HomeMy Public PortalAbout11-13 - Approving a Transfer Agreement for the Transfer of Certain Properties Owned by the Agency to the City of Carson for Use for Public Purposes and for The City to Carry out Redevelopment Activities, Pursuant to the California Redevelopment LawRESOLUTION NO. 11-13 A RESOLUTION OF THE CARSON REDEVELOPMENT AGENCY APPROVING A TRANSFER AGREEMENT FOR THE TRANSFER OF CERTAIN PROPERTIES OWNED BY THE AGENCY TO THE CITY OF CARSON FOR USE FOR PUBLIC PURPOSES AND FOR THE CITY TO CARRY OUT REDEVELOPMENT ACTIVITIES, PURSUANT TO THE CALIFORNIA REDEVELOPMENT LAW A. WHEREAS, the City Council of the City of Carson ("City Council") approved and adopted certain Redevelopment Plans for 4 various project areas starting December 20, 1971 pursuant to Ordinance No. 74-288 through July 16, 2002 pursuant to Ordinance No. 02-1254. Subsequently on October 11, 2010, the Agency consolidated the project areas into the Carson Consolidated Redevelopment Project Area ("Project Area") pursuant to Ordinance No. 10-1459, which resulted in the allocation of taxes from the Project Area to the Carson Redevelopment Agency ("Agency") for purposes of redevelopment; and WHEREAS, the intent of the Redevelopment Plan is, in part, to provide for the development and redevelopment of blighted areas in the community; to promote the general welfare of the people within the community by improving physical and economic conditions through employment of all appropriate means; to perform specific actions necessary to promote the redevelopment and the economic revitalization of the Project Area; to provide for the construction and installation of necessary public infrastructure and facilities and facilitate the repair, restoration, and/or replacement of existing public facilities; to increase, improve and preserve the community's supply of low and moderate income housing, some of which may be located or implemented outside the Project Area; and to take all other necessary actions to implement the Redevelopment Plan for the Project Area and to expend tax increment to accomplish the goals and objectives of the Redevelopment Plan; and WHEREAS, the Agency has adopted its Implementation Plan for the Project Area ("Implementation Plan") with established goals to support affordable housing, economic development, community revitalization, commercial revitalization, and institutional revitalization, and to implement the programs and activities associated with these goals, the Agency has acquired real property within the Project Area to be redeveloped; and WHEREAS, the Agency was established by the City to decrease blight and remediate and redevelop the high number of environmentally contaminated sites ("Brown Fields") impacted by former land uses such as landfills, auto wrecking yards, petroleum manufacturing sites, and other hazardous land uses operated by the County of Los Angeles prior to the city's incorporation. To date the Agency and the City have enabled redevelopment of more than 25% of the city's Brown Field properties. However, the Project Area consists of 4,866 gross acres of which 749 acres remain blighted Brown Fields that are difficult to redevelop without public/private partnerships. The Agency has, during the course of its redevelopment activities, acquired properties listed in Exhibits "A," "B," and "C" to Transfer Agreement (collectively, the "Properties") to remediate and redevelop for fixture economic development projects, for the elimination of blight and for the creation of housing; and 01018/0001/93713.1 Resolution No. 11-13 Page 2 of 3 WHEREAS, the Agency embarked on the redevelopment of certain projects and the City has been involved with the redevelopment of Brown Fields within the City; and, more specifically, the City has been intimately involved with the development of the 93 -acre BEDI Grant area, for which the City has received federal grants from both the US Environmental Protection Agency and the Housing and Urban Development Department to remediate and redevelop said area; the Agency has negotiated the purchase of a 14 acre property located at 20630 South Figueroa Street within the BEDI Grant area; and the City has also been involved with the negotiations between BP America, Inc. ("BP") and the Agency for the development of the BP office campus built partially on 5 acres of environmentally impacted Agency -owned property located at 2254 East 223 Street, and BP has an option to purchase the remaining neighboring 5 acres of Agency -owned property to the west, which is also environmentally impacted; and WHEREAS, the City has also been active in establishing an auto -row along 223 Street through zoning and general plan designations and the Agency has acquired property located at 2403 East 223 to assist in the creation of said auto -row; and WHEREAS, pursuant to Section 33220 of the California Community Redevelopment Law, which is codified as Health and Safety Code Section 33000 et seq. ("CRL"), certain public bodies, including the City, may aid and cooperate in the planning, undertaking, construction, or operation of redevelopment projects; and WHEREAS, the Agency desires to transfer the Properties to the City along with the responsibility for implementing the Redevelopment Plan and the Implementation Plan to bring about the redevelopment of those Properties, as the City is familiar with the environmental issues associated with the Properties and the goals of the CRL, the Redevelopment Plan, and the Implementation Plan; the City has land use authority within the City; and the City desires to cooperate with the Agency and to carry out the redevelopment of the Properties, in accordance with the objectives and purposes of the CRL, the Redevelopment Plan, and the Implementation Plan; and WHEREAS, the Agency and the City have prepared a Transfer Agreement for the for the Agency to transfer to the City the Properties for the following purposes: (i) the City shall retain each of the Properties listed in Exhibit "A" for public use, in accordance with the City's authority as a duly organized municipal corporation; (ii) the City shall convey each of the properties listed in Exhibit "B" within ninety (90) days through disposition and development agreements for private development by qualified developers experienced in development of environmentally constrained land; (iii) the City shall have all the authority that the Agency has under the CRL to carry out the redevelopment of these Properties; and (iv) the activities of the City hereunder shall be undertaken, in accordance with the CRL, as the CRL is written as of the execution date of the Agreement; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF 01018/00011Y3713.1 Resolution No. 11-13 Page 3 of 3 CARSON DOES HEREBY RESOLVE, AS FOLLOWS: Section 1. The Agency hereby finds and determines that the foregoing recitals are true and correct. Section 2. The Agency has received and heard all oral and written objections to the proposed transfer of Properties from the Agency to the City as proposed in the Agreement, and to other matters pertaining to this transaction, and all such oral and written objections are hereby overruled. Section 3. The Agency hereby approves the Transfer Agreement transferring the Properties listed in Exhibits "A" and "B" of the Transfer Agreement, and approves the transfer of such Properties pursuant to the terms thereof. The transfer is subject to the following terms (see staff request). Section 4. The Agency Interim Executive Director may include the transfer of additional parcels or portions of parcels thereof for street, utility, or other public purposes related to the foregoing. Section S. The Agency Chairman, or designee, is hereby authorized to execute the Agreement on behalf of the Agency, together with such non -substantive changes and amendments as may be approved by the Agency Executive Director and Agency Counsel. Section 6. The Agency Chairman, or designee, is hereby authorized, on behalf of the Agency, to sign all documents necessary and appropriate to carry out and implement the Agreement, and to administer the Agency's obligations, responsibilities and duties to be performed under the Agreement.
