HomeMy Public PortalAbout010-2009 - RSD - Resolution -JCI Findings.doRESOLUTION NO. 10 -2009 A RESOLUTION MAKING CERTAIN FINDINGS AND AUTHORIZING THE RICHMOND SANITARY DISTRICT TO ENTER INTO GUARANTEED ENERGY SAVINGS CONTRACT WHEREAS, Indiana Code 36 -1 -12.5 authorizes a governing body of a wastewater utility to enter into a Guaranteed Energy savings Contract with Qualified providers for the purposes of installation and upgrades of energy savings and conservation measures; and WHEREAS, In 2008, the Richmond Sanitary District proceeded with the Request for Proposal process pursuant to Indiana Code 36 -1- 12.5 -5 and Indiana Code 5 -3 -1; and WHEREAS, Responses to the Requests for Proposals were reviewed by a committee including representatives of the Richmond Sanitary District, including the proposal of Johnson Controls, Inc. made August 25, 2008, and Johnson Controls was selected as the Qualified Provider to enter into the proposed Guaranteed Energy Savings contract with the Richmond Sanitary District; and WHEREAS, The proposed Guaranteed Energy Savings Contract will cover the installation of energy conservation measures for various wastewater treatment and other buildings within the Richmond Sanitary District; and WHEREAS, The proposed Guaranteed Energy Savings Contract is attached to this resolution and has been designated for recordation purposes with the city clerk's office as Contract Number 87 -2009; and WHEREAS, Indiana Code requires that, in connection with the execution of the Guaranteed Energy Savings Contract, the governing body must make certain findings with regard to the proposed Contract and the savings guaranteed by the Qualified Provider. NOW, THEREFORE, BE IT RESOLVED by the Richmond Board of Sanitary Commissioners, the governing body of the Richmond Sanitary District, that: 1. FINDING: That the amount the Richmond Sanitary District will spend on the conservation measures under the proposed Guaranteed Energy Savings Contract with Johnson Controls, Inc. (hereinafter "Contract Number 87- 2009 "), and which are recommended in Johnson Control Inc.'s report, are not likely to exceed the amount to be saved in energy and water consumption costs, wastewater usage costs, and other operating costs over fifteen (15) years from the date of installation if the recommendations in the report are followed; and 1 2. FINDING: That Johnson Controls, Inc. provided a written guarantee in proposed Contract number 87 -2009 affirming that the savings resulting from the conservation measures implemented by the Richmond Sanitary District are guaranteed to cover the District's costs of the payments for those measures and that Johnson Controls, Inc. will reimburse the Richmond Sanitary District for the difference between the guaranteed savings and the actual savings.
