REGULAR MEETING
October 24, 2000
The Moab City Council held their regular meeting on the above date in
the Council Chambers of Moab City Offices, located at 115 West 200
South, Moab, Utah. Mayor Karla R. Hancock called the Pre -Council
Workshop to order at 6:30 PM
Mayor Hancock called the Regular City Council Meeting to order at 7:00
PM; Councilmember Rob Sweeten led in the Pledge of Allegiance. Also
in attendance were Councilmembers Gregg W. Stucki, Joseph Lekarczyk
and Kyle Bailey; City Manager Donna Metzler, City Recorder Rachel
Ellison, City Treasurer Laurie Ramstetter, Planning and Community
Development Director David Olsen, Police Chief Michael NaVarre and
Zoning Administrator/Planning Assistant Debra Gilger. Seven (7)
members of the audience were present.
There were no minutes to approve
There were no Citizens to be Heard.
No City Planning Update was given.
No Public Works Department Update was given.
Under Police Department Update, Police Chief Michael NaVarre stated
that the call volume for September was down slightly; however, over
half of the calls received are regarding animal control. Police Chief
NaVarre also stated that the officers had qualified at a night shoot
training.
Under Presentations, a Moab Arts and Recreation Center Board Update
was given.
Councilmember Bailey moved to approve the 2001-02 Community
Development Block Grant Project as the Center Street Court and Star
Hall Improvements Project. Councilmember Sweeten seconded the
motion. The motion carried 4-0 aye.
Councilmember Sweeten moved to approve a request to send Proposed
Ordinance #2000-07 — an Ordinance amending Section 17.09.090 of
Chapter 17.09, Title 17, of the Moab Municipal Code Regarding the
Storage of Large Vehicles Within Certain Zones of the City to Public
Hearing. Councilmember Lekarczyk seconded the motion. The motion
carried 4-0 aye.
Councilmember Sweeten moved to approve a request to send Proposed
Ordinance #2000-08 — an Ordinance Amending Section 12.6.020 of
Chapter 12.16, Title 12, of the Moab Municipal Code Regarding the
Parking of Commercial Vehicles on City Streets to Public Hearing.
Councilmember Lekarczyk seconded the motion. The motion carried 4-
0 aye.
Councilmember Bailey moved to approve a request for a Refund of a
City Water bill by the Moab Area Chamber of Commerce in the amount
of $15.53. Councilmember Sweeten seconded the motion. The motion
carried 4-0 aye by a roll -call -vote.
Councilmember Stucki moved to approve Proposed Resolution # 16-
2000 — a Resolution Adopting a Memorandum of Understanding by and
Between the City of Moab and the Grand County Solid Waste District.

Councilmember Sweeten seconded the motion. The motion carried 4-0
aye by a roll -call -vote.
Mayor Hancock opened the Public Hearing on Proposed Ordinance
#2000-09 — an Ordinance Regarding the Conditions for Professional
Offices at 7:34 PM.
Ms. Janet Lowe stated that she didn't know why we needed this
ordinance when we have a Home Occupation ordinance. Ms. Lowe
inquired if Professional Offices were allowed accessory buildings. Ms.
Lowe stated that the proposed ordinance allowed too many visitors and
employees, which would cause too many vehicles in residential areas.
Ms. Lowe concluded that she felt the residential character of
neighborhoods would be compromised.
Mayor Hancock closed the Public Hearing on Proposed Ordinance
#2000-09 at 7:36 PM.
Councilmember Bailey moved to approve a Special Event License for
the Canyonlands Fat Tire Festival to be held on October 18 through
October 23, 2000. Councilmember Sweeten seconded the motion. The
motion carried 4-0 aye.
Under Discussion with Solid Waste District Representatives, Dave
Sakrison made a presentation. Discussion followed.
Under Reading of Correspondence, Mayor Hancock stated that the
Division of Water Resources had made the State Water Plan available
for review. Mayor Hancock also stated that there would be a state -
planning meeting for the Water Plan on December 1, 2000 at 10:00 AM
in Monticello.
Under Administrative Reports City Manager Metzler stated that the
Cellular Franchise Tax would be accepted on December 1, 2000 at $1
per phone. City Manager Metzler stated that the City could not put the
fee into effect until after a ninety -day waiting period following January
1, 2001. City Manager Metzler then stated that Lisa Hendy had been
hired as the new Recreation Assistant. City Manager Metzler also stated
that there would be a North Area Planning Meeting the following day.
Under Council Reports, Councilmember Bailey stated that he had
attended a legislative meeting discussing the sales tax on food.
Mayor Hancock stated that the cost to Utah communities to drop the
sales tax on food would be over five million dollars. Mayor Hancock
stated that she supported a tax credit for food tax.
Councilmember Sweeten requested that a discussion regarding the
Middle School and a discussion regarding the Higher Education Board
be added to the next Regular Council Meeting Agenda.
Councilmember Stucki moved to approve the bills against the City of
Moab in the amount of $62,465.30. Councilmember Sweeten seconded
the motion. The motion carried by roll -call -vote 4-0 aye.
Councilmember Stucki moved to adjourn the meeting. Councilmember
Sweeten seconded the motion. The motion carried 4-0 aye.
Mayor Hancock adjourned the Regular City Council Meeting at 8:15
PM.
