HomeMy Public PortalAbout05/31/77 Special CCMThe Council of the City of Medina met in special session on Tuesday May 31, 1977 at 7:50113 Members present: Wayne Neddermeyer, Mayor; Nancy Laurent, William Reiser, Thomas Crosby Arthur Theis, Councilmembers; Clerk, Donna Roehl; Richard Schieffer, Attorney; Russel Bouley, Building Inspector 1. PIONEER CREEK CONSERVATION DISTRICT Wayne Neddermeyer presented the joint powers agreement establishing the Pioneer Creek Watershed District, as had been previously discussed. Motion by Thomas Crosby, seconded by William Reiser to enter into the Pioneer Creek joint poweres agreement. Motion carried unanimously 2. 1977 LICENSES Motion by Arthur Theis seconded by Nancy Laurent to grant a Sunday Liquor license to Medina Recreations Inc. Motion carried unanimously Motion by Nancy Laurent, seconded by Arthur Theis to grant an Off -Sale Liquor license to Pat Wald, dba Pats'. Motion carried unanimously Motion by Thomas Crosby, seconded by William Reiser to grant a Club license to the John Pohlker American Legion Post. Motion carried unanimously 3. PUBLIC HEARING, STREET VACATION, BAILEYyDANIELSON, 8:10 P.M. Dean Bailey stated that he felt that the street easement should be turned over to adjacent property owners because it is not being maintained as public property and is not useable as public property. Ron Danielson stated that in the 6 years he has lived in the area he has not seen anyone use the easement as a means to the lake and it would be dangerous to even try. Mr. Bailey stated that he knows of no one who has voiced objection to vacating of this street and that perhaps Council should declare the easement as unbuildable. Thomas Crosby stated that the Planning Commission would be studying all such streets and would be making a reccommendation after their June 14th meeting. Motion by Thomas Crosby, seconded by Arthur Theis to close the Public Hearing. Motion carried unanimously 4. JUBERT LAND DIVISION Wayne Neddermeyer a ked if council members wished to consider the land division as it had not been on the agenda. Sheldon Coplin, who had expressed concern regarding the street placement had been called and was present. Mr. Coplin stated that he and Mr. Berthiaume, the developer, had discussed the road location and Mr. Berthiaume had said that it was economically unfeasible to take down the trees. At the May 17th meeting no one, including Mrs. Weinzierl, who appeared for Mr. Berthiaume, had a problem with moving the easement. However, Mr. Berthiaume, upon being informed of Council action did not agree with the action taken. Mr. Coplin added that Mr. Berthiaume had stated to him that he would provide a 65 foot easement. Mr. Berthiaume stated that he had not said he would provide an additional 5 ft. easement and that he does not intent to take trees along the property line. He is concerned about beginning his road construction. Mrs. Weinzierl sta'.ed that road plans have been completed and approved by the city engineer. Jeanne Mabusth reported that Engineer Lyle Swanson states that they have not been asked to show a meandering road but one that is drawn on the center line of the easement. Motion by Thomas Crosby, seconded by Nancy Laurent to table the matter until land owners can determine if movement of resod is compatible with their wishes. Mr. Berthiaume stated that he would not be able to begin road construction for another 2 weeks if matter were tabled. Mr. Coplin suggested that if road were to be constructed within a 60 ft. easement from the property line then the center line of the road should be no closer than 30 ft. from the property line. Mr. Crosby withdrew his motion to table the matter. Nancy Laurent withdrew the second to the motion. '3 Motion by Thomas Crosby, seconded by William Reiser to amend Council action of May 17th mmeting concerning Jubert Land Division and permit road easement of 60 feet from north property line providing that center line be no closer than 30 feet from property line. Motion carried unanimously 5. DEAN BAILEY Mr. Bailey asked if street were vacated would it draw an assessment. Mr. Schieffer stated that if a new lot were created than there should be a new assessment. He also stated that Mr. Baileys assessment on his duplex was considered a legal assessment when the role was adopted and cannot be changed now. Thomas Crosby stated that Mr. Bailey should give Council sufficient reason for removing the assessment on the 30 foot lot that had been assessed because a cabin was on it at the time the assessment role was adopted. 6. RUSSEL BOULEY, BUILDING INSPECTOR Members discussed and compared fees of Plymouth, Orono, Corcoran and Medina. Russ Bouley stated that Plymouth is charging fees as established by the Uniform Building Code and that Medina should begin using the same fee schedule. He stated that it would probably be from 3 to 5 years before a full time inspector is needed but he now needs an assistant to handle the outside inspecting work, while he reviews plans, gives out permits and takes care of the vast amount of paper work. He also stated that he wants a salary of $5000 per year and would check with the assistant he has working with him to determine what salary he wants. Motion by Thomas Crosby, seconded by Arthur Theis to tentatively adopt the UBC fee schedule pending final determination at the July 19, 1977 meeting. Motion carried unanimously Mr. Bouley was instructed to find out, for the June 7th meeting, what salary he assistant wants. 7. METRO SYSTEMS STATEMENT Discussion of comments from Planning Commission regarding the Systems Statement. Motion by Thomas Crosby, seconded by Arthur Theis to write letter to Metropolitan Council asking them to consider the comments made by the Planning Commission. Motion carried unanimously 8. PUBLIC WORKS DEPARTMENT Ron Duran presented written report on Public Works Department personnel, particulary, Le Leuer and the fact that he has stated several things he will and will not do and that he teas not reported daily, as had been requested. Nancy Laurent asked if city attorney should write rules for Public Works Department. Thomas Crosby asked if Medina should have standards by which to be measured in order to term- inate an employee. Wayne Neddermeyer stated that if an employee is not working to the best interest of the city then employment should be terminated. Thomas Crosby recommended that Ron Duran prepare a letter of dismissal Ron Duran stated that he would then be doing the Council's job. Thomas Crosby stated that if Ron Duran wants Council to act on his recommendations then he must list reasons; Also as soon as one is dismissed city must advertize for a new employee.
