AWAKING CONTRACT FOR OUTDOOR DECORATIVE LIGHTING POLES
AND FIXTURES, WATERFRONT PARK/PHASE II
WHEREAS, the Borough of Carteret requires improvements Outdoor Decorative
Lighting Poles and Fixtures, Waterfront Park/Phase II; and
WHEREAS, the Borough Purchasing Agent has solicited and received 2 bid proposals
for Outdoor Decorative Lighting Poles and Fixtures, Waterfront Park/Phase II:
1. Turtle & Hughes, Inc. $ 79,950.00
2. Warshaurer Electric Supply Co. $ 81,700.00
WHEREAS, Turtle & Hughes, Inc., Jersey City, NJ, has submitted the lowest bid for
said improvements as evidenced by the response on file with the Borough Purchasing
Agent; and
WHEREAS, the Borough Engineer has reviewed the above bid proposals and has
recommended the award of a contract to Turtle & Hughes, Inc.
NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of
Carteret as follows:
1. That the appropriate Borough Officials are hereby authorized to
enter into a contract with Turtle & Hughes, Inc. for Outdoor Decorative
Lighting Poles and Fixtures, Waterfront Park/Phase II for the stun of
$79,950.00, in accordance in all respects with the request for proposals
and bid on same.
Adopted this 6th day of May, 2004
and certified as a true copy of the
original on May 7, 2004.

Dear Mayor Reiman:
On Wednesday, April 28, 2004, the following two bids were received for the referenced project:

Warshaurer Electric Supply Co., Tinton Falls, NJ $ 81,700.00
Engineer's Estimate $75,000.00
The low bidder for the referenced project is Turtle & Hughes, Inc., 374 Sixth Street, Jersey City, NJ 07302, in the
mount of $79,950.00. Our past dealings with representatives of Turtle & Hughes, Inc. have been good. We have been
involved in numerous projects where they have provided lighting fixtures and poles.
Based on their low bid and satisfactory past performance, I recommend the Borough of Carteret award the contract for
supply of outdoor decorative lighting poles and fixtures to Turtle & Hughes, Inc., 374 Sixth Street, Jersey City, NJ
07302, in the amount of $79,950.00.
Award of the contract should be contingent upon the necessary funds being provided by the Borough of Carteret, a
review of the bid documents by the Borough Attorney, approval of the Green Acres Office of the NJDEP (if the
Borough will use Green Acres funding for the lighting), and the New Jersey Department of Labor and Division of Wage
and Hour Compliance.

If you have not submitted evidence of an existing federally approved or sanctioned Affirmative Action
Program prior to signing the Contract, then you must complete and submit the Initial Project Workforce
Report, AA-201, within three days after signing the Contract.
The Public Agency copy of the form should be mailed to: Gloria Goodrich, Purchasing Agent, Borough of
Carteret, 61 Cooke Avenue, Carteret, New Jersey 07008, with a copy of your transmittal to the New Jersey
Affirmative Action Officer (and copy mailed to T & M Associates).
All subcontractors are required to agree to the mandatory provisions of the Contract Affim~ative Action
Requirements. Please refer to the Contract Specifications for information with regard to subcontractors.

Contract Name: Supply of Outdoor Decorative Lighting Poles and Fixtures
Bids Received on: April 28, 2004
Dear Mr. Doyle:
This Notice of Award is issued in accordance with Section IB.3.2 of the Contract Documents. On
May 6, 2004, the Borough of Carteret awarded a contract to you for the "Supply of Outdoor
Decorative Lighting Poles and Fixtures". The contract mount, as awarded, is $79,950.00.
Four copies of the Contract Documents accompany this Notice of Award.
You must comply with the following conditions precedent w/thin 12 calendar days, Sundays and
holidays excepted, of the date of award of contract, that is by May 25, 2004.
1. You must deliver to the Engineer, four (4) original copies of the contract documents properly
executed by you.
2. You must deliver to the Engineer, an original and three copies of the Certificates of Insurance
(please refer to GC.27.4 on page GC-24 of the specifications for help in completing the
required form).
Failure to comply with these conditions precedent by the date specified will entitle the Owner to
consider you in default, to annul the award and to declare your Proposal security forfeited (See
IB.10.3).
In order for the Engineer to issue a Notice to Proceed, these additional conditions/requirements must
be complied with:
3. The Owner or Owner's Counsel, must approve the executed documents and insurance
certificates delivered by you.
4. You must submit and obtain the Engineer's approval of the Delivery Schedule required by
Section GC.24.3.
