A RESOLUTION: PRESENTED February 14, 1989 89-26 ADOPTED February 14, 1989 INITIATINGANAMENDMENTOFTHELEESBURGZONING ORDINANCE FOR SECTION8A-9AND8A-11(a) OFTHESIGNREGULATIONS WHEREAS, Section 15.1-492 of the 1950 Code of Virgini~ as amended, sets forth the enabling authority for the Town of Leesburg to regulate nonconforming uses and structures; and WHEREAS, the enabling legislation stipulates the level of vested rights accorded such non- conforming uses and structures; and WHE~, Section 8A-9 of the Leesburg Zoning Ordinance is seen to impinge on the vested rights of nonconforming signs beyond that authorized by the State; and WHEREAS, Section 8A-11(a) of the Leesburg Zoning Ordinance is seen to accord a higher level of vesting to nonconforming signs than that authorized by the State; and WHEREAS, amendment of these provisions of the Leesburg Zoning Ordinance is in the best interest of the public necessity, convenience, general welfare and good zoning practice: THEREFORE, RESOLVED by the Council of the Town of Leesburg in ~Ftrginia as follows: SECTION I. An amendment to the Leesburg Zoning Ordinance is initiated to delete the words nor in content' from Section 8A-9, Development Standards for Permitted Sign T~-pes: to delete the words ~except a sign face may be changed so long as the new face is equal to or reduced in height, sign area, and/or projection" from Section 8A-ii(b), and shall read as follows: 8A-9 Development Standards for Permitted Sign .Types All new signs and all existing signs which are replaced, reconstructed, extended or changed structurally-or-4~-~mt~mt, shall comply with the following development standards. -2- Nonconformin~ Simms Nonconformin~ Siffns~ Generally. Any sign which was lawfully in existence at the time of the effective date of this Ordinance which does not conform to the provisions herein, and any sign which is accessory to a nonconforming use, shall be deemed a nonconforming sign and m~y remain except as qualified in paragraph (b) hereim b. No nonconformln~ sign shall be enlarged extended, structurally reconstructed or altered in any mnrmer; except-a-~l~a-face-m~y-~~.~-l~a-t, he-ae~ SECTION II. The Planning Commission shall report its recommendations to the Town Council on the proposed amendment within 60 days following its receipt of the proposed legislation.
