M. ROLL CALL: PRESENT: Councilmen- Nunamaker, Tyrell, Merritt ABSENT: Councilmen - Dickason, Harker ALSO PRESENT: Attorney Volpert of O'Melveny & Myers, Engineer Krelle of Krelle & Lewis, & City Manager Woollett Mayor Merritt announced the hour of 7 :30 o'clock P. M. having arrived, this is the time and place fixed for the hearing on the report filed in connection with proposed Vehicle Parking District Mo. 3. It is also the time and place fixed for the hearing on the formation of said district as proposed by the Ordinance of Intention No. 65 -144. City Clerk Woollett presented to the Council the four affi- davits showing publication, posting and mailing of the ordinance of intention and mailing of the notice of hearing on report. Attorney Volpert of O'Melveny & Myers then gave the Council and the audience a brief explanation of the two hearings. The peti- tion was filed on October 12, 1964, signed by 67% of the property owners by the area and 61% by the assessed valuation within the dis- trict requesting the district be formed. The lots are to be acquired and improved and the cost assessed against the owners within the dis- trict. Mr. Volpert advised that the assessment engineer was ordered to do a property report for feasibility. It was prepared by Mr. Krelle. The City Clerk then administered the oath to the Assessment Engineer, Mr. Krelle, who summarized his report. He pointed out the boundaries of the district and the locations of the lots to be ac- quired which are the first two properties north and adjacent to the east -west alley between Las Tunas Dr. and Woodruff Ave. and facing on Temple City Blvd. Mr. Krelle advised the total acquisition cost is estimated at $55,000. and estimated improvements cost at $8,000., total incidental expense at $7,000., making a total of $70,000. There . are no outstanding unpaid special assessments levied on the properties . proposed to be levied against. Bonds to be issued for unpaid assess- ments shall extend for 19 years with maximum +merest to be 6 %. Attorney Volpert then asked Mr, Krelle whether or not in his opinion all of the lands in the proposed district subject to assess- ment will be benefited by the proposed project. Mr. Krelle answered that in his opinion they would all be benefited. The City Clerk then advised the Council that no written pro- tests had been filed against the formation of this district. Mayor Merritt then asked if anyone wished to file an oral protest. Mrs. Thos. Parrington, 6352 N. Muscatel, San Gabriel, stated she wished to protest. She owns the third lot north of the alley, Lot #186. Her property would be adjacent to the parking lot. She felt the assessmen too much for what the property is valued at. Atty. Volpert asked Mrs, Parrington if she were protesting the formation of the district or the amount of assessment and she stated she was protesting the amount of the assessment on the property. No one else came forward to protest orally the formation of the district. Mayor Merritt then asked if anyone wished to speak in favor of the formation of the district or to comment in any other way. Mr. Paul Kettle, 6362 Golden West, commented that a lot of hard work has gone into this project and he believes it to be a wonderful thing for the City. Attorney Volpert asked Mr. Krelle whether the property owned by Mr. and Mrs. Parrington would be benefited by the proposed acquisi- tion and improvement. Mr. Krelle replied that the lot owned by the 716 Council Minutes, March 11, 1965, page 2 Parringtons would be benefited, particularly since it is immediately adjacent to the proposed parking lot. Engineer Krelle stated he felt all of the lands in the pro- posed district subject to assessment will be benefited by the proposed project. The Mayor asked if anyone wishes to ask any questions of Mr. Krelle but no one came forward. The Engineer then stated no writ- ten protests had been filed and one oral protest had been made which amounted to 3.95% of the area of the district. Councilman Tyrell moved that this City Council hereby deter - mines that written protest or objection to the doing of the . things proposed to be done as set forth in Ordinahce of Intention No. 65 -144 has not been made by the owners of more than one -half of the area of the land included within the proposed Vehicle Parking District No. 3 of this city and subject to assessment, and that there is no majority protest within the meaning of Sections 2930 and 2931 of the Streets and Highways Code, Councilman Nunamaker seconded, carried by the following roll call vote: AYES: Councilmen - Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen - Dickason- Harker Councilman Nunamaker moved that it is hereby ordered that all protests and objections, both written and oral, made or filed in the matter of Vehicle Parking District No. 3 be and the same are here- by overruled and denied, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen- Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen- Dickason, Harker City Clerk Woollett then, presented Resolution No. 65 -449 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY RE- QUIRE THE FORMATION OF A VEHICLE PARKING DISTRICT AND REQUIRE THE ACQUISITION AND IMPROVEMENT SUBSTANTIALLY AS SET FORTH IN THE REPORT ON FILE, AND DETERMINING THE PROJECT FEASIBLE (VEHICLE PARKING DIS- TRICT NO. 3). Councilman Nunamaker moved to adopt Resolution No. 65 -449, Councilman Tyrell seconded, roll call vote to carry as follows AYES: Councilmen- Nunamaker, Tyrell, Merritt NOES: Councilmen-None ABSENT: Councilmen-Dlckason, Harker City Clerk Woollett then presented Ordinance No. 65 -148 AN. ORDINANCE OF THE CITY OF TEMPLE CITY, CALIFORNIA, FINDING AND DETER- MINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE, AND ORDERING, THE ACQUISITION AND IMPROVEMENT FOR VEHICLE PARKING DISTRICT NO. 3 OF SAID CITY AND ESTABLISHING THE BOUNDARIES OF SAID DISTRICT. Counm. cilman Tyrell moved to waive further reading of Ordinance No. 65-148, Councilman Nunamaker seconded, carried by the following called vote:; AYES: Councilmen- Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen- Dickason, Harker As this was the first reading of Ordinance No. 65 -148 no further ac- tion was taken. Councilman Tyrell moved to adjourn to a study session on March 16, 1965, at 7:30 P. M. in the north meeting room of the City Hall, 5938 Kauffman Ave., Temple City, Councilman Nunamaker seconded, . carried by the following roll call vote: AYES: Councilmen- Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen- Dickason, Harker Council adjourned at 7 :47 P.
