DECLARING CERTAIN PROPERTIES IN BLOCK 11.01 AS AN AREA IN
NEED OF REDEVELOPMENT AND REFERRING THE TASK OF pREPARING
A REDEVELOPMENT PLAN TO THE PLANNING BOARD
WHEREAS, pursuant to Ordinance No. 95-40, on August 17, 1995, the Borough created
a Landfill Reclamation Improvement District ("District") affecting certain properties in
the Borough as referenced therein in accordance with the Large Site Landfill Reclamation
and Improvement Law (codified at N.J.S.A. 40A:12A-50 et seq.)(the "Landfill Law");
and
WHEREAS, pursuant to section 6 of the Landfill Law, the Borough was deemed to have
adopted a redevelopment plan at the time the District was established; and
WHEREAS, on November 2, 1995, the Borough Council adopted Resolution 95-346
that memorialized a redevelopment plan for the District; and
WHEREAS, pursuant to Ordinance No. 96-14, on May 16, 1996, the Borough amended
the boundaries of the Landfill Reclamation Improvement District, as referenced therein;
and
WHEREAS, on March 7, 2002, the Borough Council adopted "The Amended and
Restated Landfill Reclamation Improvement District Redevelopment Plan" pursuant to
Ordinance 02-05; and
WHEREAS, subsequent to the Borough's adoption of the redevelopment plan for the
District in 1995 and the revision of the boundaries thereto in May, 1996, the Landfill Law
was amended. The amendments, which took effect July 22, 1996, link the redevelopment
provisions of the Landfill Law to the Local Redevelopment and Housing Law, N.J.S.A.
40A: 12A- l et seq. ("Redevelopment Law"); and
WHEREAS, in connection with the redevelopment of the District, the Borough desires
to utilize the provisions of the Redevelopment Area Bond Financing Law and the
Revenue Allocation District Financing Act; and
WHEREAS, in order to avail itself of the powers of said laws, the Borough must
determine that any property to benefit from the financing mechanisms established by
such laws is an "area in need of redevelopment" pursuant to the Redevelopment Law; and
WHEREAS, the Redevelopment Law authorizes the governing body to declare areas in
need of redevelopment in accordance with the requirements of the Redevelopment Law;
and
WHEREAS, by Resolution #04-70 adopted on February 19, 2004, the Borough Council
authorized and directed the Planning Board of the Borough of Carteret (the "Planning
Board") to undertake a preliminary investigation to determine whether those properties
listed on Exhibit A hereto (the "Delineated Area"), known as "Phase I" of the District,
meet the criteria set forth in the Redevelopment Law for being determined to be an "area
in need of redevelopment" as defined in the Redevelopment Law; and
WHEREAS, a~ter providing requisite notice, the Planning Board held a hearing on April
7, 2004 to review the results of the preliminary investigation and to solicit public
comment on whether the Planning Board should recommend to the Council that the
Delineated Area be determined to be an "area in need of redevelopment"; and
WHEREAS, the Planning Board, by a Resolution of Findings and Conclusions dated
April 28, 2004, has recommended to the Council, pursuant to Section 6 of the
Redevelopment Law, that the Delineated Area be determined to be an "area in need of
redevelopment"; and

WHEREAS, the Council has given due consideration to the recommendation of the
Planning Board that the Delineated Area be determined to be an "area in need of
redevelopment" and has determined, pursuant to Section 6(b)(5) of the Redevelopment
Law, that the inclusion in the Delineated Area of Block 11.01, Lot 21 is not necessary at
this time in order to ensure the viability of future development of the Delineated Area;
and
WHEREAS, if, upon the completion of additional planning and design for the
redevelopment of the Delineated Area, it is demonstrated that the inclusion of Block
11.01, Lot 21 in the Delineated Area is necessary for proper redevelopment, the Council
may at that time determine that such inclusion is appropriate.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Carteret,
County of Middlesex, State of New Jersey, that the Delineated Area, with the exclusion
of Lot 21 in Block 11.01, is hereby determined to be an "area in need of redevelopment"
and is hereby designated as a "redevelopment area", as such terms are defined in the
Redevelopment Law.
BE IT FURTHER RESOLVED that the Council hereby directs the Planning Board to
prepare a Redevelopment Plan for the Delineated Area, with the exclusion of Lot 21 in
Block 11.01, in accordance with the Redevelopment Law.
BE IT FURTHER RESOLVED THAT duly executed copies of this resolution shall be
transmitted to the Planning Board and filed in the office of the Borough Clerk.
