HomeMy Public PortalAbout05/28/1962 Special CCM190 SPECIAL MEETING OF THE COUNCIL OF THE VILLAGE OF MEDINA MAY 28,1962 Meeting called to order at 8 PM by Mayor Scott, all council members present. Bldg. permit application of Merle Baker to construct a 28 x 28 foot basement under his present home on undersized lot, lots on both sides occupied and he has no possiblity to acquire more land, planning commission had recommended granting this permit. Motion by Arthur Gertz to grant Merle Baker the building permit, second by H. Winterhalter, motion carried. J K Heymer presented a registered land survey for approval by the council. The question of provideing a road to the lots was discussed at length as the survey porvided for a 40 ft. private driveway which would be jointly owned by the lot owners. Attorney Geo Hedlund suggested thata restriction be put on the deeds prohibiting the land owners from ever requesting the Village for a public road, thus protecting the village in future years from being forced to provide a road. Heymers attorney and Geo Hedlund were to meet and draw up the necessary deed restrictions. Motion by Herb Arens to accept the registered land survey presented by J K Heymer relating to his property on Mooney Lake Road, in Section 25, Township 118, range 23, provideing there is a deed restriction on the titles thet the purchaser of a lot relinquishes his right to a public road, and also providing that he satisfy the requirements of the ordinance in relation to Village parks, second by Harold Winterhalter, motion carried. The referance to the ordinance on parks pertains to the requirement that 5% of the land in plats be set aside for public use. Hedlund suggested that the village set a value of $1,000. an acre on the land, then the seller, isetead of setting aside the land could put a like amount in the village park fund. This could be done either on the basis of 5% of the selling price or on the basis of $1,000. per acre. Mel Sherman appreared with a request for a driveway foom his lot in Medina Meadows onto County road 116. He was informed that his driveway should go onto Meander lane. Sherman slued he had apporval from Hennepin County Highway Dept for this driveway. Mayor Scott said he would check with the County and report at next council meeting. Motion by H. Winterhalter to grant Medina Recreations, Inc. an off sale liqour license, second by H. Arens, Motion carried, all yes. Motion by Herb Arens to grant Marlin N Langhorst and Mervin Hulke an off sale liqour liceaee, seconed by Arthur Gertz, motion carried, all yes. Motion by Haredi1 Winterhalter to grant Laura Molitor an off sale ligo8r licsense second by H Arens, Motion carried, all yes. Motion by H. Wintehhalter to grant Bernard Leuer an off sale liqour licsense , second by H. Arnes, motion carried, all yes. Motion by Arthur Gertz to grant an on sale liqour license to Joseph A Raskob, Medina Recreations, Inc second by H. Winterhalter, motion carried. Motion by H. Arens to grant Laura Molitor an on sale liqour licesne, second by Arthur Gertz, motion carried. Motion by H Winterhalter to grant Marlin N Langhorst and Mdrvin Hulke an on sale liqour licesne, second by H Arens, motion carried. Arthur Gertz asked ghat had been done about the dancing at the 55 club. Mayor Scott reported he had written a letter to them telling them of the Village Ordinance which prohibits dancing in a setup such as they have and telling them also that they would be given time to consult theier attorney and appear before the council to state their case fefore the ordinance gould be enforced. Interrogation papers concering the Boyer Garbage case were 100000009 answered by the council, Attorney Hedlund will move the court for a motion that questions 1,2, and 3 of Plaintiff"s request for admission are irrelevant. Village engineer suggested that street subdivision specifications requireing plait mix bitumious surfacing be attached to the contracts for street construction. Motion by H. Arens to grant Henry Neumann a special use permit to build a dwelling provided that the existing house be moved from the property or not used as a dwelling., second by A Gertz, Motion carried.
