In accordance kith the Warrant, the ~~pecial "Io~~~n ~[eeting ~.~as held in the
Stony- Brook Elementary School Cafetorium, Monda~~, September 29, 1997.
The Meeting was called to order at 7:Ol p. m. b~° the. 'Moderator-, Stephen L.
Doyle. The Tellers were althea E. Aping, J,_inP (xallant, Jean Gage, Ruth
Hanlon, Eleanor ?~~ielsen, and William tiielsen. The Checkers were Germaine I.
Cummins, Catherine Flaherty, Dorothy- D. Leone, F'eter ?~~orton, Sharon Morgan,
Sherry .'~. Ryder, Sharon Ryone, and tilildred L'r~ger.
A quorum was present.
The Totivn Clerh, Joan 1;. Cole, read the Specie l Town Meeting Warrant and the
return of the Warrant. The re being no objectio~i, tl~ie 'Moderator dispensed
with the reading of all the articles.
GOLF COT?RSE EIPANSIO
ARTICLE 1. To see if the Town ~~ ill ~ otc to authorize the Board of
Selectmen to acquire by gift, by purchase, or by the exercise of eminent
domain powers ender Massachusetts General Laws Chr.~pter 79, or any other
enabling authority, the land which is designated with the following Brewster
Assessor's map and parcel numbrzrs: ?~1ap ~?, I.ot 002-001; ~iap 02, Lot 002-
002; ?`fay 52, Lot OC)2-003; MaI? 02, Lot (103; 'slap .:2, Lc~t 003-001; Map 02, Lot

001; Map 02, Lot 026; '~fap 52, Lot 027; Map 02, Lot 029; Map 02, Lot 030-001;

this land for the pi_,rposes of recreational ,_,s~ and for the expansion of the
Captains Golf Course; t.o commit this lr_lnd t.o the care, custody, control, and
management of the Board of Selectmen; to r_zppropriat~~~ n s,,m of money for the
p~rrpose of planning, acquiring this land, de~.~eloping, constructing, and
equipping it for recreational use, including the expansion of the clubhouse,
driving range, maintenance building, and related structt_rres and facilities; to
authorize the Treas,.,rer, with the apt>roval of the. Board of Selectmen, to
borrow a Burn of mone~~ under and purs,.rant to t'hapter 4 4, Section 8{ 16),
and/or any other enabling authority rend to issue notes and bonds of thr:~
"row•n therefor; to transfer from a~-ailable fund. the sum of 570,000.00 for
engineering expenses, permitting exl~ense~, architectural s~~r~.>i~-•es, including
plans and specifications, and similar project.-relr~rted preliminar~T expenses; to
appr•oprizite and to raise or transfer from ;~v,:rilrlble f~.,nds a sum of money- to
pad- for t.hE: preparation, issuance, and marketing of notes and bonds issued
under the a-,.,thority of this vote; t.o aut:horize the Board of Selectmen to
petition the General Court for legislation draft~,d t.o enable the Town to
provide for the following: (a) to e-•stablish an eni.e~•prise f~_itid for the golf
course, with the provision that any surpl,.rs retained in the fund will be
available for appropriation for any Town capital cost; (b 1 to issue bonds
payable on a level debt service basis ~,~ith a maximum term o~f thirty years
from their dates of iss~.iance; (c) to defer principal payments an~.l to capitalize
interest up to two years after the expected commencement of operation of the
golf course; (d) to authorize rE~funding of bond. anticit~ation notes issued for
preliminsr~~ expenses incurred prior to enactmc nt. of any special legislation;
and (e) to authorize the Town to „se a portion of the bond proceeds or other
finds for debt sere°ic~e, replacement, improvement., maintenance and operating
expense reserve fund; and to take and other action relative thereto.

137.624 acres; as a site for :~ municipal golf course and related facilities;
that the sum of 59,9=I>,000.00 be hereh~- appr•opriat.ed to ac~Iuire s~~rch land and
to plan, develop, construct ar~d equip an expa!,ded municii~,al golf co,_irse,
incl,,ding a clubho,_,se and related ~.t:ruct.:_u•es at~d facilities; that to meet this
appropriation the Town rote to tx•arrsfer the sum of X75,000.00 fi~om the
Stabilization fund, and authorize the Toti.-n Tr•easur•er, with the approval of the
Selectmen to borrow the sum of $9,870,000.00 i_~nder Chapter 44 of the General
Laws or anv ether enablin legislation, until enactment of the special
legislation authorized by this vote, that the Select,n~ren on behalf of the to~.•n
are authorized to petition the General Court for t}re passage of a special law
in such form as they deem appropriate to enable the Town (a) to create
certain reserve funds in connection with 1;he golf course and to establish a
modified enterprise fund for the golf co~.rrse, with the provision that anv
retained surplus in the fund would be availablc~• for appropriation for any
Town capital costs, (b) to issue bonds or notes payable on a level debt
service basis or otherwise with a maximum term of up to thirty (3C) years
from their dates, (c) to defer principal payments and capitalize interest up to
two (2) years after the expected commencement of oper:~ation of the golf course;
(d) for refunding of bond anticipation notes issued for preliminar~° expenses
prior to enactment of anti- special legislation; and (e) to authorize the Town to
rrse a portion of the bond proceeds or.• other funds for debt service,
replacement, improvement, maintenance and operating expense reserve fund;
and that the Board of Selectmen is authorized to take all other action
necessary to carry out the project.

AMENDMEtiTT OF TOWN OPERATING BUDGET
ARTICLE 2. To see if the Town ~~.~ill vote to amend its vote
rendered under Article 3 ("Down Operating Budget) of the May 5, 1997 Annual
Town 'Meeting in order to reapportion the percentage of funds to be raised
relative to the percentage of funds to be transferred and to do so because of
the likelihood of increased state funding, or to t;ake anv other action relative
thereto.

MOTION: I move that the Town rote to indefinitely postpone Article 2.
ACTION: ADOPTED TO INDEFINITELY POSTPONE
QUORUM
ARTICLE 3. To see if the Town will rote to amend the Gode of the
Town of Brewster, Massacl-~usetts, Chapter 48, Article III, Section =?8-5 by
repealing the current section which reads as follows:
A Town '.Meeting shall require the presence of at least fire percent (5%)
of the registered votex•s of the Town of Brewster, as of the previous December
31 , fora quorum;
and by substituting therefor the following:
The quorum for Annual Town Meetings and for Special Town l~teetin~s is
hereby set at two hundred registered ~-oters;
or to take any other action relative thereto.

warrrint.
