A RESOLUTION: PRESENTED April 10, 1990 90-71 ADOPTED April 10, 1990 AUTHORIZrNG LE'FrER AGREEMENT WITH THE TOLL ROAD CORPORATION OF VIRGINIA AND REPEALING COUNCIL RESOLUTION NO. 90-52 WHEREAS, the Town of Leesburg remains a vigorous supporter of the propoeed Duties Toll Road extension from Route 28 at Dulles Airport to the Leesburg by-pass; and WHEREAB, the Toll Road Corporation of Virglni~ (TRC-W) tins applied to the State Corporation Commi-~ioll (8CC) for ismiance of a Certificate of Authority to construct and operate the Dulles Toll Road from Route 28 to Leesburg, terminating at the Route 7/15 by-pass;/and WHEREAS, this Council, by Resolution No. 90-52, conditionally endorsed this application, subject to three conditions set out in the resolution pursuant to Section 56-539 of the Virginia Highway Corporation Act of 1988; and WHEREAS, Ralph L. Stanley, Chief Executive Officer of the TRCV has submitted a letter to the Mayor dated April 9, 1990, which attempts to respond to the three outstandin~ conditions; and WHE~, it is the position of the TRCV that resolution of these issues in advance of the Certificate of Authority will be helpful with the processing of its application before the SCC and will aide the necessary financing for the project; and WHE~, the aforementioned letter does address the conditions set forth in Resolution No. 90-52, subject to modifications as hereinafter set out: THEREFORE, RESOLVED by the Council of the Town of Leesburg in Vir~nls as follows: SECTION I. The application of the TRCV, filed with the SCC on February 2, 1990, is hereby endorsed, subject to the commitments made in a letter from TRCV Chief Executive ~r Ralph Stanley in a letter dated April 9, 1990, as amended, to include the following language: Development of Alternative H-initial construction for relocated Route 654 shall be accomplished as shown on Sheet 6B of 39 in Exhibit 12 to include two lanes from the proposed eastern ramp to Route 621, when the right-of-way is rrmde available to the TRCA/at no co~t to TRCV and construction of the Route 654/ RESOLUTION - -2- AUTHOR3ZING LETrER AGREEMENT WITH THE TOLL ROAD CORPORATION OF VIRGINIA Battlefield Parkway interchange No. 8 shall occur within three months of a submittal of a capacity study performed by the TRCV, which shows a level of service at any two approaches to the Sycolin Road/Route 7/15 by-pass of level of Service D or worse, and when the year 2000 toll road projections prepared by TRCV for traffic flow and revenue as previously submitted to SCC are achieved. The service level study will be performed at the request of the town or the TRCV and will follow accepted methodology found in the Highway Capacity Manual published by the Transportation Research Board National Resource Council SECTION II. Upon execution of a letter agreement between the Toll Road Corporation of Virginia Chief Executive Officer and the Mayor to include the language set forth in Section I above, Council Resolution No. 90-52 is effectively repealed. Sevila, Mayor Town o~ Leesburg 15 West Market Street Leesburg, Virginia 22075 Dear Mr. Sevila: The purpose of this letter is to respond to the concerns expressed by the Town of Leesburg in it's Resolution of March 14, 1990. TRCV commits to the Town of Leesburg as follow~: TRCV's financial plan submitted to the SCC and the financing will be for the entire toll road from the merging ramps at the existing Dulles Toll Road westward to the Route 7/15 Bypass in Leesburg. Prior to closing such financing, TRCV will have acquired the necessary Right-of-Way (ROW) for the entire road. Prior to a%~ering this approach or schedule in any way, we would consult and reach agreement with the Town of Leesburg. ! After th~ Notice to Proceed is issued by TRCV to it s Prime Contractor, a value of approximately $9.6 million in work will be performed on that portion of the DTRE located in the Town of Leesburg during the first two years. The relocated Route 654/Battlefield Parkway interchange 8 is shown in the current financing plan to be constructed and opened in the year 2000. We intend to maintain that schedule if traffic and projected revenues allow it to occur. As a part of the Comprehensive Agreement process, TRCV will keep annual historical traffic records and will annually make one, five and twenty year projections for all traffic into the future at each interchange to review and update TRCV's plan for when these and other improvements are required. In the event that such updated traffic studies show a Level of Service at any two approaches to the Sycolin Road-Route 7/15 Bypass less than a Level of Service D, TRCV would update it's future projections and schedule. Any such adjustments to the construction schedule for the Route 654 interchange to open prior to the year 2000, shall be subject to SCC approval.
