PLANNING & ZONING COMMISSION MEETING
IONA CITY HALL
SEPTEMBER 13,2023 6:30 P.M.
PRESENT: Chairman James West, Member Jason Cooper, Member Ray Hart, Member Bill
Koester and City Clerk/Treasurer Keri West.
ABSENT: Member Clint Reading.
VISITORS: Jeb Casper.
Chairman West welcomed everyone and Member Koester led the Pledge of Allegiance. A roll
call was taken by Clerk West to open the meeting.
CONSENT AGENDA: Chairman West entertained a motion. Member Cooper made a motion
to approve the consent agenda as presented. Member Koester seconded the motion. All in favor.
Motion carried.
PUBLIC COMMENT: No comments made.
ITEMS OF BUSINESS:
Final Nat Application; Eagle Rock Engineering; Countryside Estates; a Subdivision
located on the North side of 49th North, between 45th East and 55th East (Subdivision
Agreement to be presented in October) — Chairman West asked if anyone in the audience is
here to present this application. No response. Chairman West stated this property is located off
49th North and the preliminary plat was approved earlier this year. The Commission reviewed the
Final Plat and the Improvement Drawings and began their discussion. Member Hart noted the
lines are not straight and asked if there will be any property gaps that need to be addressed.
Chairman West stated this will not create gaps that will require any attention in the future. He
then stated a note from the City Engineer to consider is if the water storage on site is adequate.
Member Cooper stated he looked over it and analyzed a couple of the basins and felt the storage
was adequate for the impervious surfaces.
Chairman West pointed out on the plat that one of the lots is designated as green space that will
connect to the City's lot to the east of it. He continued and stated the City requested this during
the approval of the preliminary plat. He then confirmed the City received the deed today from
Bonneville County for the lot to the east with future plans to build a new City park. Chairman
West stated one thing he could not locate on the plat or improvement drawings are the
streetlights. The Commission all reviewed the drawings and were unable to locate any
streetlights. Clerk West stated Director Prouse has mentioned that he had some notes to add to
the improvement drawings, but the City Engineer approved them prior to his review. At this
point, Director Prouse will likely add them to the Subdivision Agreement.
Chairman West went through the Iona City Code 10-1-8: Final Plat Approval Process, to
determine if all requirements have been met for approval. He continued and stated the
Subdivision Agreement that is required has not been submitted yet. Chairman West explained
Eagle Rock Engineering was told by the City of this requirement on August 9th and had not

communicated with Attorney Rawlings until this week. He continued and stated the Commission
can choose to approve the Final Plat with stipulations requiring the Subdivision Agreement be
submitted and approved by City Council. He then stated the City Council can choose to approve
contingent upon the Planning & Zoning Commission (P&Z) reviewing and approving the
Subdivision Agreement at the October meeting, or they can bypass the P&Z's approval of the
Subdivision Agreement. Chairman West stated the rest of the requirements seem to be met.
Chairman West entertained a motion. Member Hart made a motion to recommend approval of
the Final Plat of Countryside Estates with the stipulations that they submit the Subdivision
Agreement and indicate where streetlights will be located on the drawings, for approval by the
City Council at their upcoming meeting on September 26th. Member Cooper seconded the
motion. All in favor. Motion carried.
Variance Application; Nolan Getsinger; for the property located at 5434 E. Steele Avenue,
pertaining to the required minimum lot size and total width required at the front lot line as
specified by Iona City Code § 11-4-6(A); as well as a Variance for the maximum height
allowed for a building or structure as specified by Iona City Code § 11-4-4 — Nolan
Getsinger approached the podium and stated he owns and grew up on the property at 5434 E.
Steele Avenue. He stated he does not currently live there, but inherited the property when his
parents passed away. Mr. Getsinger stated his grandson would like to partner with him to split
the property in half and purchase one side of it to build a "barndominium". He continued and
stated this will help clean up the property by adding additional storage for the vehicles. Mr.
riN Getsinger explained one variance he is applying for is the minimum lot width. He continued and
stated the City requires a frontage width of 85' and they would be 2.5' short of that if they split it
north to south. Mr. Getsinger also stated they are requesting another variance for the minimum
lot size. He explained the City Code requires a minimum square footage of 14,520 sq ft per lot,
and their lots will each be 13,200 sq ft. Mr. Getsinger then stated his last variance is for the
height of the building. He continued and explained the new building will have height of
approximately 35', but they have some flexibility with the plans. However, he is concerned with
reducing the height and pitch of the roof because of the width of the building and the required
snow load specs. Member Cooper asked if the 35' is to the peak of the roof. Mr. Getsinger
confirmed. He also confirmed the new building will meet all required setbacks. Mr. Getsinger
explained the layout and measurements of the new building. He stated the east side of the new
building will have stalls. Chairman West asked if the stalls are for farm animals. Mr. Getsinger
said they will not have any farm animals on the property. He then shared photos of existing
buildings that he is modeling the new building after. Mr. Getsinger stated there are currently
small buildings and metal sheds on the portion that will be split off and those will be removed if
the split is approved. However, there are small accessory buildings near the existing home on the
property that will stay. He also stated those buildings do not meet current requirements for
setbacks because they were placed before the current code was enacted. Chairman West
confirmed those are considered a non-conforming use and would be allowed to stay, as long as
the current buildings exist and no improvements are done.
Chairman West asked if this parcel has ever been split from a neighboring parcel. Mr. Getsinger
confirmed the parcel next to it currently belongs to his brother and was originally part of this
parcel. Chairman West asked when that split occurred. Mr. Getsinger estimated 25-30 years ago.

Clerk West stated the Commission's responsibility pertains to the variances and does not need to
consider the actual building code, etc. She continued and stated if a variance is approved, Mr.
Getsinger would be required to submit building permits for the new building that would be
reviewed by the City's Building Official. However, she stated the discussion regarding the height
of the building is something the Commission and City Council can determine if a variance is
required. Clerk West then read Iona City Code 11-4-4: Height Regulations, "No building or
structure shall exceed two and one-half(2'/2) stories or twenty-five (25) feet in height, whichever
is greater." She explained if the Commission determines his building is less than 2 '/2 stories, a
variance is not required. Member Cooper stated a typical story is 11 feet tall.
Commission discussed the application and each variance request. Chairman West suggested
discussing the height of the building variance first. Member Koester summarized the rest of the
City Code section Clerk West read previously and stated the roofs above the square of the
building are not considered in height. Commission all agreed it was less than 2 '/2 stories and did
not require a variance.
Chairman West stated the other variances are both for Iona City Code 11-4-6: Area
Requirements. He continued and stated in the R-1 Zone, he has a difficult time recommending
approval of both variances. Chairman West stated both Variances together creates two parcels
against what he believes the City is trying to achieve in the R-1 Zone. Mr. Koester asked Mr.
Getsinger if his grandson could purchase a small portion of property from his brother to increase
the total square footage. Mr. Getsinger stated he does not think that is an option because his
brother is building a new house and will be selling his property. Clerk West stated a Variance
was approved for the property across the street for the minimum frontage requirement, but those
lots are much deeper and still both met the 1/3 acre requirement. Mr. Getsinger stated he has
talked to most of his neighbors, and they were all in favor of this split but were unable to attend
the meeting tonight. Member Hart asked if Mr. Getsinger could still build the "barndominium"
without splitting the lot. Clerk West confirmed the Code does not allow living quarters in an
accessory building in the R-1 Zone.
Chairman West entertained a motion. Chairman West made a motion to recommend denial of the
Variance based on the dimensions and square footage of the lot. Member Koester seconded the
motion. All in favor. Motion carried.
Chairman West informed Mr. Getsinger this is a recommendation, but the City Council will
make the final decision at their meeting on September 26`h. Chairman West thanked him for his
time and attendance at tonight's meeting.
