AUTHORIZING AN AGREEMENT AND APPROVING A PEEFORA{ANCE
GUARANTEE AND WATER AND SEWER EXTENSION PER/MITS FOR THE
WARREN I4~J, SUBDIVISION
RESOLVED by the Council of the Town of Leesburg in Virgin~ as fo]lows:
SECTION I. The Acting Manager shall execute the contract for public improvements for the
improvements shown on the plans approved by the Director of Engineering and Public Works for the
Warren ~ Subdivision.
SECTION II. The extension of murdcipal water and sewer for the Warren Hill Subdivision is
approved in accordance with Sections 15-9 and 19-18 of the Town Code.
SECTION III. The irrevocable bank letter of credit in a form approved by the Town Attorney from
the Farmers and Mechanics National Bank in the amount of $219,200.00 is approved as security to
guarantee installation of the public improvements shown on plans approved by the Director of Engineering
and Public Works for the Warren ~ Subdivision.
SECTION IV. The developer shall mske a cash payment to the town in the amount of $3,200.00
at the time Town Council accepts the completed public improvements for the Warren ~ Subdivision.
Th~s payment represents the value of road improvements not constructed in order to preserve a specimen
tree located along Harrison Street. If the tree dies during the construction per~od the developer shall be
responsible for the tree removal, the construction of the road improvements in the area of the tree, and
no cash payment will be required~
SECTION V. The developer shall be responsible for removal of the tree at his expense if the tree
dies during the one-year mmintenance period.
