PRESENT: Chairman James West, Member Jason Cooper, Member Ray Hart, Member Bill Koester, Member Clint Reading and Deputy City Clerk Heather Marley. ABSENT: None. VISITORS: Lori Anglin, Kirsti Cook,Josette Clark, Joanie Marshall, and Gideon Anglin. Chairman West welcomed everyone and Member Reading led the Pledge of Allegiance. A roll call was taken by Deputy Clerk Marley to open the meeting. CONSENT AGENDA: Chairman West entertained a motion. Member Hart made a motion to approve the consent agenda as presented. Member Koester seconded the motion. All in favor. Motion carried. PUBLIC COMMENT: Joanie Marshall of 5226 E Williams Way approached the podium and stated she would like to comment on article B that pertains to the driveway approach. She explained that her driveway is in the corner of a cul-de-sac and her swayle is very small and she would like to increase her driveway. Chairman West explained that hers is already at the 50% level and she would not be allowed to put more concrete in because of drainage purposes. He also explained she could apply for a variance to put in concrete. Deputy Clerk Marley explained if they wanted a variance for concrete they would have to provide a drain for drainage. Member Cooper said that since the driveway is 30 feet of non-impermeable surface but the rest of the surfaces has to be able to absorb the water or it would cause flooding and her variance would need to include a plan on what to do for the water. Joanie asked about why it was 30 feet for a driveway approach. Chairman West said it was the standard that City Council decided upon. Member Cooper explained about runoff and the how the engineers come up with the number. Lori Anglin from 5167 Dutson Dr. explained her driveway approach is too small and she would like to be able to have it wider so it matches the width of her garage. Josette Clark of 5147 E Williams Way asked if she needed a permit for concrete for an accessory building. She was told she did not. ITEMS OF BUSINESS: Annexation Ordinance & Initial Zoning — City of Iona; Parcel #RP03N38E368396, located on the north side of 49th North, between 45th East and 55th East (Ord. 294-10-23) —Chairman West explained this annexation and initial zoning is for the City land to be made into a park. Chairman West explained the City has been attempting to acquire this property from Bonneville County for a while. Bonneville County contacted the City office recently and offered to deed the land to the City. Chairman West explained that said property used to be a refuse dump and will be zoned R1 and used as a large park for the City. Chairman West explained that Mayor Gubler has contacted the City Engineer to get started on this project. Chairman West said there were several concerns that because of the R1 zoning that homes were going to be built on it but he explained it will be a park but it has to be zoned R1. Member Hart explained that it cannot be IONA PLANNING & ZONING COMMISSION MEETING - OCTOBER 16, 2023 used for homes because it was a dump. Member Hart moved to recommend the approval of Ordinance 294-10-23, an Ordinance annexing certain lands to the City of Iona, Idaho; describing these lands; establishing the initial zoning for such lands; requiring the filing of the ordinance and amended City map and amended legal description of the City with the appropriate county and state authorities; and establishing effective date. Member Cooper seconded the motion. All in favor, motion carried. Ordinance to Amend Iona City Code § 10-1-17(E), pertaining to Construction Requirements for Public Ways in the Iona Subdivision Ordinance, specifically driveway approaches (Ord. 295-10-23) — Chairman West explained that the underlined area in the ordinance is being added to update the ordinance since there are larger lots and people need multiple driveways. The Commission talked about the Ordinance and concluded that the driveway approach can be wider than thirty feet if they obtain a variance and it doesn't exceed fifty percent of the frontage. They concluded it is okay to have two driveway approaches with a small strip of permeable surface between them as long as it does not take more than fifty percent of the frontage and a variance is not required. Member Reading moved to recommend the approval of Ordinance 295-10-23: an ordinance of the City of Iona, Idaho; amending section 10-1-17E of the Iona City Code; amending requirements for driveway approaches; providing methodology; preserving prior ordinances in each instance; providing for severability; and establishing an effective date. Member Cooper seconded the motion. All in favor, motion carried. Ordinance to Amend Iona City Code § 11-1-5, pertaining to shipping containers as accessory buildings (Ord. 296-10-23) — Chairman West explained there has been an uptick of shipping containers used as storage containers in the City. He said there was not currently a code for shipping containers and that the City Council would like to add them to the Code and have the same rules apply to shipping containers as an accessory building. Member Cooper moved to recommend the approval of Ordinance 296-10-23; an ordinance of the City of Iona, Idaho; amending section 11-1-5(A)(1) of the Iona City Code; amending the definition of accessory buildings to clarify that shipping containers are included in that definition; providing methodology; preserving prior ordinances in each instance; providing for severability; and establishing an effective date. Member Koester seconded the motion. Four in favor and Member Reading opposed. Approval of Development Agreement; Eagle Rock Engineering; Countryside Estates — Chairman West explained that the development agreement wasn't ready for the last Planning & Zoning Meeting but it was available to the City Council and was approved by them. It was also approved by the City attorney Andrew Rawlings and also Public Works Director Zech Prouse. Member Cooper asked why the Street Grading Section (SC-2 e.) in the Development Agreement refers to the Idaho Falls standard. Member Koester moved to approve the Development Agreement for Countryside Estates. Member Cooper seconded the motion.
