The regular meeting of the City Council of the City of Temple City was called to order by Mayor Harker at 7:30 P. M. Rev. R. 2. E. Schulz of the Lutheran Church, 9123 Broadway, Temple City. 3. Mayor Harker then led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker ALSO PRESENT: City Attorney Martin and City Manager Woollett. 5. APPROVAL OF MINUTES: Regular meeting of April 12, 1965. Councilman Nunamaker moved to approve the minutes of the regular meeting of April 12, 1965, as mailed, Councilman Merritt seconded carried by the following called vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: 6. SWEARING IN OF NEW CITY ATTORNEY: CHARLES R. MARTIN City Clerk Woollett administered the Oath of Office to Charles R. Martin who has been appointed our new City Attorney. The Councilmen then congratulated Mr. Martin and welcomed him as a City Official. 7. ORDINANCE NO. 65 -151: 1st read. Mobile Parks & Homes Thereon. City Attorney Martin presented Ordinance No. 65 -151 which relates to and regulates mobile home parks and mobile homes thereon, titled as follows: AN ORDINANCE RELATING TO AND REGULATING MOBILE HOME PARKS AND MOBILE HOMES THEREIN, REQUIRING PERMITS AND AFFIX- ING FEES THEREFOR, DESCRIBING MINIMUM STANDARDS FOR CONSTRUCTION, OPERATION AND MAINTENANCE OF MOBILE HOME PARKS, ESTABLISHING RES- PONSIBILITIES, DEFINING OFFENSES AND PRESCRIBING PENALTIES, AND REPEALING ALL ORDINANCES IN CONFLICT. Councilman Tyrell moved to waive further reading of Ordinance No. 65 -151, Councilman Nunamaker seconded, motion unanimously carried. No further action was taken as this was the first reading of the ordinance. 8. ORDINANCE NO. 65 -149: Determining Intention to form Parking Dis- trict No. 4. 2nd reading. City Attorney Martin read title to Ordinance No. 65 -149 AN ORDI- NANCE OF THE CITY OF TEMPLE CITY, CALIFORNIA, DECLARING THE IN- TENTION OF THE CITY COUNCIL OF SAID CITY TO FORM VEHICLE PARKING DISTRICT NO. 4 OF SAID CITY AND TO ACQUIRE AND IMPROVE LANDS FOR PARKING PLACES, AS PROPOSED IN THE PETITION THEREFOR, AND FIXING THE TIME AND PLACE FOR HEARING AND GIVING NOTICE THEREOF. Councilman Tyrell moved to waive further reading of Ordinance No. 65 -149, Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell moved to adopt Ordinance No. 65 -149, Councilman Nunamaker seconded, carried by the following roll call vote: AYES: Councilmen- Dickason, Merritt, Nunamaker, Tyrell, Harkeri NOES: Councilmen -None ABSENT: Councilmen -None 9. ORDINANCE NO. 65 -150: Change of Council Meeting nights. The City Attorney advised this Ordinance had been adopted as an urgency ordinance but recommended it also receive a second read- ing. He then read title to Ordinance No. 65 -150 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTION 2703 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO THE TIME OF COUNCIL MEETINGS. Councilman Tyrell moved to waive further reading of Ordinance No. 65 -150, Councilman Nunamaker seconded, carried by the following called vote: 726 Council Minutes, April 20, 1965, page 2 AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell moved to adopt Ordinance No. 65 -150, Council- man Merritt seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 10. RESOLUTION NO. 65 -460: re Double Drive City Attorney Martin read title to Resolution No. 65 -460 A RESO- LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DESIGNATIN A PORTION OF DOUBLE DRIVE WITHIN THE CITY AS A TRUCK ROUTE. Councilman Tyrell moved to adopt Resolution No. 65 -460, Council- man Dickason seconded, carried by unanimous vote. 11. RESOLUTION NO. 65 -461: re "No Parking" Olive St. City Attorney Martin read title to Resolution No. 65 -461 A RESO- LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ESTABLISH- ING A "NO PARKING" ZONE ON THE SOUTH SIDE OF OLIVE FROM ROSEMEAD EASTERLY 450 FEET. Councilman Tyrell moved to adopt Resolution No. 65 -461, Councilman Nunamaker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 12. RESOLUTION NO. 65 -462: re loading zone, Longden School City Attorney Martin read title to Resolution No. 65 -462 A RESO- LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DESIGNAT- ING CERTAIN STREETS AS ZONES OF LIMITED PARKING AND ORDERING THAT THE SAME BE PAINTED IN ACCORDANCE WITH THE TEMPLE CITY MUNI. CIPAL CODE. (White Loading Zone - Longden School, 8:00 A. M. - 6:00 P. M.) Councilman Tyrell moved to adopt Resolution No. 65 -462, Councilman Merritt seconded, motion unanimously carried. 13. APPOINTMENT OF COUNCILMEN TO COMMITTEES: At this time Mayor Harker stated in the reorganization of the Council he would make the following appointments: Finance Committee, he appointed himself as Mayor Library, Councilman Merritt Civil Defense, Councilman Tyrell to continue as representative of the Council He also previously had appointed Councilman Nunamaker as Director from this City to the League of Calif. Cities and at this time appointed Councilman Dickason as Alternate Director. Councilman Merritt will continue as Council representative to the Calif. Contract Cities, and Councilman Tyrell as Alternate. NEW BUSINESS: 14. ORDINANCE NO. 65 -153: re Off- Street Parking requirements. 1st reading. City Attorney Martin explained the Ordinance and read title to Ordinance No. 65 -153 AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING A NEW CHAPTER 9 TO ARTICLE 111 OF CHAPTER Vill OF TEMPLE CITY MUNICIPAL CODE RELATING TO DESIGN REQUIREMENTS OF OFF -STREE PARKING FACILITIES. Councilman Tyrell moved to waive further reading of Ordinance No. 65 -153, Councilman Merritt seconded, motion unanimously carried. No further action was taken as this was the first reading of the ordinance. 15. ORDINANCE NO. 65 -152: Re Council Meetings, etc. 1st reading. City Attorney Martin read in full. Ordinance No. 65 -152 AN ORDI- NANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 2700, 2701, 2702, 2703, AND 2704 OF THE TEMPLE CITY MUNICIPAL CODE. Council- man Tyrell was opposed to Section 2702 which states the City offices shall be closed on all official State Holidays as listed in Section 6700 of the CaliFornia Government Code, and that the City Hall should be open comparable to businesses in town. Also Section 2704 requiring seven copies of items to be consider- ed on the Agenda for the next meeting, and that they be present- ed six days (Sunday included) in writing before the Council Meeting. The City Manager advised our Personnel ordinance pro- 727 Council Minutes, April 20, 1965, page 3 vides only six holidays which is in conflict with the State of California Government Code, and also with Section 2702 of our Municipal Code. Following discussion it was agreed that Sections 2702 and 2704 be withheld for further consideration, Councilman Tyrell then moved to waive further reading of Ordinance No. 65- 152 covering Sections 2701 and 2703 and withholding Sections 2702 and 2704, Councilman Nunamaker seconded, carried by the following roll call vote: BYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None As this was the first reading no further action was taken. 16. ASSESSMENT HEARING FOR SIDEWALK CONSTRUCTION: Double Drive. City Manager Woollett advised this hearing was requested for assessments covering sidewalk installation on the west side of Double Drive from Grand to Daines. Councilman Merritt moved to set a public hearing for 7 :30 P. M., May 4, 1965, Councilman Tyrell seconded, motion unanimously carried. 17. RESOLUTION NO. 65 -458: Warrants & Demands, Vehicle Parking Dis- trict Improvement Fund City Manager Woollett presented Resolution No. 65 -458 A RESOLUTIO! OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $1,060.00, DEMAND NO. 108, ACQUISITION AND IMPROVEMENT FUND VEHICLE PARKING DISTRICT #2. Councilman Tyrell moved to adopt Resolution No. 65 -458, Councilman Nunamaker seconded, carried by the following called vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 18, RESOLUTION NO. 65-459: Warrants & Demands City Manager Woollett presented Resolution No. 65 -459 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $29,375.84, DEMAND NOS. 6433 THROUGH No. 6448. Councilman Tyrell moved to adopt Resolution No. 65- 459, Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 19. AMENDMENT TO AGREEMENT BETIEEN CITY AND COMMUNITY DISPOSAL CO. City Attorney Martin presented the proposed amendment which pro- vided for adjustment of schedule of charges from $2. to $2.15 per month due to cost of living increase of 7.79 %. Councilman Tyreli moved to approve and instruct the Mayor and City Clerk to sign on behalf of the City, Councilman Nunamaker seconded, carried by the following called vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 20. RESOLUTION NO. 65- 463 :Amending Resolution No. 64 -376 re acquisi- tion of property for Parking District No. 1 City Attorney Martin explained the resolution was to get back funds advanced in taxes, escrow charges, down payment and monthly payments in excess of the sum of $7500. for property acquisition in Parking Dis.t. #1. He then read title to Resolution No. 65 -463 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMEND - ING RESOLUTION NO. 64 -376 IN CONNECTION .,'IITH THE ACQUISITION OF PROPERTY FOR PARKING DISTRICT NO. 1. Councilman Nunamaker moved to adopt Resolution No. 65 -463, Councilman Tyrell seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None COMMUNICATIONS: 21. City Manager Woollett presented a letter from the Los Angeles County Boundary Commission re proposed annexation #1965-1, City of San Gabriel. Councilman Tyrell moved to receive and file, 728 Council Minutes, April 20, 1965, page 4 Councilman Nunamaker seconded, and carried. 22. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Charles Archer, 9844 Broadway, Temple City, spoke representing three areas, first as a citizen, second as a telephone subscriber, and third as a telephone employee. He suggested the Council re- view the request of the League of Calif. Cities and the City of Long Beach, both of whom have requested a special tax be imposed on telephone companies of California and that this be pro -rated to cities on per capita basis for their general fund. He asked that the Council review this with the thought in mind that every- one is concerned with tax reduction and not increase. 23. MATTERS FROM CITY OFFICIALS: Councilman Dickason inquired about the two law suits pending, one on Kauffman and one Findley etal. City Manager Woollett advised he had discussed this with the City Attorney very briefly, and Mr. Martin & Mr.Shatford will review the status and he will come up with a recommendation at that time. Councilman Merritt reported on the Civil Defense meeting he and Mr. Sale had attended. Sheriff Peter Pitchess was the speaker and reported on the proposed program of the new plan that the Sheriff's office would take over totally in state of disaster. The Sheriff advised that during a disaster of great magnitude they would not have the regular procedures so they would be able to handle it without difficulty. Councilman Nunamaker presented a letter from the Savings Bond Committee and advised he is Chairman in this area and requested the Mayor to proclaim May "Savings Bond Campaign Month ". Council- man Dickason moved to have the Mayor so proclaim, Councilman Tyrell seconded and carried, Mayor Harker so proclaimed..,,. Councilman Tyrell referred to a recent request from a youth or- ganization With headquarters in Arcadia, and in which a number of Temple City youth are enrolled: The request had been for a banner across Las Tunas br, advertising a circtis...for the benefit of the school and which the Council denied. Councilman Tyrell moved to reconsider this and grant them this permission. Following discus- sion the motion died for lack of a second. Councilman Dickason stated some time ago the Council was consider ing adopting an ordinance to control businesses that come into th, city or move without respect to zoning. Discussion followed. The City Manager and City Attorney will review and check with other cities in the area and report back to the Council.. Mayor Harker presented the subject of power poles in the Parking Districts and malls, and recommended the City Manager and Staff be instructed to begin negotiations with Edison Co. on removal of poles in Parking Districts as they have been formed and to go underground or moved to edge of areas. Following discussion Councilman Nunamaker moved to instruct the City Attorney and City Manager working together with the staff to look into the matter o relocation of power poles presently located in the Parking Dis- tricts, Councilman Merritt seconded, carried by the following roll call vote: AYES: Councilmen- Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None City Manager `Woollett presented a status report on allowable im- provements in parkways and advised it had been sent to the Traffic Commission for consideration. The City Manager stated the City had advanced $31,248.84 to Park- ing District No. 2 and recommended the Council authorize the re- turn of these funds to the General Fund of the City, such transfer of funds to be completed immediately, is it wi l l • be on expenditure resolution at next Council meeting. This will be paid to the General Fund from the Parking District #2 Improvement Fund. Councilman Dickason moved to authorize the return of these funds to the General Fund, Councilman Tyrell seconded, carried by the 729 1 1 Council Minutes, April 20, 1965, page 5 following roll call vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None City. Manager Woollett suggested the Council instruct the staff to draw specifications and go to bid for the City's liability insurance. Councilman Merritt so moved, Councilman Tyrell se- conded, and the motion was unanimously carried. 2k. ADJOURNMENT: Councilman Merritt moved to adjourn to 7 :30 P.
