ORDINANCE NO. I S ~
AN ORDINANCE LEVYING AND ASSESSING SPECIAL
ASSESSMENTS ON CERTAIN LOTS, PIECES AND
PARCELS OF LAND LIABLE FOR SUCH SPECIAL
ASSESSMENTS TO PAY THE COSTS OF INTERNAL
IMPROVEMENTS IN THE CITY OF BEL AIRE,
KANSAS, AS HERETOFORE AUTHORIZED BY
RESOLUTION NOS. R-88-12, R-88-13, R-88-14
AND R-89-10, RESPECTIVELY, OF THE CITY; AND
PROVIDING FOR THE COLLECTION OF SUCH SPECIAL
ASSESSMENTS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL
AIRE, KANSAS:
SECTION - 1. For the purpose of paying the costs of the
following described improvements in the City:
Water Distribution System Ex.tension in
portions of Blocks 3, 4, 5, and 6 in
Kappelman's Bel Aire Heights an addi tion to
Sedgwick County, Kansas known as Phase I I I
Water Extension;
Sanitary Sewer Extension in portions of
Blocks 3, 4, 5 and 6 in Kappelman's Bel Aire
Heights, an addition to Sedgwick County,
Kansas known as Phase III Sewer Extension;
Asphalt paving with concrete curb and gutter
and related i terns on Farmstead Street from
the South line of Lot 33, Block 5, to the
South line of Farmstead Court No.6,
Fa rmstead Court No.5, 48th St. Ci rc Ie #1,
48th St. Ci rcle #2, 48th St. from Farmstead
to Homestead, and Homestead St. from the
North line of Homestead Court No. 1 to the
North line of Lot 15, Block 3, all in
Kappelman' s Bel Aire Heights, according to
the plans and specifications to be furnished
by the City Engineer; and

Construction of a waterworks
including necessary water mains,

to the City of Bel Aire, Sedgwick County, Kansas; as heretofore
authorized by Resolution Nos. R-88-12, R-88-13, R-88-14 and
R-89-10, respectively, of the City of Bel Aire, Kansas, there
are hereby levied and assessed against the properties liable
therefor the severa 1 amounts set forth on Exhibi t A attached
hereto following the description of each lot, piece or parcel
of land.
SECTION 2. The amounts so levied and assessed as set forth
on Exhibit A of this Ordinance shall be due and payable from
and after the date of publication of this Ordinance; and the
City Clerk shall notify the owners of the above described
properties, insofar as known to said City Clerk, of the amounts
of their respective assessments; and, said notice shall further
state that unless such assessments are paid within thirty (30)
days from the date of publication of this Ordinance, bonds will
be issued therefor. The City Clerk shall certify to the County
Clerk, in the same manner and at the same time as other taxes
are certified, for a period of ten (10) years, all of the above
assessments !"lhich have not been paid within thirty (30) days
after the date of publication of this Ordinance, together with
interest on such amount thereof at a rate not exceeding the
maximum rate therefor as prescribed by the laws of the State of
Kansas; and such amounts so certified shall be placed on the
tax rolls and shall be collected as other taxes are collected
over said period of ten (10) years, the levy for each year
being a portion of the principal amount of the assessment plus
one (1) year's interest on the amount remaining unpaid.
SECTION 3. This Ordinance shall take effect and be in
force from and after its passage, approval and publication once
in the official city newspaper.
