A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY, CALIFORNIA, URGING THE STATE LEGIS-
LATURE TO ADOPT LEGISLATION WHICH WOULD PERMIT
GENERAL LAW CITIES TO LEVY A CIGARETTE TAX
WHEREAS, the City Council of the City of Temple City,
California, is cognizant of the ever- increasing tax burden upon the
property owner in the State of California; and
WHEREAS, it has been determined that State Law as now
written permits chartered cities to levy a cigarette tax, but does not
permit general law cities to levy such a cigarette tax; and
WHEREAS, this Council is of the opinion that the levying of
a cigarette tax by general law cities in the State of California would
be a fair and equitable means of obtaining additional revenue without
placing an undue burden on any individual, and particularly, would be
a step in the direction of eliminating the necessity of increasing the
property tax levy of such cities; and
WHEREAS, Assemblymen Lanterman, Knox, Schabarun and Townsend
have introduced Assembly Bill No. 399, which would amend the Revenue
and Taxation Code of the State of California to permit any County and
any City in such a County to impose a sales tax on cigarettes accord-
ing to the standards and limits set out in said Code, and further
permits any City or County to contract with the Board of Equalization
for collection of such tax; and
WHEREAS, said Assembly Bill No. 399 has been referred to the
Committee on Revenue and Taxation;
NOW, THEREFORE, BE IT RESOLVED, that this City Council does
hereby urge the State Legislature to give favorable consideration to
Assembly Bill No. 399, and to adopt legislation enabling general law
cities in the State to levy a cigarette tax; and
BE IT FURTHER RESOLVED, that this Council hereby urges, the
County of Los Angeles,t:all cities in said County, and the League of
California Cities to support such legislation; and
BE IT FURTHER RESOLVED, that certified copies of this Reso-
lution be forwarded to the following:
1. Assemblymen Lanterman, Knox, Schabarum and Townsend
2. All legislators in Los Angeles County not named above
3. League of California Cities
4. Board of Supervisors of Los Angeles County
S. All cities in Los Angeles County
6. All members of Revenue and Taxation Committee of both
Assembly and Senate; and
BE IT FURTHER RESOLVED, that the City Clerk shall certify to
the passage and adoption of this Resolution; shall cause the same to
be entered among the original Resolutions of said City; and shall make
a minute of the passage and adoption thereof in the records of the
proceedings of the City Council of said City in the minutes of the
meeting at which the same is passed and adopted.
PASSED AND ADOPTED by the City Council of the City of Temple
City at its regular meeting held on the 6th day of June, 1967.
