HomeMy Public PortalAboutMIN-CC-2000-03-28MOAB CITY COUNCIL REGULAR MEETING March 28, 2000 The Moab City Council held their regular meeting on the above date in the Council Chambers of Moab City Offices, located at 115 West 200 South, Moab, Utah. Mayor Karla R. Hancock called the Pre -Council Workshop to order at 6:30 p.m. Mayor Hancock called the Regular City Council Meeting to order at 7:00 p.m. Councilmember Rob Sweeten led in the Pledge of Allegiance. Also in attendance were Councilmembers Kyle Bailey, Kirstin Peterson, Joseph Lekarczyk and Gregg W. Stucki; City Manager Donna Metzler, City Recorder Rachel Ellison, City Treasurer Laurie Ramstetter, Zoning Administrator/Planning Assistant Debra Gilger, Public Works Director Brent Williams, City Attorney Chris McAnany, Acting Temporary Police Chief Michael NaVarre, and Temporary Planning Assistant Janet Lowe. Twenty-four (24) members of the audience and media were present. There were no Minutes to approve. There were no Citizens to be Heard. Joanne Savoie of the Moab Arts and Recreation Center Board made a Presentation. The Presentation Regarding Used Oil was canceled. County Councilmember Al McLeod made a presentation regarding a Solid Waste District Report. Under Planning Update, Zoning Administrator/Planning Assistant Debra Gilger stated that the City Spring Clean-up was scheduled for April 14 and 15, 2000. Zoning Administrator/Planning Assistant Gilger also stated that she had been working on a project to replace the streetlights on Main Street that block the sidewalk in the City right-of- way. Ms. Gilger stated that she would be coordinating the replacement with Public Works, Utah Power and Light and the Utah Department of Transportation. Councilmember Peterson suggested that now would be the time to look into night sky friendly lighting. Ms. Gilger stated that Utah Power and Light Engineers had suggested shorter lights of twenty (20) feet. Mayor Hancock inquired if the trees would be able to grow higher and require less pruning. Ms. Gilger stated that all electrical wires would be underground now. Councilmember Bailey moved to Approve a Request for a Special Events License for the Moab Rod Benders' Car Show to be held on April 28, 29 and 30, 2000. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Sweeten moved to Approve a Request for a Moved -on Structure Permit for Sheldon Hefner, d.b.a. Cabin Kettle Corn, located at 83 South Main Street to Conduct a Kettle Corn Business. REGULAR MEETING & ATTENDANCE APPROVAL OF MINUTES CITIZENS TO BE HEARD MOAB ARTS AND RECREATION CENTER BOARD PRESENTATION USED OIL PRES. CANCELED SOLID WASTE DISTRICT REPORT PLANNING UPDATE SPECIAL EVENTS LICENSE FOR THE MOAB ROD BENDERS' CAR SHOW TO BE HELD ON APRIL 28, 29 AND 30, 2000, APPROVED MOVED -ON STRUCTURE PERMIT FOR SHELDON HEFNER, D.B.A. CABIN KETTLE CORN Councilmember Peterson seconded the motion. The motion carried 5- 0 aye Councilmember Bailey moved to approve a Request for the use of Swanny City Park by the Moab Christian Center to Conduct a Worship Service on May 21, 2000 with the understanding that it will not be exclusive use of the park. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye. Councilmember Sweeten moved to approve a Request to Send Proposed Ordinance #2000-03 - An Ordinance Amending Chapter 15.44 of the Moab Municipal Code Regarding Sign Code to Public Hearing with the change that bicycle racks be changed to one square foot. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve Proposed Ordinance #2000- 02 - An Ordinance Amending Chapter 17.70 of the Moab Municipal Code Regarding Bed and Breakfasts with the provision that the Ordinance be applied prospectively to new Bed and Breakfasts Applicants and Licensees after the effective date of the Ordinance. Councilmember Lekarczyk seconded the motion. The failed 2-3 nay with Councilmembers Bailey and Lekarczyk voting aye. Councilmember Peterson moved to approve Proposed Ordinance #2000-02 - An Ordinance Amending Chapter 17.70 of the Moab Municipal Code Regarding Bed and Breakfasts with the change that Owner be defined as holding not less than fifteen percent (15%) of total equity and the provision that the Ordinance be applied prospectively to new Bed and Breakfasts Applicants and Licensees after the effective date of the Ordinance. Councilmember Sweeten seconded the motion. The motion carried 3-2 aye by a roll -call -vote with Councilmembers Lekarczyk and Bailey voting nay. Councilmember Stucki moved to approve a Request for a Proposed Zone Change Located at 606 South Main Street from FC-1 to C-3. Councilmember Bailey seconded the motion. The motion failed 1-4 nay with Councilmember Stucki voting aye. Councilmember Peterson moved to grant authority to City Manager Metzler to negotiate a Sewer Agreement with Grand Water and Sewer Service Agency. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve Proposed Resolution #05- 2000 - a Resolution Approving the Interlocal Agreement for the Coordination of North Corridor Planning by and between Grand County and the City of Moab. Councilmember Sweeten seconded the motion. The motion carried 3-2 aye with Councilmembers Bailey and Lekarczyk voting nay. Under Reading of Correspondence, Mayor Hancock stated that she had received a letter from Izzy Nelson requesting that the part of Millcreek Parkway on the west side of the Main Street Bridge be open to the Public. Councilmember Sweeten stated that he had received numerous calls regarding the Moab Arts and Recreation Center. Under Administrative Reports, City Manager Metzler stated that staff had been working on the Fiscal Year 2000-2001 Budget, which would be presented to the Council next week. REQUEST FOR THE USE OF SWANNY CITY PARK BY THE MOAB CHRISTIAN CENTER TO CONDUCT A WORSHIP SERVICE ON MAY 21, 2000, APPROVED PROPOSED ORDINANCE #2000-03 - AN ORDINANCE AMENDING CHAPTER 15.44 OF THE MOAB MUNICIPAL CODE REGARDING SIGN CODE SENT TO PUBLIC HEARING PROPOSED ORDINANCE #2000-02 - AN ORDINANCE AMENDING CHAPTER 17.70 OF THE MOAB MUNICIPAL CODE REGARDING BED AND BREAKFASTS WITH THE PROVISIONS, FAILED PROPOSED ORDINANCE #2000-02 - AN ORDINANCE AMENDING CHAPTER 17.70 OF THE MOAB MUNICIPAL CODE REGARDING BED AND BREAKFASTS WITH THE PROVISIONS, APPROVED REQUEST FOR A PROPOSED ZONE CHANGE LOCATED AT 606 SOUTH MAIN STREET FROM FC-1 TO C-3, FAILED CITY MANAGER GRANTED AUTHORITY TO NEGOTIATE A SEWER AGMT W/ GRAND WATER AND SEWER SERVICE AGENCY PROP RES. #05-2000 - A RES. APPROVING THE INTERLOCAL AGREEMENT FOR THE COORDINATION OF NORTH CORRIDOR PLANNING, APPROVED READING OF CORRESPONDENCE ADMINISTRATIVE REPORTS City Manager Metzler stated that she and several Councilmembers had attended the first Law Enforcement consolidation meeting on March 27th. City Manager Metzler stated that City staff was continuing to work on the City Web Page. Under Mayor and Council Reports, Mayor Hancock read a statement regarding Law Enforcement Consolidation. Discussion followed. The Council reached a consensus to direct City Manager Metzler to inform Grand County that the City will not pursue law enforcement consolidation. Councilmember Stucki moved to pay the bills against the City of Moab in the amount of $21,059.32. Councilmember Bailey seconded the motion. The motion carried 5-0 aye by a roll -call -vote.
