ITEM #2: Rezoning Requests (7:00) a) To rezone .61 ac on the west side of Churton St. from OI and R-20 to Central Commercial (TM 4.36.E.18, 21 & 22) (228 Group/Calvin Ray). b) To rezone approximately .5 ac on the south side of Cornelius St. from R- 10 to General Commercial (TM 4.14.A.4a & 7a) (Elsie Davis & Kathryn Peele). c) Brad Walker to rezone 11.01 ac from AR to Multi -family. The property is north of the railroad and south of King James and King Charles Roads (TM 4.38.A.2b). ITEM #4: Zoning Ordinance Text Amendments (approx. 7:25) a) Amend Section 9.8 to clarify when a use with non -conforming characteristics must come into complete compliance. ITEM #5: Close public hearing and adjourn Planning Board. ITEM #6: Town Board/Parks & Recreation Board joint meeting to discuss items of mutual interest. Dean, Jonathan Butler, Beth Velliquette, Margaret Hauth ITEM #1: Mayor Johnson called the hearing to order and passed the gavel to Planning Board Chair Taylor. Taylor briefly described the hearing process and order of business. He also asked the public to not present duplicate information as there is a second meeting scheduled immediately following the hearing. ITEM #2a: Hauth described the Ray/228 Group request to rezone from Residential -20 and Office -Institutional to Central Commercial. She indicated the property location on the map and noted it was back for public hearing at the Town Board's request. Olson spoke and noted she is part owner in the 228 Group. She noted the current dangerous situation created by the intersection of Churton and N & K Streets in such close proximity to the intersection with Exchange Park Lane. She added that the intersection problem is separate from the rezoning request and should be addressed regardless of the rezoning outcome. J. Boericke spoke against the request. He said that the area is a residential neighborhood and commercial development should not be allowed to intrude. Burel spoke against the request. He said he moved to the neighborhood years ago because of its character. He added that he had raised his family in the neighborhood, just as other members of the community doing are now. He said approving the rezoning, which to him has not been justified, will open the property up to many types of development and encourage a domino effect of rezonings in the block. G. Dean spoke against the request. He said there is a considerable amount of commercially zoned land in town which is currently unused or under -used. He questioned the need to rezone additional property, especially when its adjacent to a residential neighborhood. ITEM #2b: Hauth described the Davis and Peele request to rezone from Residential -10 to General Commercial. She indicated the property location on the map and noted the adjacent properties were recently rezoned General Commercial. She said these two properties were not included in the original request because of inaccuracy in ownership records and unclear handwriting. Smith asked for clarification of the map's color coding and Hauth explained. There were no public comments. ITEM #2c: Hauth described the Walker request to rezone 11.01 acres from Agricultural -Residential to Multi- family. She added that a portion of the property is also railroad right-of-way and the buildable portion is 8.4 acres. She said that 20% of the owners within 100' have submitted a protest petition against the request and indicated the location of the signers on the map. She added that the petition requires the Town Board to vote with a 3/4 majority if they choose to approve the request. Walker spoke on behalf of his request, saying he would gladly answer any questions the members had and asked their support for desperately needed, high-end rental housing in Hillsborough. E. Hicks spoke against the request. She presented petitions signed by 75 neighborhood residents opposing the multi -family zoning. She said they had opposed Walker JPH 4/23/96, page 2 family rezoning requests on this property in the past and they will continue to do so. She said the neighbors are concerned about increased traffic and continuing water pressure concerns. T. Deaton spoke in opposition to the request. He said that the property he and his wife own has been in her family for many years. He noted that the area in question is residential and agricultural in nature. He noted that he and his wife are in the process of trying to move back to the family property. Casper spoke against the request. He said the neighborhood is safe, secure, and tranquil as it is. He continued that the development of the property would ruin those qualities. He added that since Walker is a neighbor, they had hoped for neighborly behavior from him. He asked the board to reconcile the three constituencies involved: the neighborhood, Mr. Walker, and God. ITEM #3: Hauth introduced the proposed amendment to Section 9.8 to clarify when properties with non- conforming characteristics need to come into compliance. She noted that with increasingly strict development standards, it is sometimes unreasonable to require properties to come in to complete compliance before they can expand. She added that the amendment would allow the Board of Adjustment to review the specific facts of a situation and determine what improvements will be required.
