PRESENT: Mayor Daniel Gubler, Council President Robert Geray, Council Member Peter Wadsworth, Council Member Evan Mann, City Attorney Andrew Rawlings, City Engineer Dave Noel and City Clerk/Treasurer Keri West. ABSENT: Council Member Michael Thompson and Public Works Director Zech Prouse. VISITORS: Kirsti Cook, Mark Schaffer, Beth Schaffer, Tiffany Nielsen, Rylea Farrens, Adam Johnson, Karl Miller, Jeb Casper and Michelle Tolman. Mayor Gubler welcomed everyone and led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of September 26, 2023, were reviewed. Council reviewed the finance reports for the period ending September 30, 2023 (100% of the fiscal year elapsed). The City had $1,633,484.82 in the bank and routine bills had been paid, "Exhibit A". Mayor Gubler entertained a motion. Council President Geray made a motion to approve the consent agenda as presented. Council Member Wadsworth seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: Annexation Ordinance & Initial Zoning — City of Iona; Parcel# RP03N38E368396, located on north side of 49th North, between 45th East and 55th East (Ord. 294-10-23) — Mayor Gubler stated the property that we are discussing is located on 49th North and was owned by Bonneville County. He continued and stated the property was previously used as a landfill and was covered approximately 35 years ago. Mayor Gubler stated Bonneville County has deeded this parcel to the City and the first course of action is to annex it into our City limits. He continued and stated the City has been working with Bonneville County for a few years to acquire this property, with the intention of using it for recreation. Mayor Gubler stated this is a Public Hearing and asked if anyone in the audience would like to address the City Council on this topic. No response. Mayor Gubler closed the Public Hearing portion of this agenda item to allow for Council deliberation. Clerk West stated she has received phone calls regarding the zoning of this property. She explained it is being zoned as R-1: Single Family Residential. She clarified that does not mean there will be houses on this property, but rather the City Code designates that parks should reside in the R-1 Zone. Council Member Wadsworth asked if vault toilets would be allowed. Mayor Gubler confirmed they would be allowed. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve Ordinance No. 294-10-23, an Ordinance annexing certain lands to the City of Iona, Idaho; IONA CITY COUNCIL REGULAR MEETING—OCTOBER 17, 2023 describing these lands; establishing the initial zoning for such lands; requiring the filing of the Ordinance and amended City map and amended legal description of the City with the appropriate county and state authorities; and establishing an effective date. Council Member Wadsworth also stated this parcel is to be zoned as R-1. Council Member Wadsworth also made a motion to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council Member Mann seconded the motion. All in favor. Motion carried. Ordinance to Amend Iona City Code § 10-1-17(E), pertaining to Construction Requirements for Public Ways in the Iona Subdivision Ordinance, specifically driveway approaches (Ord. 295-10-23) —Mayor Gubler asked the Council if they had a chance to review the minutes from the Planning & Zoning Commission (P&Z) Meeting on this topic. All confirmed. Mayor Gubler stated the City Council changed the City Code a few months ago to no longer allow swales in new subdivisions. He continued and stated the City Council determined that swales caused too many issues, so all new subdivisions are now required to install curb and gutter. Mayor Gubler continued and stated, the Council is now reviewing the ordinance that addresses driveway approaches, specifically for those situations when a resident wants to add an additional driveway for a shop or other accessory building. He continued and stated the purpose of the drainage swales was to allow drainage from the roads. Mayor Gubler explained the current requirement is that driveway approaches can be no wider than 30'. He stated the Council is not looking at changing that, but they are going to address some of the rules to allow additional driveways. Mayor Gubler stated the Council is discussing the allowance of an additional driveway, as long as the cumulative width of all driveway approaches does not exceed 50% of the total frontage of the lot. Mayor Gubler then stated something that needs to be considered is the strength requirement for the sidewalk for the sections that are intended to be driven over. He continued and stated the drainage needs to be addressed also. Council Member Wadsworth asked the City Engineer, at what point is it necessary for residents to put in a drainage system in the swale. He continued and stated if someone has 200 feet of frontage and they want to have two driveway approaches that are each 30 feet wide, he does not think they should be required to install a french drain because he believes there is still sufficient drainage area for that length of frontage. Attorney Rawlings explained this amendment allows residents to have separate driveway approaches that take up less than 50% of the total frontage, as long as neither driveway approach exceeds 30 feet in width. He continued and stated if a resident desires to exceed those requirements there is an option to apply and submit engineering that illustrates the proposed design effectively addresses the necessary drainage. Mayor Gubler stated this is a Public Hearing and asked if anyone in the audience would like to address the Council on this topic. An audience member asked why there is a $150 fee for residents that wish to exceed the limits. Mayor Gubler stated that is the cost of the application process. Clerk West clarified the cost covers the City Engineer's review of the provided design and all City staff to review and process the application. Another audience member asked the exact process for residents wanting to alter their driveway approaches. Attorney Rawlings stated with this amendment if a resident wants to increase their driveway approaches but remains under 50% of the frontage and does not exceed 30' wide approaches, they are permitted to do so. If they choose to exceed the 50% or the 30' driveway approach, they would need to apply at the City Office with their engineered design and pay the $150 fee. The application would then be reviewed by the City Engineer and the City Council for final approval. Another audience 2 IONA CITY COUNCIL REGULAR MEETING—OCTOBER 17, 2023 member asked what material is considered part of the driveway approach. Mayor Gubler stated anything that is non-permeable. Another audience member asked if he could fill his swale with road base if it doesn't make the driveway approaches exceed 50%. Mayor Gubler stated if it exceeds the driveway approach beyond the 30' he would be required to submit an application and design. City Engineer Dave Noel stated compacted road base is not considered permeable. Discussion then turned to what a drainage swale is and where they are located throughout Iona. An audience member asked if their design is denied by the City Engineer and they make the necessary adjustments and resubmit it, would they be required to pay an additional $150. Mayor Gubler said no, they would only be charged once. Council President Geray stated that would allow residents to submit anything they want and have our City Engineer basically design it for them with his recommendations. Engineer Noel expressed concern over this process also. Mayor Gubler asked if there were any other comments or questions from the public. No response. He then closed the Public Hearing portion of this agenda item. Council Member Mann asked Mayor Gubler to clarify if he wanted to add a statement about the ownership of the sidewalks. Mayor Gubler stated the City cannot divest itself of the right of way, which includes the sidewalks. Council President Geray clarified the process and asked if there needs to be anything additional regarding a denial and what the resubmit process is. Mayor Gubler stated in the past the City has waived fees for a resubmitted application. Council President Geray stated if the City has to pay the City Engineer to review an application two times, he does not think the City should be covering those costs. He continued and stated he thinks the amendment wording should stay the way it is and if an application is denied the applicant would need to repeat the process from the beginning. Attorney Rawlings agreed and stated most jurisdictions would give an approval or denial without much feedback for the applicant on how to resubmit for approval. Engineer Noel stated he feels the proposed amendment is missing the desired percolation rates for approval. He continued and stated the City recently approved an alternate drawing for swales that lists the required percolation rates, but that is the only place in the City Code that those calculations can be found. Engineer Noel continued and stated there needs to be something in this amendment that points to those required calculations for the applicant's engineer to follow. Mayor Gubler directed Attorney Rawlings to work on a new draft for this amendment that will reference that drawing and the subsequent calculations. Mayor Gubler asked if they can pass this amendment with the addition of a reference to the Standard Drawings added. Attorney Rawlings stated they would need to use the exact words in the motion that they want him to add; otherwise it would be better to re-draft it for approval at next month's meeting. Council President Geray stated he doesn't feel this is urgent enough to pass tonight and suggested tabling it until next month. Council Member Wadsworth agreed. Mayor Gubler entertained a motion. Council President Geray made a motion to table Ordinance No. 295-10-23, an Ordinance to amend Iona City Code § 10-1-17(E), pertaining to Construction Requirements for Public Ways in the Iona Subdivision Ordinance, specifically driveway approaches. Council Member Wadsworth seconded the motion. All in favor. Motion carried. 3 IONA CITY COUNCIL REGULAR MEETING—OCTOBER 17, 2023 Ordinance to Amend Iona City Code § 11-1-5, pertaining to shipping containers as accessory buildings (Ord. 296-10-23) — Attorney Rawlings stated shipping containers are increasingly being used for storage in the residential areas of the City. He continued and stated they have fallen into a gap because they are not buildings or structures. Attorney Rawlings stated this amendment will cause shipping containers to fall into the "accessory building" category and will therefore need to meet the same setback requirements, as requested by the Building Official. Mayor Gubler stated this is a Public Hearing and asked if anyone in the audience would like to address the City Council on this topic. No response. He then closed the Public Hearing portion of this agenda item for Council deliberations. Council President Geray asked if the P&Z recommended approval of this ordinance. Clerk West confirmed. She stated there was one member that opposed it, but he did not give any explanation. Mayor Gubler entertained a motion. Council Member Mann made a motion to approve Ordinance No. 296-10-23, an Ordinance of the City of Iona, Idaho; amending Section 11-1- 5(A)(1) of the Iona City Code; amending the definition of accessory building to clarify that shipping containers are included in that definition; providing methodology; preserving prior ordinances in each instance; providing for severability; and establishing an effective date. Council Member Maim also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council Member Wadsworth seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member Mann: YES Ordinance to Amend Iona City Code 1-6-1: Regular Meetings, pertaining to the date of monthly City Council Meetings (Ord. 297-10-23) — Mayor Gubler stated this ordinance is to move the regular City Council meetings to the fourth Tuesday each month, rather than the third Tuesday. Clerk West clarified this ordinance allows the City Council to pass a yearly meeting schedule by Resolution, rather than requiring those meetings to take place on a specific day of each month, as currently stated in the City Code. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve Ordinance No. 297-10-23, an Ordinance of the City of Iona, Idaho; amending Section 1-6-1 of the Iona City Code; clarifying that regular monthly meetings of the City Council will be specified by Resolution; providing methodology; preserving prior ordinances in each instance; providing for severability; and establishing an effective date. Council Member Wadsworth also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council President Geray seconded the motion. All in favor. Motion carried. Approval of Resolution 2023-04: Building Rental Fees — Mayor Gubler stated the City is looking to increase the rental fees for the City Building. He continued and stated the rates for City residents will remain the same, but non-resident fees will increase. Mayor Gubler explained further that residents will continue to pay $30/hour or $150/day, but non-residents will now be required to pay $60/hour or $300/day to rent the gym or Council Room in the City Building. He continued and stated the Council felt there needed to be a greater benefit to the City residents. 4 IONA CITY COUNCIL REGULAR MEETING—OCTOBER 17, 2023 Clerk West stated the Resolution also requires a non-refundable $50 reservation fee that will go towards the rental amount. She continued and stated the office staff will begin requiring this for renters to reserve their dates. An audience member asked if a renter would receive their $50 reservation fee back if they canceled more than 2 weeks in advance. Council Member Mann said the $50 fee is non-refundable. Clerk West confirmed and said that covers the cost of the office staff's time to communicate back and forth with the renters. Council President Geray stated the City has been very diligent when charging fees to ensure that every application is paying for itself. He continued and stated the City pays the staff to complete certain tasks and those costs should not be subsidized by the City if they are associated with an individual's use. Council President Geray gave additional examples and stated the costs should be offset by the individual that is requesting those specific services. An audience member asked if there are different rates for non-profit organizations. Clerk West stated the Resolution does give the Mayor authority to allow a reduced rate by written agreement. She continued and stated the City has worked with non-profit organizations before and have agreed to a reduced rental fee, but they are still required to pay something because utilities and cleaning services are still being used. Council Member Wadsworth stated there have been instances in the past where the City waived all fees because the rental was considered a benefit to the residents, such as the theater program last year that was free for the community. Mayor Gubler entertained a motion. Council President Geray made a motion to approve Resolution No. 2023-04, a Resolution updating the rental fees and required deposits for the Iona Community Center. Council Member Mann seconded the motion. All in favor. Motion carried. Approval of Professional Services Agreement; City Engineering Services — Fiscal Year 2024 for Forsgren & Associates, Inc. —Mayor Gubler stated this was discussed last month and was postponed until this meeting to allow more time for the City Attorney and City Engineer to discuss and determine appropriate language in the contract. Attorney Rawlings confirmed he has been working with Dave Noel and Kevin Harris, both of Forsgren & Associates. He continued and stated it was determined by both parties to have a "Base Contract" and "Task Orders" for specific projects, etc. Attorney Rawlings stated the first Task Order includes all the basic functions for the City Engineer. Clerk West stated this document is not in the Council packet because the agreement was just completed today. City Engineer, Dave Noel, distributed paper copies of the proposed agreement to the City Council. Council President Geray asked the length of the contract. Attorney Rawlings stated it is included in Section 2 of the agreement and specifies the contract to go until September 30, 2024, with automatic renewal, unless either party chooses otherwise. Council Member Wadsworth stated he agrees with this course of action because it gives the City an option to pursue other firms if they are not satisfied but are not required to go through that process if they are happy with the services provided by Forsgren & Associates. Council President Geray asked for further clarification from Attorney Rawlings regarding the "Termination" section of the contract. Attorney Rawlings stated this section allows the City to terminate for cause or to simply not renew the contract at the end of the term. He did clarify the contract does not allow the City to terminate the contract without cause. Council President Geray stated if the City Attorney feels this agreement is adequate to terminate the contract for just cause, he feels that is sufficient. Attorney Rawlings confirmed he believes the City and Forsgren & Associates all have the same understanding of that intent. He clarified 5 IONA CITY COUNCIL REGULAR MEETING—OCTOBER 17, 2023 that this agreement does not allow for at-will termination. Engineer Noel stated each task or project will be completed by separate Task Order Agreements, so Forsgren will only complete tasks that are agreed upon with a scope of work and project cost. Mayor Gubler entertained a motion. Council President Geray made a motion to approve the Base Contract for Engineering Services dated October 17th, 2023, between the City of Iona and Forsgren & Associates, Inc. Council Member Wadsworth seconded the motion. All in favor. Motion carried. Discussion of Story Walk in City Park—Mayor Gubler stated the City was approached by the Bonneville County Library District (BCLD) that they have received a grant that would pay for large story boards to be placed around the City Park for children to read as they walked around the path. He continued and stated he thinks it is a great idea but would be concerned if they were placed in areas of the park that would interfere with sports activities. Michelle Tolman from BCLD stated the grant covers the cost of all materials, but the City would need to install them. She brought a stand to the front of the room to show as a visual reference. Mrs. Tolman stated there are a total of 10 stands that have been provided. The City Council reviewed a map of the City Park on the projector and discussed potential locations. Council Member Wadsworth asked if the stories can be changed in the boards. Mrs. Tolman confirmed there are many other stories that can be provided when they want to change them out. Clerk West asked if Director Prouse had mentioned any concerns regarding this topic. Mayor Gubler stated he did express concern when they are mowing the grass, but he personally does not feel this would be a big hinderance. An audience member expressed concern that these story boards would be prone to graffiti. Mayor Gubler stated everything in the park is prone to graffiti, but asked if these boards are going to be easy to clean. Mrs. Tolman stated the City could add plexiglass on top of the boards for protection. Mayor Gubler stated if the City Council agrees, he will talk to Director Prouse about placement, preferably starting at the sidewalk in front of the library entrance. Council Member Wadsworth stated this could also be a good project for a youth group. Mayor Gubler suggested possibly having the Mayor's Youth Advisory Council (MYAC) install them, with supervision. All Council members agreed to move forward with this project. General Fiber Discussion — Mayor Gubler stated Director Prouse could not attend the meeting tonight, but he did provide a written update regarding the fiber project. As a summary, Direct Communications is continuing to work to install conduit and pull fiber throughout the various zones of the City. A punch list of items to be repaired has been issued to Direct Communications and they are currently working on those repairs. Mayor Gubler clarified the City has a contract with Direct Communications to bring fiber to each residence in the City, but Fybercom has chosen to bring fiber service to the City on their own dime. He then continued to read Director Prouse's report. The City issued a letter to Fybercom on 10/02/2023 with a punch list of items to correct that were done unsatisfactorily in the public right-of-way. Fybercom has completed all items on the list in the timeframe that was stipulated in the letter. Fybercom currently has 3 open Right-of-Way Permits that cover the following areas: Country Haven, Mountain Ridge, all of Iona Road, Rushton Road to Olsen Avenue, Freedom Field Estates and Sunrise Acres. Fybercom has applied for another Right-of-Way Permit that has not been approved yet and will not be permitted until the work in the other areas is completed. Fybercom has now contracted with the same installation contractor that was previously used by Direct Communications, in an attempt to reduce the construction errors going forward, and the quality of work has drastically improved. 6 IONA CITY COUNCIL REGULAR MEETING—OCTOBER 17, 2023 An audience member asked if any residents have had problems with broken items in their yard due to the fiber installation. Mayor Gubler stated that has happened and the companies are responsible for fixing anything they break. He continued and stated residents need to contact the companies directly and report the issue. Clerk West added if the companies are not repairing issues after they have been reported, residents are encouraged to contact the City Office to report it for escalation to Direct Communications' upper management. SUGGESTED AGENDA ITEMS: No comments made. STAFF REPORTS: Deputy Davies stated the reports have been provided. Clerk West stated the law enforcement reports have been added to the City Council packets. Deputy Davies stated most of the items on the reports are consistent with last year, but traffic stops have increased. He also stated he is working with a few residents on ordinance violations. Council Member Wadsworth expressed appreciation to Deputy Davies for the good work he is doing for the City. Clerk West reported the Recreation Department is doing well. They just completed Fall Flag Football in the City Park and Director Oliverson said it went really well at that location. Fall Basketball registration just ended and there are approximately 60 teams registered, which is double what it was last year. She continued and stated Winter Basketball registration will be held November 6-8. Clerk West also reported that City Elections will take place on Tuesday, November 7th and there will be a Meet the Candidates Night on Thursday, November 2' ' at 6:00pm in the Council Chambers. She continued and stated there will be an open Q&A forum with the public at that event. Clerk West also reported the City Halloween Carnival will take place on Saturday, October 28th at the City Building from 2-4pm. Council Member Wadsworth stated he recognizes the motorcycle issue that is going on throughout the City. He continued and stated he has stopped and talked to a few of the boys that have been riding their motorcycles and some of them are not getting the clue that their behavior needs to stop for safety reasons. He asked Deputy Davies what the options are if he sees them driving through town at a high speed with no registration, etc. Deputy Davies said he can charge them. Mayor Gubler stated if the riders are not following the laws for helmets, speed, etc., they should start getting charged. Deputy Davies agreed. Council Member Mann stated Recreation Director Oliverson is doing a great job. He also reported the Mayor's Walking Challenge is almost complete and he will earn $1,000 to donate to the schools. Council President Geray asked if there is a speaker selected for Veteran's Day. Rylea Farrens commented from the audience that she has not found a speaker yet but did ask for a City Council representative to attend the program. Council President Geray and Mayor Gubler both confirmed they would be there. Mayor Gubler stated the path forward for the park on 49th North is to begin with a topographical survey with a drone that will provide millions of data points. Once they have that information and know how much cap there is on top of the landfill, the City will start researching and 7 IONA CITY COUNCIL REGULAR MEETING—OCTOBER 17, 2023 drafting plans to present to the City residents for their input.
