HomeMy Public PortalAboutResolution 67-7161 RESOLUTION NO. 67 -716 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR PUBLIC STREET PURPOSES AND ALL USES APPURTENANT THERETO (BROADWAY WIDENING PROJECT). THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Temple City does hereby find, determine and declare that the public interest, convenience and necessity require the acquisition by said City of the fee title interest to certain hereinafter described real property, for public street purposes and all uses appurtenant thereto. That the location of said rights -of -way has been planned and located in a manner which will be most compatible with the greatest public good and the least private injury. SECTION 2. That it is the intention of said City Council to acquire said property in its name, by a proceeding in condemnation, in accordance with the provisions of the Code of Civil Procedure of the State of California. SECTION 3. That the said real property hereinabove referred to, the acquisition of which is required by said public interest, convenience and necessity, for the purpose set forth in SECTION 1 hereof, is located in the City of Temple City, County of Los Angeles, State of California, and is more particularly described on that certain document attached hereto and incorporated herein by this reference, marked Exhibit "A ". SECTION 4. That the City Attorney of the City of Temple City, and designated Special Counsel, are hereby authorized and directed to prepare, institute and prosecute , in the name of said City, such proceedings in the proper Court having jurisdiction thereof as may be necessary for the acquisition of said real property as is described on Exhibit "A" attached hereto. Said City Attorney is also authorized and directed to obtain a necessary Order of Court granting to said City the right of immediate occupancy and possession of said property. SECTION 5. PARCEL NO. 3 (6680856) The southerly 10.00 feet of the east 80 feet of Lot 6, Tract No. 3623, in the City of Temple City, County of Los Angeles, State of California, as per map recorded in Book 40 Page 52 of Maps, in the office of the County Recorder of said County. PARCEL N0. 4 (6680857) The southerly 10.00 feet of Lot 6 of Tract 3623, in the City of Temple City, in the County of Los Angeles, State of Califor- nia, as per map recorded in Book 40 Pages 52 of Maps, in the office of the County Recorder of said County. Except the easterly 80.00 feet of said Lot. Also except that portion of Lot 6 lying westerly of a line parallel with the easterly line of said lot, which passes through a point in the southerly line of said Lot, distant easterly 54.00 feet from the southwesterly corner of said Lot. PARCEL NO. 7 (6680860) The Northerly 10.00 feet of that portion of the Northeast quarter of the southwest quarter of Section 7, Township 1 South, Range 11 West, San Bernardino meridian, in the City of Temple City, County and State, according to the official plat thereof, described as follows: Beginning at a point in the south line of Broadway, 60 feet wide, distant South 89 45' 15" East 867.95 feet from the northeast corner of lot 4 of the Hubbard Ranch Tract, in the County of Los Angeles, State of California, as per map recorded in Book 10 Page 173 of Maps, said point of beginning being the northeaster- ly corner of the land described in deed to Edna M.
