the use. Commissioner Renzi
stated that staff has prohibited all attention getting devices and feels that all signs are attention getting
devices, so he suggested changing the language. Mr. Ding explained the intention of the change and
agreed to review the language, so it is not confusing. Chairman Kiefer stated he wants the language &
definitions to be clear, so the Village is not receiving variance requests for every sign. Commissioner
Renzi asked staff to look at the length of time a message needs to be displayed, since he thought is was 7
seconds but what is being presented is 5 seconds. Mr. Ding explained that previously there were two
categories for electronic message signs and staff is trying to merge them into one. Mr. Ding stated staff is
trying to balance the different requirements. Mr. Ding indicated staff will consider changing it to 7

second display. Commissioner Renzi asked under Mobile Food Trucks the preclusion of making or
storage nonalcoholic beverage, so it will be OK to prepare or store alcoholic beverage. Chairman Kiefer
stated that applicant will need to obtain a liquor license. Commissioner Renzi suggested adding verbiage
that alcohol sales/storage will require a liquor license with reference to the liquor license section in the
code. Commissioner Renzi suggested to change verbiage where there is a preclusion and exception, to
have the preclusions first and then the exceptions.
Commissioner Ruane stated the Food Truck amendments do not address special events, such as Plainfield
Fest. Commissioner Ruane suggested creating PUD language for Food Truck for special events. Mr.
Ding explained special events are approved by the Village so the Food Trucks will be allowed at them.
Commissioner Ruane stated that Food Trucks cannot be within 100 feet of a residence and this
amendment will impact several businesses and would like to staff to take that into consideration.
Commissioner Ruane would also like verbiage to limit Food Trucks from using generator when they can
connect to a permanent source of electricity, if not possible to limit the sound decibels of the generators.
Mr. Ding stated the intention to have a distance from residence for Food Trucks is that they would not
disturb the neighborhood. Chairman Kiefer asked that Food Trucks in a residential area should be
reviewed administratively, so variances are not required. Mr. Ding stated staff will continue to work on
these suggestions and concerns.
Commissioner Minnis agrees with the comments regarding “full kitchen” in the definition of a Banquet
Facility is important clarification to make. Commissioner Minnis does not want residential
neighborhoods to be required to get a special event permit for subdivision events for food trucks.
Commissioner Minnis asked that the definition of a Mobile Food Truck be very specific, so trailers,
storage containers, etc. are not allowed.
Commissioners Heinen and Womack had nothing further to add.
Commissioner Seggebruch is worried that there will be food trucks at a location year-round or a
homeowner having a private event at your home and inconveniencing their neighbors. Commissioner
Seggebruch felt a neighborhood event with multiple food truck should get a special event permit.
Chairman Kiefer stated that there are many concerns about the language for the Mobile Food Truck
amendments. Mr. Proulx advised the commission that the Mobile Food Truck amendments could be
updated by staff and brought back to the Plan Commission. Mr. Proulx suggested voting on all
amendments except the Mobile Food Truck amendments.
Commissioner Renzi made a motion recommend approval of the proposed text amendments, excluding
the proposed amendments for Mobile Food Trucks, to the Village of Plainfield Zoning Ordinance as
outlined in the staff report.
Second by Commissioner Ruane. Vote by roll call: Heinen, yes; Minnis, yes; Seggebruch, yes; Womack,
yes; Ruane, yes; Renzi, yes; and Kiefer, yes. Motion carried 7-0.

Village Board and Plan Commission,
Over the past two weeks, many have vocally opposed the proposed high density rental development
at the corner of Route 59 and Renwick Road.
The developer has made one thing clear: he wants to make this an age targeted development and
not an age restricted development. According to the Fair Housing Act, a developer or landlord is not
allowed to discriminate based on familial status unless he meets certain requirements. One of the
requirements to qualify for the "55 or Older" exemption is having 80% of the units occupied by one
person 55 or older. If you do not meet this requirement, he would, by Federal law, have to rent to
anyone regardless of age or familial status. Details found

The way I see it, even being a 55+ community does not mean there will be no younger residents and
no children. So, even if he wanted to make it an age restricted community with rules that match
Federal law, the community very well could have more than 1 or 2 people per unit and it very well
could have children in it. This would burden the school system and would make the people per acre
far more dense than expected.
If you assume the worst, like I do, he is simply using the "age targeted" designation to push it
through the Village approval process and then open it up to anyone. If you approve this as age
targeted, all he would have to do is say, "I can't discriminate based on age, so I have to rent to all
ages." At that point, the Village would have been hoodwinked into approving this development and
it would be too late to undo the mistake.
There are so many reasons to stop this development dead in its tracks. Avoiding being tricked into
approving a development that turns out different than it was presented is just one of them.

If you haven't already, I would involve the Village's legal counsel to see what exposure you might
have with this kind of proposal. Your attorney surely would not allow you to enforce a policy that
violates the Fair Housing Act.

Sec. 9-26. – Mobile food units (UPDATED)
(1) Definition:
Mobile food unit. A mobile food unit shall be an establishment that is vehicle-mounted or
motorized to be readily movable with a commercial license and shall be used solely for
mobile food and beverage vendors.
Base of operation. A location that a mobile food unit will be stored, cleaned and maintained
when not in operation. It is also used to store extra food and food related items.
Special event. Temporary, short-term occurrences that are sponsored by a church, school,
or any other community service organization; or are held by any business or organization,
which event is associated with a temporary outdoor use that has been approved by the
village president and board of trustees in accordance with section 9-27(1)(c).
(2) Application Procedures:
a. Mobile food unit operators must obtain a business license from the village building
department.
b. As a condition of receiving a business license, the mobile food unit operator must
submit approval documents issued by the applicable (Will or Kendall County) Health
Department and (Plainfield or Oswego) Fire Protection District, a certificate of
commercial general liability insurance with limits of not less than $1,000,000 per
occurrence, as well as provide proof of the required sales tax registration with the State
of Illinois.
c. In order for parked/stationary mobile food units to conduct sales activities, the vendor
or the host location (host business or property owner/property manager) of
the mobile food unit must obtain a site permit from the village planning department.
This may only occur after the applicant has received the approval of a business license
from the village building department.
d. Each approved site permit shall only apply to one (1) mobile food unit operator for one
(1) period of business at the proposed location.
e. Any continuation of the current business being run at the same location after the end of
the valid site permit or any changes to the business plan shall require the mobile food
unit applicant to submit a new site permit application package to the village planning
department for review. The new site permit shall require the applicant to comply with
the rest hours and accrual requirements explained in Item e.
f. Mobile food units may not be operated until all the approval documents are issued.
(3) Site Permit Requirements. A site permit issued by the village planning department is
required for a mobile food unit operator to run business in the village. The following
information shall be required in order to complete the site permit application:
a. Mobile food unit applicants shall submit a written consent document from the owner
or manager of the proposed private non-residential lot location with an illustrative
location map to demonstrate compliance with the siting requirements explained in Item
14
d to the village planning department along with a completed site permit application
form.
b. Mobile food unit applicants proposing to operate in residential subdivisions shall reach
out to the subject Homeowner Association (HOA) to receive a written consent
document from the HOA prior to submitting the site plan application to the village
planning department.
c. For special events held regularly by public or non-profit organizations, event organizers
or mobile food unit operators may apply for an annual permit by submitting one (1)
site permit application listing all event dates and locations in the calendar year.
Applicants shall submit a new application to the village planning department for review
if the approved event plan is changed.
d. Mobile food unit applicants shall provide final menus to the village planning
department for review upon submitting the site permit application.
e. Mobile food unit applicants shall provide graphics illustrating the owned mobile food
unit, site plan and location, to the village planning department for review.
f. Variances. No requests for variances shall be permitted other than the approval
received by the village administrator or designee.
(4) Zoning Districts:
a. Mobile food units are allowed in the zoning districts identified in Table II-1.
b. Mobile food units are prohibited as a principal use and shall not be operated on a vacant
public or private property.
(5) Locations:
a. Rights-of-way:
i. Unless expressly authorized by the village administrator or designee, mobile food
units are prohibited from operating in a parked/stationary manner in public rights-
of-way (except for in residential subdivisions) or on public properties, for example,
in on-street public parking spaces. Anticipated exceptions include operation during
special events approved by the village administrator or designee.
ii. Mobile food units may park on private properties or rights-of-way in residential
subdivisions with written consent provided by the property owner and the local
Homeowner’s Association, but shall not block entrances, sidewalks, bike lanes,
driveways, fire lanes, or traffic flows on private properties.
iii. Mobile food units shall not park within fifty (50) feet of the center of any street
intersections measured from the intersection of street centerlines.
b. Parking Surface. Mobile food units shall park on a paved surface only such as concrete,
bricks, or asphalt, and shall not park on unpaved surfaces such as gravel, mud, or grass.
c. Spacing:
i. Unless expressly authorized by the village administrator, or designee, or received
written consent letter from the nearby businesses, mobile food units in non-
residential zoning districts shall not operate within five hundred (500) feet of the

property line of any brick-and-mortar food establishments. Such written
agreements shall be submitted along with the site permit application to the planning
department.
ii. Unless expressly authorized by the village administrator or designee, mobile food
units shall not operate within five hundred (500) feet of the property line of any
school during school sessions.
iii. Unless expressly authorized by the village administrator or designee, each mobile
food unit shall be at least two hundred and fifty (250) feet apart in all directions on
the same property.
iv. Unless expressly authorized by the village administrator or designee, mobile food
units that are not part of a special event, shall not be operated within five hundred
(500) feet of any festival, special or civic event sponsored or permitted by the
Village.
v. Unless expressly authorized by the village administrator or designee, mobile food
units, when operating on nonresidential properties, shall not operate within fifty (50)
feet of an adjacent residential property line.
d. Maximum number of mobile food units. Unless expressly authorized by the village
administrator or designee, no more than three (3) mobile food units shall be permitted
on a private property at the same time. Maximum of mobile food units shall be
calculated upon a ratio of paved area per mobile food unit:
Twenty-five thousand (25,000) square feet per mobile food unit
The calculation of paved area shall not include any space that is conflicting with other
uses or activities in that area occurring simultaneously while the mobile food unit is in
operation.
e. Access. Mobile food units shall not block ingress or egress of other businesses or
building entrances or emergency exits.
f. Parking. All mobile food units shall not park on a permitted lot overnight after business
hours. Instead, they shall park at the reported base of operation locations.
(6) Business Operations:
a. Setup:
i. Vehicle Requirements. A mobile food unit shall be licensed and shall not be used
for vending an approved product unless the vehicle has been designed and
constructed specifically for such purpose.
ii. License and permit display. Mobile food units shall place all received permits and
licenses from the Village as well as the applicable County Health Department near
the serving window where customers receive their merchandise on the vehicle.
Failing to do so may cause suspension of the village business license and site permit.
iii. Permitted sales. Mobile food units shall only sell food and non-alcoholic beverages
that are listed on the menu that has been approved by the village planning
department.

iv. Merchandise Preparation:
1. Food and non-alcoholic beverages sold from a mobile food unit shall not be
prepared or stored in a residential home.
2. No open flame cooking shall be permitted except that such activity may take
place if permitted by the applicable County Health Department and the fire
department.
3. The mobile food unit site permit applicant must identify the base of operation
location for food preparation and storage in the site permit application.
v. Style of sales:
1. Services provided by mobile food units shall be limited to grab-and-go.
2. No tables and chairs or non-disposable containers, plates, or utensils shall be
provided by mobile food unit vendors to the customers. No non-disposable
articles can be reused.
vi. Signage. No signs or attention-seeking devices shall be displayed except for the
signage or graphic designs painted on the mobile food units.
vii. Noise limitations. No amplified music or loudspeakers shall be permitted.
Generators for mobile food units shall be prohibited anywhere in the village.
viii. Catering. Mobile food units used for catering services, as part of a private event,
must not provide general sales to the public.
ix. Waste collection and hygiene management:
1. A trash receptacle and a recycling receptacle shall be equipped within twenty
(20) feet from a mobile food unit.
2. Ground within a twenty-five-foot (25’) radius of the mobile food unit shall be
kept neat and orderly at all times.
3. Garbage must be removed by the mobile food vendors prior to leaving the
premises each day or changing locations. No receptacles should remain on the
property at the end of operations each day.
b. Hours of Operation:
i. Frequency:
1. Unless otherwise permitted as part of a special event with the approval of the
village administrator or designee, mobile food units are prohibited from
operating in a stationary manner, without relocating, at a given location for a
period exceeding twelve (12) hours in one (1) calendar day.
2. Mobile foot units are prohibited from operating at a given location for more
than twenty-eight (28) days in a calendar year, unless prior approval is granted
by the board of trustees to exceed twenty-eight (28) days of operation at that
location.
ii. Daily hours limitation. Daily hours of operation in non-residential zoning districts
shall be between seven (7) a.m. and seven (7) p.m., and shall be between nine (9)
a.m. and seven (7) p.m. in residential zoning districts, unless otherwise permitted

as part of a special event with the approval of the village administrator or designee.
Last call sales shall start thirty (30) minutes prior to the end of the proposed hours.
iii. Rest period. Unless permitted as part of a special event with the approval of the
village administrator or designee, mobile food units must observe a forty-eight-
hour (48) wait period between operations at the same location. A new completed
site permit application must be submitted to the village planning department for
review.
(7) Enforcement and Penalty:
a. Violations. It shall be unlawful for any mobile food unit vendors who obtain the village
mobile food unit business license and the site permit to violate, disobey, neglect, omit,
refuse to comply with, or resist the enforcement of any of the provisions of the mobile
food unit regulations.
b. Enforcement. The Village shall investigate all alleged instances of code violations. If
the code violation covers the applicable County Health Department’s Food Code, the
applicable County Health Department shall be notified by the village and has the
authority to initiate the investigation.
c. Notification of violation. If the Village determines that a violation exists, the Village
shall notify, in writing, the mobile food unit vendors within three (3) business days. If
the code violation happens in a residential subdivision, a copy of such written
notification of violation shall be mailed to the local HOA for their record. If the code
violation is related to the County Food Code, such copy of the written notification of
violation shall be mailed to the relevant County Health Department. The mobile food
unit vendors must eliminate the violation immediately upon the initial presence of the
Village staff due to the code violation.
d. Penalties. The Village may suspend or revoke the village business license and site
permit for violations of the ordinance. The Village may impose fines against any
mobile food unit vendors or any agent for violations of the ordinance in an amount not
exceeding seven hundred and fifty dollars ($750.00). Each day that a violation
continues to exist shall constitute a separate offense. If the revocation or suspension of
the permit is caused by the permitee, there shall be no refund of any fees paid to the
Village for operation of a mobile food unit.

Sec. 9-16. - Accessory buildings, structures, and uses of land.
(9) [Mobile food units.] Mobile food units shall be permitted pursuant to the following
requirements and limitations:
a. Mobile food units are allowed in the zoning districts identified in Table II-1.
b. Mobile food unit operators must obtain a business license from the village. As a
condition of receiving a business license, the mobile food unit operator must demonstrate
compliance with the requirements of the applicable (Will or Kendall County) Health
Department and (Plainfield or Oswego) Fire Protection District, as well as provide proof
of the required sales tax registration with the State of Illinois.
c. For parked/stationary mobile food units, the host location (host business or property
owner/property manager) of the mobile food unit must obtain a site permit from the
planning department.

South: Clarence Davids & Co. (Unincorporated Will County A-2)
West: Plainfield Walmart Commercial Subdivision (B-3 Commercial); Route 59 (Major
Arterial)
ANALYSIS
Background
Belle Tire is an automotive service retailer that sells and installs vehicle tires and offers minor
automotive repairs. They have just under 150 locations in Michigan, Ohio, and Indiana and are
expected to begin construction on eight locations in Illinois, including one located in adjacent
Joliet.
The subject property is currently zoned B-3 Highway Business District. In accordance with
Section 9-13 of the Zoning Ordinance, auto body and repair is permitted with a special use in the
B-3 zoning district. Approval of the special use for planned development authorizes the auto
body use associated with the proposed business and also incorporates some flexibility from
Article XI of the Zoning Ordinance related to signage.
Special Use Planned Development
The applicant is seeking a special use permit for a planned development to allow an auto body
and repair use as well as three variations from Article XI – Signs of the Zoning Ordinance in
order to permit a wall sign on the north elevation and mount a 600 square foot United States flag
on a 60-foot pole.
In order for the Plan Commission to recommend approval of a special use, it must make two
findings of fact, as follows:
a.) The special use will not be injurious to the use and enjoyment of other property in the
immediate area for the purposes already permitted, nor substantially diminish property
values within the neighborhood; and
Staff finds that the special use will not be injurious to the use and enjoyment of other
property in the immediate area. The site is adjacent to Route 59, a major arterial, and is
designated as “General Commercial” in the Village’s Comprehensive Plan. It is also
located adjacent to existing commercial and light industrial land uses.
b.) The establishment of the special use will not impede the normal and orderly development
and improvement of the adjacent properties for uses permitted in the subject zoning
district.
Staff submits that the proposed auto body and tire shop is compatible with the existing
commercial and light industrial uses located within the immediate area.
Separately, there are additional findings below that must be demonstrated in order to recommend
approval of a planned development.

a. The planned development fulfills the objectives of the comprehensive plan and the land use
policies of the Village and presents an innovative and creative approach to the development
of land and living environments;
The proposed commercial development fulfills the objectives of the comprehensive plan and
the establishment of ingress/egress from Route 59 positions the property for further
commercial investment along a heavily trafficked corridor in the Village.
b. The proposed land uses fulfill, or can reasonably be expected to fulfill, a need or demand for
such uses within the Village;
Staff submits that the proposed auto body repair and tire shop will fulfill a need or demand in
the Village.
c. The physical design of the planned development efficiently utilizes the land, adequately
provides for transportation and public facilities, and preserves natural features of the site,
and that the property is suitable for the proposed purposes and land uses;
Staff submits that the planned development is suitable for the proposed land use and that the
proposed site plan and parking adequately provides for the subject development. The
physical design of the site promotes efficient circulation by incorporating cross access among
multiple parcels and shared access to public streets.
d. Any exceptions to bulk and density regulations of the underlying zoning shall be solely for
the purpose of promoting an efficient and coordinated site plan, no less beneficial to the
residents or occupants of such development, as well as the neighboring property, than would
be obtained under the bulk and density regulations of this ordinance for buildings developed
on separate zoning lots;
No variations from the bulk and density standards of the Zoning Ordinance are being sought.
The petitioner is seeking two variations from the sign code based on the typical sign branding
package for Belle Tire.
e. The planned development meets the requirements and standards of the planned development
regulations;
Staff submits that the planned development meets the requirements and standards of the
planned development regulations.
f. Open spaces and recreational facilities are provided;
The proposed commercial building does not initiate the requirement for a plaza or outdoor
seating area.
g. The planned development is compatible with the adjacent properties and the neighborhood,
and along the periphery of the planned development, yards or setbacks shall be provided that
meet or exceed the regulations of the district in which the planned development is located;

The proposed development is compatible with adjacent auto-oriented land uses. Although the
eastern boundary of the site abuts a multifamily residential zoning, it is substantially buffered
by an existing grove of mature trees as well as the detention pond located along the eastern
side.
h. That the land uses permitted are necessary or desirable and are appropriate with respect to
the primary purpose of the planned development;
Staff submits that the land uses permitted are necessary and desirable with respect to the
primary purpose of the planned development.
i. That the land uses are not of such a nature, or so located, as to exercise a detrimental
influence on the surrounding neighborhood.
Staff submits that the auto body repair and tire shop that is proposed shall not pose a
detriment to surrounding property and is compatible with the nearby commercial and
industrial land uses located east of Route 59.
Site Plan Review
Site Plan/Access/ Circulation
The Belle Tire development proposes a 9,800 square foot building on Lot 1 (1.197 acres) of the
Sohol Commercial Center Subdivision. The ingress/egress identified on the site plan includes a
right-in/right-out from Illinois Route 59 and private road access from Rhea Drive (public street)
to the north. The entrance from Route 59 is currently under review by the Illinois Department of
Transportation (IDOT). Cross-connection access easements are proposed between the subject
Belle Tire lot and the remainder of the site so that all lots benefit from multiple access points and
use of the lighted intersection at West Industrial Drive and Illinois Route 59.
Within the proximity of the site, there are existing pedestrian sidewalks located along West
Industrial Drive. Although the sidewalk is currently interrupted along the McDonald’s frontage,
staff supports the addition of sidewalks along the Route 59 frontage of this parcel. Doing so not
only provides a pedestrian connection to nearby commercial businesses, but to future lots
developed on this site. The applicant agrees to work with the Engineering Department during
final engineering review to identify the best method for a pedestrian connection. Barring any
engineering related issues, sidewalks will be incorporated.
Trash Enclosure
A trash enclosure is identified at the southeast corner of the parking lot that incorporates brick
veneer to screen the refuse/recycling containers as well as to match the style and color of the
principal building.

Elevations/Façade/Architecture
The architectural plans illustrate the use of brick veneer on all elevations with the roofline being
enhanced with continuous cornice, frieze, and brick soldier course as decorative elements. The
entryway projects from the main façade for distinction, highlighting the entrance. The proposed
architecture complies with the Village’s design standards.
Signage
The signage illustrated on the architectural plans are representative of the type of signage that is
consistent with the typical branding package for Belle Tire. As part of the planned development,
the petitioner is requesting the following flexibility with respect to permitted signage on the site:
1) 20’x30’ United States flag mounted on a 60-foot flagpole (50 sf and 25 ft per code)
2) An additional wall sign to be located on the north elevation that is consistent in size with
signage on the front and south elevations.
Landscaping/Lighting
A landscaping plan has been provided as part of the site plan review application. As mentioned
previously, the remainder of the site, which may incorporate one or two additional users, will be
subject to future site plan review. The detention area, to be shared between all users, will follow
Best Management Practices, and incorporate native detention basin storm water and prairie seed
mixes. With respect to requirements in the Zoning Ordinance, staff highlights the following:
x A landscape berm is provided at the Route 59 frontage that incorporates five (5) trees,
fifty-seven (57) shrubs, eighteen (18) ornamental grasses and fifty-seven (57) perennials
to form an attractive cluster of plantings.
x Parking lot screening has been provided for the subject development to screen parking
spaces from view. Staff suggests varying the plantings proposed along the rear access
drive from Rhea Drive to beautify this secondary point of ingress/egress.
x Foundation plantings have been incorporated along the front elevation of the new
commercial building. Foundation plantings are absent from elevations where bay doors
and necessary ingress and egress may not be obstructed.
x There is an existing landscaping hedge and retaining wall located along the northern
property line that is shared between this site and McDonald’s. Staff will work with the
applicant during final engineering on the possibility of incorporating additional plantings

in this area. That being said, this area is at a lower elevation than the adjacent lot and will
not be visible from the Route 59.
The photometric plan complies with the Village of Plainfield Zoning Ordinance with respect to
the type and height of proposed light fixtures and the maximum light spillover allowed at
property lines. Lighting incorporated at points of ingress/egress will be coordinated between
Belle Tire and current property owner for the remainder of the site.
Stormwater Management
The detention pond is identified on the eastern side the Belle Tire development bordered by an
existing grove of trees on the east and the access drive from Rhea Drive on the west. At present,
the detention pond is proposed to be constructed with enough storage capacity to accommodate
Lots 1 and 2. The shared detention easement is formalized on the final plat of subdivision.
PRELIMINARY/FINAL PLAT REVIEW
The subject property is currently 7.253 acres of unimproved land located that is triangular in
shape. The final plat identifies the subdivision of the property into three (3) lots. Lot 3
incorporates the shared detention pond. The proposed lots conform to the Village Zoning
Ordinance. All proposed easements will be reviewed at final engineering but incorporate a
shared detention easement and cross-access easements.
CONCLUSION/ RECOMMENDATION
In conclusion, staff believes that the proposed use is appropriate at the subject location and
supports the variations requested from the Zoning Ordinance. Based on the foregoing analysis,
prior to any public comment or discussion by the Plan Commission, staff recommends approval.
