HomeMy Public PortalAboutResolution 67-754RESOLUTION NO. 67 -754 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANTING A VARIANCE IN ZONE VARIANCE CASE NO. 67 -222 AND REVERSING THE PLANNING COMMISSION RESOLUTION NO. 67 -257PC IN CONNECTION THEREWITH THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE: SECTION 1. The City Council finds and determines: (a) That the owners of certain real property located in the City of Temple City, County of Los Angeles, State of Cal- ifornia, located 4800 Baldwin Avenue, in said City, more par- ticularly described as Portion of Lot 50, Parcel 16 of F. J. Baldwin Addition, No. 1 to Santa Anita Colony, Book 52, page 60 of Maps in the Office of the County Recorder, County of Los Angeles, State of California, have heretofore filed an appli- cation for a zone variance to remodel an existing service sta- tion building to a restaurant use with substandard parking spaces to wit: 9 feet or less. (b) That the Planning Commission has conducted a duly noticed public hearing on such application; and has heretofore adopted Resolution No. 67 -257PC in connection therewith; (c) That the applicant has duly appealed such decision to the City Council and a public hearing has been held on such appeal; and (d) That based upon the evidence adduced at such hear- ing and the files and staff reports herein, and each member of the City Council being familiar with the site, the City Council determines that the Planning Commission should be reversed and the variance granted for the reasons hereinafter set forth. SECTION 2. The City Council finds and determines: (a) That such lot is unique in that the same has been narrowed to a minimal size by the widening of Baldwin Avenue, and for the further reason that the same now constitutes a sub- standard C -2 lot in the area of its location; said property is further unique in that it contains an abandoned service sta- tion, unable to function as such because of the reduced lot size, and must be converted to some other commercial use. (b) That there now exists a hardship upon the land in that the same is not usable for its present use; the same is zoned C -2 and is entitled to a reasonable commercial usage. (c) That the variance requested in this case is from a minimal requirement, to wit, 9 -foot parking spaces; and the sub - standard or narrow spaces will not be of any detri- ment to the public or to neighboring properties. (d) That such a variance will not be a detriment to the comprehensive plan in that the eleven (11) parking -1- 1114 1 1 1 spaces required by such plan are in fact being provided. SECTION 3. The City Council further finds and determines that the objections of the neighborhood generally relate to the C -2 zoning or traffic conditions rather than to the var- iance applied for; that such objections will not be affected by the reduced parking stalls. SECTION 4. Accordingly, the variance is hereby granted as requested to install parking spaces on such lot each having a width of less than 9 feet, to wit, a minimum of 8 feet 3 inches, subject to the conditions recommended by the staff as follows: a. Provide a minimum of 6 ft. high block wall abutting residential properties; and b. Reduce the height of the wall to 40" for a distance of 15 ft. from the property line on the northerly boundary of the subject property; and c. Except for curb cuts, provide and maintain an open- work wall of 36" to 40" in height on both streets; and d. Provide a 26 ft. wide entrance -exit driveway approach on Baldwin Avenue; and e. Landscape the southwest corner of the property; and f. Provide 6 ft. sidewalks and landscape with sprinkler system the remaining portion of parkways on both Baldwin Ave. and Lower Azusa Road; and g. Remove storage tank and existing signs from the property; and h. Provide a walled -in enclosure at least 5 ft. in height for storage of refuse and refuse containers; and i. Maintain the parking area and the structure in good condition and repairs; and j. Follow building and fire codes and regulations. SECTION 5.
