Special Session
August 22, 1989
The Greencastle Common Council met in special session on Tuesday, August 22, 1989
at 7:30 p.m. in the Greencastle Middle School. On call of the roll the following"
members were shown to be present: Councilor Sheri Roach, Councilor Tim Conway,
Councilor Sue Murray, Councilor Bob Sedlack. Councilor Mike Rokicki was absent. City
Attorney Larry J. Wilson and City Engineer Jim Frazel.l were also present.
Department Reports:
Chief Jack Hanlon delivered a statistical report which included 464 complaints
answered in the month of July that included 108 arrests. Tickets issued in the month
totaled 172 with $1,294.99 collected from violations and meter receipts. Councilor
asked how the number compared to last year. Chief Hanlon responded that complaints
number approximately 50 higher than last year with more arrests.
The Street Department report included 142 tons of stone purchased, picked up 4
dogs, purchased 14 tons of hot mix, installed 31.7 feet of storm sewer on Illinois
Street and 322 feet of storm sewer on Ohi.o Street, repaired 17 signs, cleaned 1,500
feet of storm sewer pipe and 27 catch basins, painted curbs, and other street
maintenance duties. Councilor Sedlack requested an update on paving city streets.
Mr. Wright noted that Houck road had been completed and that Arlington and Maple would
be paved next week. Ile continued that the support for the state work being done was
complete. Mr. Wright also noted that the new truck was scheduled for delivery and
that the department was also able to purchase a used truck from the State Highway
Department for $1,800.00.
Mr.. Wright also reported on the park. He noted that swings had been replaced and
that maintenance is ongoing. Increased vandalism has been evident especially the
restroomis, he continued. Councilor Murray asked if the park was open at night. Mr.
Wright responded that the gates and the restrooms are being locked at eleven o'clock
at night.
Mrs. Charlene Nichols reported an average flow of 1.0 MGD, l.0 jet calls, 1,200
feet of line cleaned, 3,050 feet of line run with the vactor, cleaned the backwash
waste tank, and repaired and replaced sample pulps. Mrs. Nichols also noted that the
plant passed the recent EPA inspection. Councilor Murray asked if the vactor had a
regular route. Mrs. Nichols responded that after the problem areas are treated, the
truck will rotate through the entire city.
Chief Bob Elmore delivered a statistical report which included 5 fire runs, 2 car
fires, mutual aid to Bainbridge, Cloverdale, Fillmore, 9 false alarms. Chief Elmore
also noted that homeowners should inspect attics before adding blown in insulation.
He continued that if inadequate wire is buried by fiber cellulose insulation the heat
generated can start an attic fire.
Minutes:
The minutes of June 22, 27, 29 and July 11 -, 1.8, 25, and August 8, 1989 were
distributed to Council. for approval at the next session.
Recommendations:
Ordinance 1989 -22, An Ordinance Annexing Territory to the City of Greencastle,
Indiana (Area I Frazier Street), was presented to Council and was read for the second
time by Mayor Harmless by title only. Councilor Roach then moved to approve Ordinance
1989 -22 as presented. 'This motion was seconded by Councilor Sedlack and was carried
by the following roll call vote:

Mayor Harmless declared Ordinance 1989 -22 to have been passed and adopted.
Ordinance 1989 -23, An Ordinance Annexing Territory to the City of Greencastle,
Indiana, (Area III 240 Fast), was presented to Council and was read for the second
time by Mayor Harmless by title only. Councilor Murray then moved to approve

Mayor Harmless declared Ordinance 1989 -23 to have been passed and adopted.
® Ordinance 1989 -24, An Ordinance Annexing Territory to the City of Greencastle,
Indiana, (Area I11A Fi.11.more Road), was presented to Council. and was read for the
second time by Mayor Hanrless by title only. City Attorney Wilson noted an amendment
to the Ordinance on page 2, item 3, the percentage of contiguity changed from 50% to
40%, noting that it was still well. within the 12.5% required by law. Councilor
Sedlack then moved to approve Ordinance 1989 -24 as presented. This motion was
seconded by Councilor Murray. Discussion ensued concerning opposition to the
annexation by some of the residents on SR240. Mr. Tom Gorham indicated that four of
the five homeowners on SR240 are against the annexation. Ile continued that he has no
sewage problems and would like to remain in the country. Mrs. Godfrey, also a
resident of the area noted that she only has water over the finger system in the
spring when the ground is saturated. Mayor Harmless acknowledged the receipt of a
petition opposed to annexation which was delivered to City Hall. Councilor Conway
then presented a substi.Lute motion to amend the motion on the floor to exclude the
five homes located on SR240. City Attorney Wilson noted that the five homeowners to
be excluded by the substitute motion were Max and Joy Evans, Tom Gorham and Shirley
Wisner, Mrs. Godfrey, Woodrow and Nancy Power, and Mrs. O'Hair. Discussion continued.
Mr. Bob Breese noted that a group of Fillmore Road residents came before the Plan
Commission during the last administration asking for annexation. Mr. Gorham indicated
that the Fillmore Road residents are a different group than the SR240 residents. The
substitute motion presented by Councilor Conway received no second, and therefore
dissolved. On call for the question, a roll call carried the original motion with the
following vote:

Mayor Harmless declared Ordinance 1989 -24 to have been passed and adopted. Mr.
Wilson explained the remonstrance procedure, noting that annexation becones effective
® 60 days from the date of second publication. Mayor. Harmless offered to meet with
individuals concerning true cost and effect of annexation.
Ordinance 1989 -25, An Ordinance Annexing Territory to the City of Greencastle,
Indiana, (Area IV Foxridge /Tennessee Street), was presented to Council was read for
the second time by Mayor Harmless by title only. Councilor Sedlack then moved to
approve Ordinance 1989 -25 as presented. This motion was seconded by Councilor Roach.
Discussion ensued with some area residents in the audience to oppose annexation and
costs involved with putting in the sewer system. Mrs. Thelma Bumgardner asked about
the grant from 1959. Mr. Frazell noted that the grant that existed in 1959, but was
not used, has no bearing on a 1989 grant; however, the Foxridge area has been shown to
be a viable project. He continued that the City would also be exploring DOC grant
availability due to the income level in the area. Councilor Murray noted that if
there is a concern about health due to the septic systems in the area, then it must be
a priority. She continued that no grants can be guarantied, however, if annexation
does not occur then the City cannot even apply for the grant. Councilor Sedlack added
that if there is a health concern, then this is a moral issue, and the City will have
to do what they feel is right. A letter from Councilor Rokicki concerning the
Foxridge annexation was read into the minutes at this time. On call for the question,
a roll call carried the motion with the following vote:

Ordinance 1989 -20, An Ordinance for Appropriations and Tax Rates, (1990 Budget),
was presented to Council and was read for the second time by Clerk- Treasurer Berry by
title only. Councilor Sedlack then moved to approve Ordinance 1989 -20 as presented.
® This motion was seconded by Councilor Murray, and a roll call. vote carried the motion
with the following vote:

Ordinance 1989 -21, An Ordinance to Amend Ordinance 1988 -12 Being the 1989 Salary
• Ordinance for the City of Greencastle, (to add the position of full -time city
engineer), was presented to Council and was read by Mayor Harmless for the second time
by title only. Councilor Murray then moved to approve Ordinance 1989 -21 as presented.
This motion was seconded by Councilor Sedlack. Discussion ensued concerning the
salary and the need to retain the consulting engineers for the utility departments.
On call for the question, a roll call carried the motion with the following vote:

Mayor Harmless declared Ordinance 1989 -21 to have been passed and adopted.
Mayor Harmless Chen introduced the presentation of the Geo. S. Olive R Company,
Financial Consultants. Present to explain the revenue enhancement study were Dexter
H. Cooley and Devon Moon. Mr. Moon gave an overview of study and proceeded to note
priority recommendations indicated in the study. It was also noted that the study
included a comparison of five cities and their financial status.
With no further business, Councilor Roach moved for adjournment. This motion was
seconded by Councilor Sedlack, carried by an aye unanimous vote, and the meeting was
adjourned at 9:50 p.m. / � /
