Check our website for updates at: www.moabcity.org Agenda 4 of 80 MOAB CITY COUNCIL REGULAR MEETING February 23, 2016 The Moab City Council held its Regular Meeting on the above date in the Council Chambers at the Moab City Center, located at 217 East Center Street, Moab, Utah. Mayor David Sakrison called the Pre -Council Workshop to order at 6:00 PM. In attendance were Councilmembers Heila Ershadi, Rani Derasary, Kyle Bailey, Tawny Knuteson-Boyd and Kalen Jones. Also in attendance were City Manager Rebecca Davidson, City Recorder/Assistant City Manager Rachel Stenta, Planning Director Jeff Reinhart, Police Chief Mike Navarre and City Engineer Phillip Bowman. In Pre -council workshop a presentation was given by John Croft of the Dan O'Laurie Museum and Don Montoya, an Archeologist with the BLM (Bureau of Land Management), concerning the museum. Jeff Beckman of Bowen, Collins and Associates and City Engineer Bowman gave a presentation on sewer, in the Pre -council workshop. Mayor Sakrison called the Regular City Council Meeting to order at 7:00 PM and led the pledge of allegiance. Twenty-nine (29) members of the audience and media were present. Councilmember Jones moved to approve the Regular Council Meeting minutes of January 25, 2016. Councilmember Derasary seconded the motion. The motion carried 5-0 aye, with City Councilmembers Bailey, Ershadi, Jones, Knuteson-Boyd, Derasary voting aye. Under Citizens to be Heard Sara Melnicoff of Moab Solutions and a Salvation Army Volunteer, distributed a Fact Sheet on Moab Solutions. Ms. Melnicoff stated that August 2016 will be the 12th year of Friends of the Parkway, and that Friends of the Parkway helps to maximize recycling and minimize the destruction of the land. Mayor Sakrison presented Tatum Packard with the Mayor's Student Citizenship of the Month Award for January 2016 for Helen M. Knight School. REGULAR MEETING & ATTENDANCE PRE COUNCIL WORKSHOP REGULAR MEETING CALLED TO ORDER APPROVAL OF MINUTES CITIZENS TO BE HEARD PRESENTATION OF MAYOR'S STUDENT OF THE MONTH Agenda 5 of 80 A presentation was given from Mrs. Camps' sixth grade class from Helen M. Knight Elementary School. The students presented their findings and reports on a handful of topics. One topic was concerning the Pedestrian Crossings on Main street, to which City Manager Davidson asked if the students would return to the next City Council meeting to present their report to UDOT. Councilmember Ershadi moved to approve a Request for Special use of City Parks Permit for Sun Court for the Moab Music Festival. Councilmember Bailey seconded the motion. The motion carried 5-0 aye, with City Councilmembers Bailey, Ershadi, Jones, Knuteson-Boyd, Derasary voting aye. Councilmember Bailey moved to approve a Special Event License and Special Use of Swanny City Park for Southeastern Utah District Health Department to Conduct the Moab Farmers Market on select Thursdays from April 2016 through October 2016. Councilmember Knuteson-Boyd seconded the motion. The motion carried 5-0 aye, with City Councilmembers Bailey, Ershadi, Jones, Knuteson-Boyd, Derasary voting aye. Councilmember Derasary moved to approve a Waiver/Refund of fees for the Southeastern Utah District Health Department for the Moab Farmers Market not to exceed $965. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye, with City Councilmembers Bailey, Ershadi, Jones, Knuteson-Boyd, Derasary voting aye. Councilmember Bailey moved to Approve a Special Business Event License and Park Use Permits for Moab Rotary April Action Car Show for April 29 to May 1, 2016. Councilmember Knuteson-Boyd seconded the motion. The motion carried 5-0 aye, with City Councilmembers Bailey, Ershadi, Jones, Knuteson-Boyd, Derasary voting aye. Councilmember Bailey moved to approve a Special Business Event License for Creative Solutions Group, d.b.a. Jeep to Conduct a Display Event at 290 South Main Street in the Walker Drug Parking Lot. Councilmember Derasary seconded the motion. The motion carried 5-0 aye, with City Councilmembers Bailey, Ershadi, Jones, Knuteson-Boyd, Derasary voting aye. Councilmember Ershadi moved to approve a Private Property Vendor License for Christine and Kent Green, d.b.a. Moab Cowboy Country Off Road Adventures, Located at 83 South Main Street for a term of February 25, 2016 to February 24, 2017. Councilmember Derasary seconded the motion. The motion carried 5-0 aye, with City Councilmembers Bailey, Ershadi, Jones, Knuteson-Boyd, Derasary voting aye. Councilmember Derasary moved to approve a Confirmation of Mayoral Appointment of Councilmember Jones to the Solid Waste Special Services District #1 to serve a four (4) year term ending December 31, 2019. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye, with City Councilmembers Bailey, Ershadi, Jones, Knuteson- Boyd, Derasary voting aye. Councilmember Bailey moved to approve a Request for Use of City Right- of-way by John Knowles to Conduct a Sidewalk Sale on March 11 —13, 2016 at 50 South Main Street. Councilmember Jones moved to approve moving forward with the First Reading of Proposed Ordinance # 2016-02 — An Ordinance Amending Conditional Uses and Specifically Bed and Breakfasts as found in MMC Chapters 17.09.530 and 17.09.531 as Referred to Council by the Planning Commission, with the changes incorporated. Councilmember Derasary seconded the motion. The motion carried 5-0 aye, with City Councilmembers Bailey, Ershadi, Jones, Knuteson-Boyd, Derasary voting aye. Councilmember Bailey moved to approve Resolution #04-2016 —A Resolution Declaring Certain Property of the City of Moab as Surplus and Donating Said Property (Playground Equipment with Slide) to the Town of Castle Valley. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye, with City Councilmembers Bailey, Ershadi, Jones, Knuteson-Boyd, Derasary voting aye. Councilmember Jones moved to approve Resolution #03-2016 — A Resolution Approving a Petition to Vacate a Boundary Line between Properties Located at 301 S 400 E in the C-5 (Neighborhood Commercial) Zone. Councilmember Derasary seconded the motion. The motion carried 5-0 aye, with City Councilmembers Bailey, Ershadi, Jones, Knuteson-Boyd, Derasary voting aye. Councilmember Bailey moved to table the First Reading and Possible Call for Public Hearing to Consider Ordinance #2016-01— An Ordinance to Amend Chapter 17.45.060, Single-family and Two-family Residential Zone and 17.15.050, Residential Area Regulations, of the Moab Municipal Code Referencing the Size of Residential Single-family Uses and an Application for a Code Amendment to Moab Municipal Code Sections 17.45.060, R-2, One -family and Two-family Residential Zone, and 17.15.050, Residential Area Regulations Reducing the Minimum Size of Dwellings in the R-2 Zone. Councilmember Knuteson-Boyd seconded the motion. The motion failed with Councilmembers Bailey and Knuteson-Boyd voting aye and Councilmembers Ershadi, Jones and Derasary voting nay. Councilmember Derasary reported that she attended the Moab Tourism Expo. She mentioned that the "Mighty Five" State Tourism Campaign is ending and will be replaced with "Road to Mighty". Councilmember Derasary also reported that she attended a World Trade Center of Utah meeting. They are a free resource to businesses in the community. Councilmember Derasary attended the Legislative Policy Committee meeting with Mayor Sakrison. Councilmember Derasary also mentioned that the Solid Waste District SB 196 may possibly charge for paper and plastic bags. Councilmember Ershadi reported that she attended an ASAP meeting at USU. While there, she with Beth McClure regarding Economic Development potential in Moab. Councilmember Jones informed the Council that the Solid Waste District Director did a regional survey on small yard waste loads. The Solid Waste MAYOR AND COUNCIL REPORTS Agenda of 81 District is proceeding with a composting plan and are looking into composting drop of locations. Councilmember Jones reported that the ATV Committee slogan will be "Throttle Down in Town". Councilmembers Jones, Derasary and Knuteson-Boyd attended Grand County Housing Workshop. Mayor Sakrison asked Councilmember Jones to be the City Council Liaison to the Moab City Planning Commission. Councilmember Jones will consider the request. Mayor Sakrison attended the USU Dean's Advisory Committee Meeting. The committee asked if the City would be the sponsor of a CIB Infrastructure Funding Application. Mayor Sakrison stated that the language in House Bill 132 was changed so that the Zoning Authority remains with the City. There was no Correspondence to be Read. Under Administrative Report, City Manager Davidson gave a written report. A Report on City/County Cooperation was not given. Councilmember Derasary moved to pay the bills against the City of Moab in the amount of $198,942.04. Councilmember Bailey seconded the motion. The motion carried 5-0 aye, with City Councilmembers Bailey, Ershadi, Jones, Knuteson-Boyd, Derasary voting aye. Councilmember Jones moved to adjourn the Council Meeting. The event will start at the Holiday Inn Express and finish at Swanny Park. Registration will also happen at the Holiday Inn Express. The requested date for the event is May 14, 2016 with all -day park use. The new start and registration location make things easier for city staff, as there would be no traffic control or noise issues for an early morning start at the park. There are a few conditions that should attach to the permits, as shown on the attached list of conditions. Options: The Council may approve, approve with conditions, deny or postpone the items. Staff Recommendation: Staff recommends Approval of the Special Business Events License and Special Use of Swanny City Park with conditions listed on the attached page. 1 Recommended Motions: (1) "I move to approve the Special Business Event License for Red Rock Relay with the conditions attached to the staff memo." Special Use of Swanny Park and other non -reservation parks within the City is subject to approval by the Moab City Council. The City Council may approve use applications for events that provide clear benefits to the community. Requests for usage by private businesses that serve a limited clientele will not be approved. Bowman, P.E., City Engineer Department: Engineering Background/Summary: The Utah Department of Transportation (UDOT) has prepared the US-191 Corridor Preservation Study (the Study) to evaluate current and future traffic capacity needs, analyze crash data and safety concerns, and provide for the long-term planning of projects through the study area. The Corridor Preservation Study examined approximately 11.4 miles of US-191, starting at milepost (MP) 112.0 near Bridger Jack Mesa Road in San Juan County and ending at MP 123.4 near Sage Drive in Grand County. As shown on the attached graphic, approximately 0.5 miles of the study area is contained within the incorporated limits of the City of Moab. The Study was completed with input from a Technical Advisory Committee (TAC) that was led by UDOT Region 4 and the project consultant, Parametrix. The Committee included representative members from Grand County, San Juan County, City of Moab, School and Institutional Trust Lands Administration (SITLA), the Bureau of Land Management. The City of Moab was represented by the City Engineer and the Public Works Director. The TAC provided significant input on the Study for access management and long- term private development potential along the corridor. One of the main outcomes of the Study is an access consolidation and management strategy that is summarized in the Proposed Corridor Agreement. In addition, the TAC provided input on key intersection improvements and capacity improvements desired along the corridor. It is noted that one of the key intersections analyzed within the study limits is at Mill Creek Drive and US-191, which is located within the incorporated limits of the City of Moab. The Mill Creek Drive intersection has been identified for a full traffic signal in the long-term planning of the corridor. This is consistent with the zoning 1 Agenda 65 of 80 and likely development patterns in the immediate area, which include the future USU-Moab Campus, subdivision and housing development on the adjacent SITLA property, and other mixed -use development projects on parcels along US-191. The First Reading of the Proposed Corridor Agreement is presented at this time for City Council to review the agreement, and to ask questions of City Staff, UDOT Staff, and the project consultant. The Corridor Agreement will be presented for the Second Reading and final approval at the next regular City Council meeting on April 12, 2016. The PARTIES agree that traffic signals will only be installed in accordance with the Signal Control Plan and at those intersections that meet the minimum traffic signal warrants as defined by the most recently adopted Utah Manual on Uniform Traffic Control Devices (MUTCD) and a UDOT field review. The U.S. 191 Corridor Study has identified the location of the possibility of three new signal locations. They are defined below: a. U.S. 191 and Old Spanish Trail Arena (milepost 120.6), Future b. If any term or provision of this CORRIDOR AGREEMENT or application to any person or circumstance shall, to any extent, be invalid or unenforceable, then the remainder of this CORRIDOR AGREEMENT shall not be affected and each term, condition and provision of this CORRIDOR AGREEMENT shall be valid and enforced to the fullest extent permitted by law, so long as removing the severed portion does not materially alter the overall intent of this CORRIDOR AGREEMENT. 9. The failure of a party to insist upon strict performance of any provisions of this CORRIDOR AGREEMENT shall be construed as a waiver for future purposes with respect to any such provision or portion.
