ITEM #l: Zoning Requests
a) 105.63 acres that is a portion of Fox Hill Farm (part of Tax Map 5.13..14) from county
Residential -1 to town Residential -20 (20,000 square foot minimum lot size) (This
designation is at the owner's request).
b) 85.85 acres on the west side of NC 57 owned by Freeland heirs and Phelps (parts of Tax
Map 4.4..6 & 4.2..1) from county Agricultural Residential to town Agricultural
Residential (40,000 square foot minimum lot size).
C) 24.72 acres at the intersection of NC 86 and US 70 Business (Tax Map 4.40.A.9) from
county Industrial -2 to town General Industrial (This designation is at the owners'
request).
ITEM #2: Adjourn Planning Board and call Town Board public hearing to order.
ITEM #3: Public Hearing on the 1998-1999 Budget.
ITEM #4: Close public hearing.
ITEM #5: Consideration of resolution accepting the dedication of streets in Old Mill Business Park and
Phase 5, Cornwallis Hills.
ITEM #6: Confirmation of Board members attending NCLM Town Hall Day.

PRESENT: Mayor Horace Johnson, Ken Chavious, Frances Dancy, Evelyn Lloyd, Catherine Martin, Richard
Simpson, John Taylor (PB chair), Richard Bradford, David Daniel, Ed Gill, Pip Merrick, Chris Quinn,

Mayor Johnson called the hearing to order at 7:03 PM. He passed the gavel to Planning Board Chair
Taylor who briefly described the hearing purpose.
ITEM #la: Hauth introduced the zoning request for the recently annexed portion of Fax Hill Farms from county
Residential -1 to town Residential -20. She called the members attention to the request from the owner
for the R-20 and noted his representatives were present. Sprouse spoke on behalf of the owner, as
the realtor handling the property. He said the development pattern of Fox Hill Farm will not change;
lots will still range from 1'/z to 5 acres, but the flexibility of lot widths of 100 feet is desired. Hauth
added that the AR zone requires 200 foot lot widths, R-40 requires 150 foot lot widths and R-20 is
the next district, which requires 100 foot lot widths.
Boyd asked what impact the zoning and annexation would have on his property, which is adjacent
to Fox Hill Farm on Miller Road. Hauth noted the annexation and zoning would not change the
development schedule of Fox Hill Farm nor impact Mr. Boyd's property directly. She added that the
town generally annexes property at the owner's request. Simpson noted his continued concern that
annexing these properties will have spin-off affects which were not anticipated. Taylor noted that the
annexation has already been decided and the only question still on the table is the zoning.
McCullough asked what the larger impact to taxes and development in northern Orange County
would be. Gillespie, attorney for Fox Hill Farm, reiterated that annexation was not done to bring
utilities to the development, nor to speed up or change the appearance of Fox Hill Farm. He noted
that R-20 allows them to continue development at their current pace with their current style.
ITEM #1b: Hauth introduced the zoning request for the recently annexed portions of the Phelps and Freeland
heirs properties on NC 57. She noted the owners wish to continue their Agricultural -Residential
designation as it was with the county. She noted the property falls between 1900 and 2400 NC 57.
ITEM #lc: Hauth introduced the zoning request for the recently annexed Hines Liner tract at the intersection of
NC 86 and US 70 a. She noted the parcel is currently zoned industrial by the county and the owners
wish to maintain that designation. Taylor asked if the parcel is the entire tract shown in their packets
and she said it was. She added that the Meadowlands is to the east, a mixture of HIC and OI,
Cornerstone Park is across NC 86, a mixture of HIC and GI, the Elizabeth Brady Road area is zoned
industrial and a few residential properties abut the tract.
ITEM #2: Taylor closed the public hearing and returned the gavel to Mayor Johnson. He adjourned the
Planning Board and called for a 10 minutes recess at 7:20 PM.
