HomeMy Public PortalAboutResolution 67-764RESOLUTION NO. 67 -764 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANTING A VARIANCE IN ZONE VARIANCE CASE NO. 67 -224. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council does hereby find, determine and declare as follows: (a) That the owners of certain real property located in the City of Temple City, County of Los Angeles, State of California, located at 5803 North Cloverly Avenue in said City, more particularly described as South 50 feet of lot 708, Tract No. 6561, Book 72, pages 33 -35 of Maps in the Office of the County Recorder, County of Los Angeles, State of California, have heretofore filed an application for a zone variance to allow relocation of existing residential struc- tures on an R -3 zoned lot with less than the required off - street park- ing requirements and a substandard sideyard area; and (b) That the Planning Commission has heretofore adopted Reso- lution 67 -260PC granting said variance, which decision has been duly appealed; and (c) That the City Council conducted a duly noticed public hearing on such appeal; that said hearing was duly closed; and (d) That based upon the evidence adduced at said hearing, the Planning Commission files and applicable staff reports, and each mem- ber of the Council being familiar with the proposed site, said City Council determined that the facts required by Section 1802 of the Temple City Zoning Ordinance were present and therefore the zone variance application should be granted. SECTION 2. That the zone variance application, hereinabove described be and the same is hereby granted subject to the following conditions: (a) That development of the subject property shall be substanti- ally in accord with the plot plan, Exhibit "A ", as modified by the Planning Commission on June 13, 1967, and (b) That all buildings and structures shall observe a 15 -foot rear yard area, that the single family dwelling unit shall observe a 9 -foot sideyard area, and (c) That the applicant shall construct, agree to (and not pro- test) any petition to install sidewalks and a concrete driveway approach on Workman Avenue by assessment district in accordance with specifications of the Public Works Department, and (d) The applicant shall provide tree wells and plant street trees on both Workman Avenue and Cloverly Avenue as re- quested by the Public Works Department, and (e) That the buidings to be located upon subject property shall be reconstructed as necessary to remove hazards as provided by city ordinances, such "hazards" to be elimi- nated as determined by the Building Inspector, subject to appeal to the Council, and (f) That this variance shall expire and be of no effect unless exercised within a period of one year from and after the date of adoption of this resolution, and 1129 Resolution No. 67 -764 Page 2 (g) Applicant shall file, or cause to be filed, with the City Clerk a document which the City may record, which shall acknowledge that the owner of the Subject Property is aware of and accepts the conditions set forth in paragraphs (a) through (e) above, and that the Subject Property, regard- less of any change in ownership, is bound by and subject to the provisions of this Resolution and the conditions contained herein. SECTION 3, The City Clerk shall certify to the adoption of this Resolution. ADOPTED AND APPROVED this 18th day of July, 1967.
