HomeMy Public PortalAbout1989_04_25_R083Leest~urg in ~Zirginia PRESENTED April 25, 1989 RESOLUTION NO. 89-83 ADOPTED April 25, 1989 A RESOLUTION: AUTHORIZING THE EXECUTION OF A LEASE AGREEMENT FOR PLAZA STREET PARK WITH LOUDOUN HOUSE ASSOCL~TES WHEREAS, Loudoun House Associates has requested the town to lease Plaza Street Park to Loudoun House Associates so the complex may be more effectively supervised and secured; and WHEREAS, the Town of Leesburg Police Department has recommended leasing Plaza Street Park to Loudoun House Associates for security reasons; and WHEREAS, the Leesburg Parks and Recreation Advisory Commission has unanimously approved leasing the park to Loudoun House Associates; and WHEREAS, the town requires the area will continue to be operated as a park: THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the manager is authorized to execute a lease agreement with Loudoun House Associates for an initial six- month period: PASSED this 25th day of April ATTEST: ~']'erk of C,~ncil ,1989. Robert E Sevila, Mayo'r- Town of Leesburg This lease made this __ day of , 1989, by and bet~veen the Town of Leesburg, a municipal corporation in the State of Virginia, hereafter referred to as "Lessor" and Loudoun House Associates, hereafter referred to as "Lessee." WITNESSETH: Whereas, Lessor is the owner of the area designated Plaza Street Park situated in the Town of Leesburg, Loudoun County, Virginia; and Whereas, the parties hereto have agreed that the said park can be operated more efficientJy if the Lessee has control and sole authority over the use thereof by the public subject to certain conditions which will be imposed by the Lessor, and Whereas, in order to implement the understanding the Lessor does hereby lease that certain tract or parcel of land together with easements designated Parcels A and B on Boundary Survey showing part of the property of Loudoun House Associates and part of the property of John A. Wallace Et A1 for a term of six (6) months commencing on the day of , 1989, and ending on the day of ., 1989, on the following terms: 1. The payment as rent of the sum of $10.00 at the time Lessee signs this lease. 2. The Lessee acquiring public noncancellable liability insurance in the total amount of $1,000,000.00, wherein, the Lessor is an additional insured which shall be paid up at the time the lease is signed by Lessee and a proper endorsement furnished Lessor. 3. The Lessee agrees that the area will continue to be operated as a park and will never be used for any other purpose. 4. Lessee is responsible for the duration of lease for maintenance of the park area and ingress and egress easement and does release Lessor from the obligations in the deed dated August 31, 1981, from Lessee to Lessor recorded in Deed Book 796, Page 151, while this lease is in effect and maintenance shall be defined to include major repairs to the playground equipment. 5. Lessee shall return the park to the town at termination of lease in the same condition as it was at the commencement of the occupancy normal wear and tear excepted. 6. Lessee agrees that if it fails to meet these requirements, after -2- ten days notice that it is in default, the lease shall then be null and void and of no further effect.
