CITY COUNCIL REGULAR MEETING
IONA CITY HALL
SEPTEMBER 26,2023 —7:00 P.M.
PRESENT: Mayor Daniel Gubler, Council President Rob Geray, Council Member Michael
Thompson, Council Member Peter Wadsworth, Council Member Evan Mann, Public Works
Director Zech Prouse, City Attorney Andrew Rawlings and City Clerk/Treasurer Keri West.
ABSENT: None.

Mayor Gubler welcomed everyone and led the Pledge of Allegiance. A roll call was taken by
Clerk West to open the meeting.
CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of August
15, 2023, were reviewed. City Council Special Meeting Minutes of September 7, 2023, were
reviewed. Council reviewed the finance reports for the period ending August 31, 2023 (92% of
the fiscal year elapsed). The City had $1,668,564.77 in the bank and routine bills had been paid,
"Exhibit A".
Mayor Gubler entertained a motion. Council President Geray made a motion to approve the
consent agenda as presented. Council Member Wadsworth seconded the motion. All in favor.
Motion carried.
STAFF REPORTS: Director Prouse stated nothing to report.
Clerk West reported she attended the Association of Idaho Cities (AIC) Conference last week
and expressed her appreciation for being able to do so. She also reported City Elections are
coming up on November 7th and there are 5 candidates running for the two Council seats. Clerk
West continued and stated the City will host a "Meet the Candidates" Night on Thursday,
November 2nd at 6:00pm that will include an open Q&A forum with the public. She encouraged
the public to attend and to get to the polls to vote on November 7th
Deputy Davies reported traffic stops and animal complaint calls increased over this time last
year. He also distributed his monthly call volume reports to the Mayor and Council.
Council President Geray stated he has nothing to report, but he is happy to see others engaged in
the electoral process. He continued and stated it is a good thing to have more people on the City
Council ballot this year.
Council Members Wadsworth and Thompson both stated nothing to report.
Council Member Mann stated he has gotten to know the new Sports Director, Shane Oliverson
and thinks he will do some good work for the City. Clerk West agreed and stated registration for
Fall Basketball is going on this week.

Mayor Gubler reported the City has acquired the property on 49th North from Bonneville County.
He continued and said next month will be the official annexation for that property. He further
explained the first task to move forward with the property will be to complete a topographical
survey. Clerk West displayed a map of this property on the projector screen. Mayor Gubler
stated once they know more about the ground the City Engineers will provide feedback on how
the space can be used. He continued and stated various plan ideas will then be brought to the
public for their input.
ITEMS OF BUSINESS:
General Fiber Discussion — Mayor Gubler stated Direct Communications is moving through
Zone 1 and is currently hooking customers up to fiber. They are moving through the rest of the
zones pulling fiber through the conduit in the ground.
Public Hearing, Final Plat Application & Subdivision Agreement; Eagle Rock Engineering;
Countryside Estates; a Subdivision located on the North side of 49t North, between 45th
East and 55th East—Niel Humphreys with Eagle Rock Engineering approached the podium and
presented the Final Plat for Countryside Estates. He stated the subdivision will have 32 buildable
lots and 1 non-buildable lot that will be used as green space and access to the property to the
east. Council Member Thompson asked Director Prouse if he has received the streetlight
placements for the subdivision. Director Prouse stated it is not required on the Improvement
Drawings, but he did get updated drawings today that show the placement of the streetlights
throughout the subdivision. Mayor Gubler stated the City has been working with Bonneville
County to acquire the property to the east of this subdivision for a City park and that property
now belongs to the City. He continued and stated that is the reason the City required the
developers to include access from this subdivision to that parcel.
Mayor Gubler asked Director Prouse if his concerns have been addressed regarding this Final
Plat. He confirmed everything has been satisfied. Mayor Gubler asked Attorney Rawlings if his
concerns have been addressed. Attorney Rawlings stated he has worked with Director Prouse and
Eagle Rock Engineering on the Development Agreement, and he believes everything has been
addressed. Mayor Gubler asked Kevin Harris of Forsgren & Associates, the City's engineering
firm, if he had any concerns. Mr. Harris confirmed his firm has issued their approval letters.
Mayor Gubler stated this is a Public Hearing and asked if anyone in the audience had any
questions or comments. An audience member asked what the lot sizes would be for this
subdivision. Mayor Gubler confirmed they cannot be smaller than 1/3 acre, per City Code. Clerk
West displayed the Final Plat on the projector and confirmed the majority of the lots will be 0.34
acres. Mayor Gubler asked if there were any other questions from the public. No response.
Mayor Gubler then closed the Public Hearing portion of this agenda item.
Mayor Gubler asked if the Council had any additional questions. Clerk West stated the
Development Agreement was not ready to present to the Planning & Zoning Commission(P&Z)
at their September 13th meeting. She continued and stated the Council can choose to bypass their
approval, or approve it contingent upon the P&Z reviewing it at their October meeting. Council
President Geray stated he would advise to utilize P&Z and allow them to review it in October.

Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve the
Final Plat Application and Development Agreement of the Countryside Estates Subdivision for
Eagle Rock Engineering, contingent upon the Planning & Zoning Commission approving the
Development Agreement. Council President Geray seconded the motion. A roll call vote was
taken:

Public Hearing, Variance Application; Nolan Getsinger; for the property located at 5434 E.
Steele Avenue, pertaining to the required minimum lot size and total width required at the
front lot line as specified by Iona City Code § 11-4-6(A); as well as a Variance for the
maximum height allowed for a building or structure as specified by Iona City Code § 11-4-
4 — Nolan Getsinger approached the podium and introduced himself and his grandson, Talon
Robison. He stated his family purchased the property located at 5434 E. Steele Avenue in 1953
and he inherited it after his parents passed away. Mr. Getsinger continued and said due to health
concerns; he has found it difficult to maintain the property as is needed. He stated his grandson
has proposed to purchase half the property to build a "barndominium" and to help clean up the
rest of the property. However, if they split the property in half, it would not meet the City
requirements for minimum lot size and lot width. Mr. Getsinger explained the minimum lot
width is 85' and he would only be at 82'5". He added that it would also be 1,320 square feet
short of the minimum lot size requirement. He continued and stated these are the reasons he is
now seeking a Variance. Mr. Getsinger confirmed if the Variance is approved, the new building
would meet all setback requirements. Clerk West displayed drawings of the proposed property
split and the new building on the projector screen for the Council and audience to view and
discuss. Mr. Getsinger explained the measurements of the building and Mayor Gubler stated a
Variance on the height is not required.
Mayor Gubler stated one of the drawings shows 10'x10' stalls on the east side of the building
and asked what those will be used for. Mr. Getsinger stated those will be used to store classic
cars. Mayor Gubler then asked if anyone is living in the original house. Mr. Getsinger confirmed
no one is currently living in the house. He continued and stated the pipes in the house are from
1928 and need to be replaced, among other maintenance issues that need to be addressed. Mayor
Gubler then asked if his grandson could just move into the house. Mr. Getsinger stated they are
going to try and do the improvements to the house so that he and his wife can move back into it
to be near their grandson. Council Member Mann asked if they have considered getting rid of the
current home and building a new home, rather than splitting the property to build a second home.
Mr. Getsinger stated there is sentimental value in the home and reiterated that they want to live
next to their grandson so that he can help them as they get older. He also stated this would be a
benefit to the neighbors because it will help them clean up the property and get rid of some of the
junk that is currently there. Council Member Mann asked when they intend to move back into
the current home and when they anticipate building the "barndominium". Mr. Getsinger stated
they are hoping to begin construction next summer.
Mayor Gubler stated this is a Public Hearing and asked if anyone in the audience would like to
address the Council on this topic. No comments made. Mr. Getsinger stated he did provide Clerk
West with signed approval letters from his neighbors. Mayor Gubler confirmed their City

Council packet does have 24 pages that have been individually signed by Mr. Getsinger's
neighbors and they all approve this action. Mayor Gubler then closed the Public Hearing portion
of this agenda item.
Mayor Gubler began Council deliberations. He asked Director Prouse if he had any comments.
Director Prouse stated he had no comments. Council President Geray asked P&Z members in the
audience if their basis for disapproval was strictly for lot size and width. James West, P&Z
Chairman stated the P&Z only considered the lot size and the front width and felt there was not
enough reason to approve a Variance for those 2 items. Council President Geray asked if the
P&Z saw any other concerns. Chairman West stated there were no other concerns. Council
Member Thompson asked about the building specifics pertaining to the roof line and possible
"human occupancy" in the upper 10' of the building, which is not allowed according to the City
Code § 11-4-4. He continued and asked whether a vaulted ceiling would be considered "human
occupancy". Attorney Rawlings stated he would recommend the City's Building Official to
review this point, if the Council feels that is necessary. Council discussed those specifics and
how they each interpret the intention of this section of the Code. Clerk West stated the P&Z read
the same section of the City Code and deemed the height Variance not necessary because it
states,
"No building or structure shall exceed two and one-half(2'/2) stories or twenty-five (25) feet in
height,whichever is greater."
She continued and stated the P&Z determined the building would be less than 2 1/2 stories, so it is
allowed by this section of the Code. Council Member Wadsworth stated he is not concerned with
the building, but he is concerned about the lot size. He then asked if the property is being split
down the middle, would both sides be 1,320 short of the minimum lot size? Mr. Getsinger
confirmed both lots would be the same size, which would be less than the minimum requirement.
Council Member Mann expressed concern allowing two lots to be less than the minimum size.
Council Member Wadsworth stated if they just wanted to build the shop, it would not require a
property split or a Variance. Council Member Thompson confirmed,but stated they would not be
allowed to live in the shop.
Council President Geray asked Director Prouse what the basis is for the 85' lot width
requirement. Director Prouse stated that has been the requirement since he has been with the City
and does not know where it originated. Mayor Gubler stated it is an arbitrary number, but he
believes it was created when the lots were much larger and there was a need for equipment to get
in and out of those lots.
Council President Geray then summarized that the Variance for the width and the lot size would
not be a significant reduction, if approved. He continued and stated with the recent Code changes
for Variances, the Council can now consider things like this that may enhance the aesthetic
appeal, etc. Council President Geray stated when he looks at the plans for the area, he feels it
would be an improvement from what is there currently. Mayor Gubler stated the City granted a
Variance for the lots across the street from this one to reduce their lot width. Clerk West
confirmed the P&Z discussed that also, but those lots were much deeper and still met the
minimum lot size requirement. Council Member Thompson stated there is another lot that is
diagonal from this lot that is only 0.27 acres, so these lots would not look out of the norm on this

street. Council President Geray agreed and stated in this area of the City he anticipates many
other lots being split due to their large sizes and shapes. Council President Geray reiterated the
24 neighbors that support this split and asked if there had been any feedback received from
anyone that is against it. Clerk West stated they have received no phone calls or emails against
this proposal. She also stated the 24 letters came in after the P&Z Meeting and there were no
audience members present at that meeting.
Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the
Variance Request for Nolan Getsinger for the property located at 5434 E. Steele Avenue,
pertaining to the required minimum lot size and width of the front lot line, as specified in the
Iona City Code § 11-4-6-(A). Council Member Wadsworth seconded the motion. A roll call vote
was taken:

Discussion of High-Density Residential Zones — Clerk West stated it has been brought to her
attention that in the new Area of Impact (AOI) Agreement there are zones in the AOI that are
designated as "high-density". However, the City Code does not currently have any zones that
would be considered "high-density". Clerk West continued and stated she has added this as a
discussion for the Council to decide if they would like to start discussing the addition of those
zones in preparation for future developments. Mayor Gubler stated any developments that take
place in the AOI would fall under the Bonneville County zones that are approved in the
Agreement. He continued and stated the City does not need to address the zones until those
developments are contiguous. Council President Geray agreed and stated he doesn't feel this is
necessary until those areas are close to being annexed into the City. Clerk West stated if the
development happens quickly, the City may want to have those codes in place. Council President
Geray stated he does not believe it would be a big undertaking to create high-density zones,
when the time comes. He continued and stated the City would likely use the Bonneville County
zones as a template and adjust from there. Council President Geray asked Attorney Rawlings his
opinion on this topic. Attorney Rawlings stated having the zones already in place would mean
the City could start adapting zones as issues arise, rather than flying blind. He continued and
stated the process to create new zones would take a minimum of 2 months because they are
ordinances that would need to go through the Planning & Zoning Commission, as well as the
Public Hearing process. Council Member Wadsworth stated there are already rumors of
upcoming developments and he doesn't see the harm in being proactive with the City's zoning
ordinances. Council President Geray stated every time the City invokes Attorney Rawlings'
expertise there is a cost associated with it and he does not think that is a necessary cost at this
time. Council Member Mann agreed. Council President Geray further explained if a development
is proposed in the AOI, the Agreement between the City and Bonneville County already
specifies which zones are approved by both entities, depending on location. Attorney Rawlings
stated there is also an option for a developer to come to the City and apply for a waiver to build
high-density housing outside of the designated corridor, as specified in the Agreement. Audience
member, Adrian Beazer, asked for a map of the new AOI. Clerk West displayed it on the
projector screen. Mayor Gubler identified various designations in the area.

Audience member, Curtis Johnson spoke up and stated he brought this discussion to Clerk West
in an attempt for developers to know what the City of Iona is seeking when it comes to high-
density housing. He continued and stated having a code in place helps everyone be prepared for
the future. Mayor Gubler stated the AOI Agreement addresses what the City would like to see in
the future and already spells out which Bonneville County zones are approved by the City. He
then asked if anyone on the City Council wanted to discuss this further. No comments made.
Discussion about Mailbox Code& Standard Drawing—Bill Koester of 3767 N. Dayton Street
approached the podium and stated he likes having the individual mailboxes in front of houses,
but thinks it is unfortunate the United States Postal Service (USPS) and the City did not get
together prior to notifying residents of the option to discontinue their post office box and put up
mailboxes. He continued and stated there should have been more guidance and consistency
between the two entities on the rules and requirements for the placement of mailboxes. Mr.
Koester stated he and three of his neighbors put up a mailbox unit that is 11' away from the
asphalt to allow the mail carrier to deliver mail safely. He continued and stated the Iona Deputy
approached him and told him their mailbox was too "substantial" and needed to be removed. Mr.
Koester read various parts of Iona City Code § 6-4-10: Installation of Mailboxes within Public
Rights of Way. He summarized that barrels, masonry, buckets, are all prohibited structures for
mailboxes. Mr. Koester stated he has driven around the City and taken pictures of many of these
existing violations and sent them to Clerk West. Clerk West displayed them on the projector
screen. Mr. Koester encouraged the Council to read through the current Code and make
adjustments to be more consistent. He also encouraged them to add something to the Code that
allows residents to place their mailbox further away from the asphalt, with the understanding
they would then be responsible for snow removal. Mayor Gubler asked if anyone else in the
audience would like to address the Council on this topic. No response.
Mayor Gubler asked Director Prouse if he has anything to add. Director Prouse stated Mr.
Koester is correct that there are currently many mailboxes throughout the City in violation of the
City Code. He stated now that the USPS is allowing more mailboxes in the City, his suggestion
would be to either enforce these requirements City-wide or amend the City Code. Mayor Gubler
offered insights regarding when this section of Code was adopted and explained it was intended
to reduce possible damage to City vehicles and snowplow equipment. Director Prouse stated the
size of the mailbox post was also designed for all vehicle safety, including pedestrians and
bicycles. Mayor Gubler stated all the mailboxes in violation around the City that were placed
before this code was adopted are considered "grandfathered". He continued and stated if the
Council feels there are amendments that need to take place on this section of the code, they can
discuss it. Council President Geray stated he does not believe anyone on the Council is averse to
researching this section of the Code and making changes, if necessary. Director Prouse asked the
Bonneville County Sheriffs Office (BCSO) representatives if they have witnessed the damage
these types of mailboxes can cause. They all agreed most of the damage caused by mailboxes is
from masonry mailboxes. Discussion then continued regarding various sizes of mailbox posts
and the appropriate distance for a mailbox from the asphalt. Audience member, Steve Elg,
voiced his frustrations regarding the lack of communication between the City and USPS. He
stated they talked to the local post office about what type of mailbox they wanted to put up as a
neighborhood before they put anything up. Mr. Elg continued and stated they followed the USPS
rules and was told 30 days later by the Iona Deputy that their mailbox did not meet the City rules

and needed to be removed. Mayor Gubler stated the City had given the post office employees
copies of the City Code and the drawings.
Mayor Gubler and Council Members discussed the options on how to address this issue going
forward. Director Prouse stated allowing residents to violate the Code could leave the City liable
for any damage caused by those mailboxes. Attorney Rawlings agreed. Mayor Gubler stated
nothing can be changed tonight, but he does believe it is worth a discussion to amend certain
requirements in the Code pertaining to mailbox placement. The Council and Director Prouse
discussed specific measurements of the right-of-way in various parts of the City. Council
President Geray suggested Attorney Rawlings and Director Prouse work together on possible
amendments to the City Code to address some of the concerns brought up tonight. All Council
Members agreed to this course of action. Mayor Gubler advised the members in the audience to
wait until the Council comes to a conclusion before doing anything with their mailboxes.
Approval of Professional Services Agreement; City Engineering Services, Fiscal Year 2024
for Forsgren & Associates, Inc. — Mayor Gubler stated this is the new City Engineer
Agreement with Forsgren & Associates and asked if Attorney Rawlings had any feedback. Clerk
West stated she received an email from Attorney Rawlings with feedback a few weeks ago and
forwarded it to Mayor Gubler and the City Council. Council President Geray asked Attorney
Rawlings if he was involved in the development of this agreement. Attorney Rawlings stated he
was not involved and just gave his feedback on the agreement as it was written by Forsgren &
Associates. Mayor Gubler stated he has not seen the feedback from Attorney Rawlings. He then
suggested Attorney Rawlings communicate directly with Forsgren & Associates to come up with
an agreement that satisfies both parties. Attorney Rawlings agreed.
Mayor Gubler entertained a motion. Council President Geray made a motion to table the
Approval of Professional Services Agreement for City Engineering Services, Fiscal Year 2024
for Forsgren & Associates due to needing to align between the City and the engineering fine.
Council Member Thompson seconded the motion. All in favor. Motion carried.
Approval of Fiscal Year 2024 Bonneville County Sheriff's Office Law Enforcement
Contract — Mayor Gubler stated there was an increase of 5% to the annual contract fee, but no
other changes to the contract from previous years. Clerk West confirmed. Council Member
Mann asked for clarification on the total number of hours as specified in the contract. Mayor
Gubler stated the contract lists the total annual hours that our assigned deputy will work in the
City,but additional coverage will be provided by BCSO.
Council President Geray stated BCSO is still maintaining the same Dodge Durango that belongs
to the City. He asked about the current condition of the vehicle. Deputy Davies stated the check
engine light is currently on and it is due for regular maintenance. He continued and stated it has
approximately 75,000 miles. Council President Geray asked about BCSO's plan for when that
vehicle is no longer working. Mayor Gubler stated in the original negotiations it was decided that
BCSO would be required to cover the cost of the replacement vehicle and the City would pay for
the identification on the vehicle to advertise it as the City deputy's vehicle. Lieutenant Josh
Fielding stated he does not know the timeframe on when the vehicle will be replaced, but they
have a total of 234 vehicles and typically replace approximately 12 vehicles each year. He also

stated they try to keep vehicles until they reach 100,000 miles before they replace them. Council
President Geray asked for this follow up information at a later date. Lt. Fielding agreed.
Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve the
proposed contract for the Bonneville County Law Enforcement and Animal Control Agreement
in the amount of $233,730. Council Member Thompson seconded the motion. All in favor.
Motion carried.
Approval of Engagement Letter for Fiscal Year 2023 Audit; Searle Hart & Associates,
PLLC — Clerk West stated this is a formality to state that the City will be using Searle Hart &
Associates for our annual audit. Mayor Gubler asked if there is an amount specified in the letter.
Clerk West stated it lists a fee range of$11,000 - $13,000. She continued and stated last year the
final cost was $11,650, which also included a single audit of the American Rescue Plan Act
(ARPA) funds.
Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the
engagement letter for Fiscal Year 2023 Audit for Searle Hart & Associates, in a range amount of
$11,000 - $13,000. Council Member Wadsworth seconded the motion. All in favor. Motion
carried.
Approval of Legal Services Proposal; Fiscal Year 2024 for Holden, Kidwell, Hahn &
Crapo, P.L.L.C. —Attorney Rawlings explained most of the proposal stayed the same, with the
exception of the hourly rate. He continued and stated his hourly rate will increase from
$190/hour to $200/hour. Mayor Gubler asked if anyone had questions or concerns regarding this
contract. No comments made.
Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the
Legal Services Proposal for Fiscal Year 2024 for Holden, Kidwell, Hahn & Crapo, as proposed,
including the increase of Andrew Rawlings' rate from $190 to $200 per hour. Council Member
Wadsworth seconded the motion. All in favor.
Approval of Resolution 2023-03: Authorizing Resolution for the Drinking Water Planning
Grant—Clerk West stated this is a requirement by Department of Environmental Quality(DEQ)
to have an official Resolution specifying who is allowed to sign all the paperwork for the
Drinking Water Planning Grant. She continued and stated she received a template from DEQ and
used that to draft the Resolution.
Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve
Resolution 2023-03, A Resolution of the City Council of the City of Iona, Idaho, authorizing the
Mayor to sign all applications, funding agreements, and other documents relating to the Drinking
Water Project. Council Member Thompson seconded the motion. All in favor. Motion carried.
