AUTHORIZING AN OFFER TO HERBERT D. INGRAM AND MARY E. INGRAM
FOR PURCHASE OF A STORM DRAINAGE EASEMENT NEEDED FOR THE
PEER MANOR OFFSITE STORM DRAINAGE IMPROVEMENT PROJECT
& AUTHORIZING CONDEMNATION PROCEEDING
WHEREAS, the 1975 Storm Drainage Master Plan and the Capital Improvements Program call for
extensive storm drainage improvements at the western ~f" intersection of West Loudoun Street and West
Market Street and a new channel to Town Branch from West Loudoun Street; and
Wt~REAS, alternative box culvert routes have been evaluated, the design has been completed and
construction plans approved; and
WHEREAS, easements for the underground box culvert are required to allow this project to
proceed; and
WHEREAS, completion of this project during the 1990 construction season is a high priority since
this will correct severe flooding problems on West Loudoun Street and West Market Street.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. Herbert D. Ingram and Mary E. Ingrain are hereby offered a sum of $4,000.00 plus
$7,000.00 for landscaping as just compensation for the easement shown on the attached plat and
described in the easement documents.
SECTION II. In event this offer is not accepted in writing within ten (10) days from receipt, the
Council hereby declares that an essential public convenience and necessity exists to acquire the easement
and does hereby authorize the Town Attorney to f'de the requisite petition for condemnation and early
entry in order to construct the storm drain system on behalf of the Town of Leesburg and does authorize

the Director of Finance to issue a check in the sum of $11,000.00 payable to the Clerk of Circuit Court
in accordance with Section 25-46.8 of the 1950 Code of Virginia, as amended.

Finally, detailed engineering/construction drawings for the
Route 654 interchange shall be completed by TRCV and submitted
to the Town of Leesburg, Loudoun County and VDOT for review
within two years of the date of TRCV's Notice to Proceed to
it's Prime Contractor on the Dulles Toll Road Extension.
There are no ramp toll facilities shown at interchanges 9 and
8 (the Route 7/15 Bypass and future Battlefield Parkway).
All movements at these two interchange facilities are (free)
without charge. The first notes referring to T.B. are on
Sheet 8 of 39, of Exhibit 12 (The Drawings).
We have, by the attached letter, clarified our Application with the
State Corporation Commission to make it clear that there are not toll
facilities shown on our plan.
Thank you Town of Leesburg .for your continued support of TRCV's
Application to bring the DTRE to Leesburg.

Rates of Return, Toll Rates and Ratemaking
Methodology Pursuant to the Virginia Highway
Corporation Act of 1988; Case No. PUA900013
Dear Mr. Bryant:
The purpose of this letter is to amend and clarify the
Application of Toll Road Corporation of Virginia. The amendment
and clarification are as follows:
Exhibit 7 is to be amended by adding the four additional
permits and approvals which are listed on Attachment A
to this letter.
In response to the concern expressed by the Town of
Leesburg in its Resolution of March 14, 1990, Toll Road
Corporation of Virginia hereby confirms that neither the
Application, the financing plan, nor the operating plan
includes or assumes toll revenues or toll facilities on
the two Leesburg interchanges at the Route 7/15 Bypass
and Battlefield Parkway for local traffic movements
within the Town of Leesburg.

, I would appreciate it if you could distribute a copy of this
letter and Attachment A to those persons within the Commission who
received copies of the original Application, testimony and
exhibits.
A copy of this letter and attachment is being served on all
of the persons the Commission has directed the Application and its
Procedural Order of February 13, 1990 be served upon.
