HomeMy Public PortalAboutResolution 2018-39, Accepting Final Plat And Plans Of Woods Estates First Addition - NOT PASSED STILL TABLES NOVEMBER 2018 RESOLUTION NO. 2018-39 A RESOLUTION ACCEPTING THE FINAL PLAT AND PLANS OF THE WOODS ESTATES OF RIVERDALE FIRST ADDITION AS RECOMMENDED BY THE PLANNING & ZONING COMMISSION OF THE CITY OF RIVERDALE WHEREAS, Seth Woods, Seth Woods Construction and Development, Inc. ("Woods"), did by his civil engineer J & M Civil Design LLC, Bettendorf, present a revised version (Revision No. 4, dated 10/18/18) of a Final Plat of Woods Estates of Riverdale First Addition, originally dated October 10, 2018 ("Plat") for review by the City Engineer and City staff, and discussion before the Riverdale Planning & Zoning Commission("Commission"); and, WHEREAS, Woods civil engineer also provided construction plans and specifications for said property, prepared by Bryce A. Johnson, Licensed Professional Engineer, Iowa License 13827 and dated"For Review- 10-08-2018" ("Plans"), which plans and specifications have been reviewed and commented upon by the City Engineer, City Officials and were provided to the members of the Commission for consideration; and, WHEREAS, the City Engineer finds that Plat and Plans for Woods Estates of Riverdale First Addition and related, required documentation including stormwater management plans and calculations, does meet the minimum requirements as set forth in the City Code; and, WHEREAS, The Commission did on October 18, 2018 hold a Public Hearing, properly noticed and advertised per Sections 25.04 and 27.03 of the Riverdale City Code and Chapter 362.3 of the Iowa Code, which was attended by residents and representatives of Woods and also the City of Riverdale ("City"), at which time open discussion was had, public comments made and recommendations heard from City representatives and Woods engineer upon the aforesaid Plat and Plans; and, WHEREAS, at the Commission voted to ; and, WHEREAS, the Commission does acknowledge that City Council approval of the said preliminary plat would allow Woods' engineer and contractors to proceed with the construction of the public improvements as set forth in the Plans of the First Addition and where specified, of the overall subdivision; and, WHEREAS, with the understanding that this approval does not provide authority for the recording of the Plat; that the recording of the Plat is subject to a subsequent agreement between the City and Woods as to the guaranteeing of the construction of the public improvements pursuant to the allowances set forth in Section 40 of the City Subdivision Ordinance, which actions will be considered by the City Council subsequent to passage of this resolution. That the document prepared by Woods' engineer, J &M Civil Design, Inc, Bettendorf, Iowa, being a revised version (Revision No. 4, dated 10/18/18) of a Final Plat of Woods Estates of Riverdale First Addition, originally dated October 10, 2018 is attached to and hereafter is a part of this resolution. Section 2. That the document prepared by Woods' engineer, J & M Civil Design, Inc, Bettendorf, Iowa, being construction plans and specifications for said property, prepared by Bryce A. Johnson, Licensed Professional Engineer, Iowa License 13827 and dated "For Review- 10-08-2018" are attached to and hereafter are a part of this resolution. Section 3. That the Council, upon consideration of the recommendation of the Planning & Zoning Commission, its engineer and staff, and its own review and observations, does accept and approve the Plat and Plans of Woods Estates of Riverdale First Addition.
