RESOLUTION NO. 89-35 ADOPTED February 14, 1989
A RESOLUTION: ACCEPTING PUBLICIMPROVEMENTS, REI,EASING THE PERFORMANCE
GUARANTEE AND APPROVING A MAINTENANCE GUARANTEE FOR
PUBLIC IMPROVEMENTS TO THE ROUTE 15 BYPASS AT BATTLEFIELD
PARKWAY
WHE~, Richmond American, the developer of improvements to the Route 15 Bypass at
Battlefield Parkway has completed the public improvements in accordance with approved plans and
town standards, and these have been inspected and approved.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The corporate surety bond from American Motorists Insurance Company in the
amount of $96,114.00 is released, and a new surety in a fora approved by the town attorney for a
maintenance guarantee in the Rmount of $24,036.00 is approved, and shall be in effect for a period of
one year from this date.
SECTION II. This release is contingent upon delivery of a properly executed instrument
conveying unto the town all such improvements and easements free of any liens or changes.
SECTION III. This release is also contingent upon the payment to the town the amount of
$22,766.00 for installation of street lights.
