HomeMy Public PortalAbout1990_06_27_R150Leesb~rg in CVirginia PRESENTED June 27, 1990 RESOLUTION NO. 90-150 ADOPTED June 27, 1990 A RESOLUTION: ACCEPTING PUBLIC IMPROVEMENTS AND A CASH PAYMENT IN LIEU OF SIDEWALK CONSTRUCTION, RELEASING THE PERFORMANCE GUARANTEE AND APPROVING A MAINTENANCE GUARANTEE FOR PUBLIC IMPROVEMENTS AT COUNTRY CLUB APARTMENTS II WHEREAS, John C. Wright & Son, the developer of Country Club Apartments II has completed the public improvements except for 1,150 linear feet of sidewalk in accordance with approved plans and town standards, and these have been inspected and approved; WHEREAS, the developer has offered a cash payment to the town in the amount of $10,350.00 in lieu of construction of 1,150 linear feet of sidewalk along the north side of Clubhouse Drive; WHEREAS, the Department of Engineering and Public Works has approved the $10,350.00 payment as the construction cost of the sidewalk. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The irrevocable letter of credit from First American Bank in the amount of $235,803.00 is released, and a new surety in a form approved by the town attorney for a maintenance guarantee in the amount of $11,790.00 is approved, and shall be in effect for a period of one year from this date. SECTION Il. A cash payment of $10,350.00 is hereby accepted in lieu of construction of 1,150 linear feet of sidewalk. SECTION III. This release is contingent upon delivery of a properly executed instrument conveying unto the town all such improvements and easements free of any liens or charges.
