AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR
LEGAL SERVICES WITH WINDELS MARX LANE & MITTENDORF,
LLP
WHEREAS, there presently exists a need within the Borough of Carteret for
specialized legal services to advise and direct the Mayor and Council concerning
the potential redevelopment of the Borough's former Landfill Site; and
WHEREAS, the law firm of Windels Marx Lane & Mittendorf, LLP possess the
requisite experience and expertise to provide the aforementioned specialized legal
services; and
WHEREAS, legal services are a professional service exempt from the
requirement of public bidding pursuant to N.J.S.A.40A: 1159(1)(a); and
WHEREAS, the Chief Financial Officer has certified that funds are available for
payment of said services.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret that the law firm of Windels Marx Lane & Mittendorf, LLP
is hereby appointed for the purposes of providing specialized legal services to the
Mayor and Council with regard to the potential redevelopment of the former
Landfill Site and various redevelopment matters throughout the Borough at an
initial maximum cost not to exceed $10,000.00 at $125.00 per hour.
BE IT FURTHER RESOLVED that the Mayor and Municipal Clerk are hereby
authorized to execute the Contract for said legal services.
BE IT FURTHER RESOLVED that said Contract is awarded without
competitive bids in accordance with N.J.S.A.40A:ll-5(I)(a) due to the
specialized and professional nature of the services provided.
