City Attorney Martin presented Ordinance No. 65 -151 and read title

City Attorney Martin presented Ordinance No. 65 -153 and read title

Dickason seconded, and the notion was carried unanimously.
City Attorney Martin recommended this Ordinance be referred to the

8. ORDINANCE NO. 65 -152: Amending Municipal Code relating to locatio!
of Council Chambers, City Offices, & Council Meetings. 2nd read.
City Attorney Martin read title to Jrdinance No. 65 -152: AN OR-
DINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 2700, 2701,
AND 2703 OF THE TEMPLE CITY MUi'! I C I � .L CODE. Councilman Tyrell
moved to waive further reading, Councilman Nunamaker seconded,
motion carried. Councilman Tyrell moved to adopt Ordinance No.
65 -152, Councilman Merritt seconded, motion carried unanimously.
PUBLIC HEARING - CONTINUED: 7:30 P. M. VEHICLE PARKING DISTRICT NO. 1
ASSESSMENT HEARING:
Mayor Harker announced the hour of 7:30 o'clock P. M. having ar-
rIVed, this is the time and place fixed for the continued bearing
on the assessment filed in the matter of Vehicle ?arking District
No. 1 of the City of Temple City.
City Clerk'Woollett advised he had received no further correspon-
dence with respect to this parking district since April 29.
City Attorney Martin swore in Assessment Engineer Krelle who sub-
mitted to the Council the recalculated assessments as requested b
the Council at the hearing on April 29, and stated he is prepared
to answer questions of the Council or persons in the audience.
Atty. Kramer asked Mr. Krelle if at the conclusion of the last
hearing on April 29 if the Council directed him to prepare a
list of suggested changes as indicated by the City Council to
which he replied "yes ", and Atty. Kramer asked Mr. Krelle to read
off this new list of assessments proposed. Mr. Krelle read the
list showing the changes in accordance with re- spreading the
assessment as requested by the Council. Councilman Nunamaker ask
ed for the average assessment raise on main two zones and Mr.
Krelle advised on parcels 2 to 27, the 100% zone, on a 25 ft. lot
the increase was approximately $150., parcels 23 to 35, the 75%
zone on a 25 ft. lot the increase was approximately $114., and he
proceeded to show on the map for the benefit of the audience which
areas he was speaking of. Mr. Krelle explained the properties on
the southerly line of the District on Temple City Blvd. the
assessment was cut on the northerly lots, 7 on the east side and
eight on the west side. This amount was respread in accordance
with the assessments to the properties on Las Tunas Dr. between
Cloverly and Kauffman.
Mayor Harker asked if anyone present desired to be heard in con-
nection with this assessment.
R. D. Sweeney, Attorney, 615 S. Flower St., Los Angeles, stated
he represented parcels 12, 18 and 27, protested my behalf of his
clients to the new proposed spread, and stated if nothing was
done at the hearing on April 29, that nothing could be done at
this meeting.
Geo. Evans, 9514 Las Tunas Dr.,protested the new proposed spread
as unjust and unequal assessment of property owners.
John L. Shaw, 5816 Temple City Blvd., spoke regarding his protest
of the original assessment in favor of the proposed assessment
submitted tonicht.
John Asder, 310 ' ^f. Foothill Blvd., Arcadia, was not in favor of
assessment as he states he provides ample parking for his buildin:
Lloyd 'falters, 5828 -50182 Temple City Blvd., stated he was not in
favor of the assessment spread as read tonight.
Jennie Beckwith, 5827 -5329 Temple City Blvd., stated if this is
the best the City Council can do s :ie will go along with it but
had hoped for a larger reduction.

the statement the City is standing some expense and asked that

City Manager Woollett explained the City wi ?1 contribute some
$47,000. to the districts when completed, and ;additionally the
City has agreed to pay for the maintenance. The estimated cost
to the City is the same as the original costs of the districts,
The $47,000. is what we compute to be the difference between the
parking lots and what the mall would be
Henry Walters, 9560 Las Tunas Dr., stated property owners on
Temple City Blvd. have been making quite a thing of benefits to
be derived by the owners on Las Tunas Dr. Also that it was his
impression that Mr. Krelle felt the original spread fair and was
not in favor of making a change. Mr. Krelle stated the Council
has the authority to change the spread in any way they see fit
and he did what the Council instructed him to do.
'1. J. Sheffler, L.731 Angeles Vista Blvd., Los Angeles, stated Mr.
Krelle stated on the spread he presented April 29 that he thought
it was fair and equitable. Councilman Nunamaker advised he made
the motion to have the engineer present a new spread to scale the
spread on Temple City Blvd., and Councilman Merritt stated the
Council was in general agreement to this except for Councilman
Dickason who was not present at the meting. Councilman Tyrell
stated this new spread would not make any significant change to
any property particularly over a 20 year period.
R. D. Sweeney, Atty., 615 So. Flower St., Los Angeles, stated thi:
new spread was not equitable, and that they were willing to.go
along with Mr. Krelle on the original distribution. He also stat•
ed it appeared to him that under certain facts of the State High-
way Code the Council could modify or alter the assessment but
that they cannot do so at an adjourned' meeting without another
notice as the amount is to be changed. if the assessment is
changed tonight you are making a re- assessment.
Henry Walters, 9560 Las Tunas Dr., asked if the City paid Mr.
Krelle for his survey in arriving at this assessment, and if so
by changing it if the City did not feel he was capable of doing
the work he is assigned to do. City Attorney Martin requested
Attorney Kramer to clear the two legal points raised.
Attorney Kramer advised that with regard to the assessment phase
of the proceeding, the 1943 Act incorporates the provisions of
the Street Cpenine Act of 1903. The 1503 Act provides for the
manner of giving notice and the holding of a hearing. At the con-
clusion of the hearing., the City Council may confirm the assess-
ment as presented, or may order modifications and confirm the
assessment as modified. The hearing may be continued from time tc
time, but there is no legal requirement to mail new notices of
each continuance. The procedure differs from a proceeding to ore
er changes in the boundaries of the district or changes in the ac=
quisition or improvement, which proceeding does require separate
notices and a separate hearing. Such changes are not involved in
this proceeding tonight.
dith regard to the role of the Assessment Engineer, Mr. Kramer ad.
vised that the Engineer had the duty, under the direction of the
Superintendent of Streets, to prepare an assessment spread and to
present it to the Council at the time of the hearing. The ulti-
mate decision as to whether the proposed spread is fair and in
proportion to the benefits to be received rests with the Council,
';while the Council should normally give considerable weight to the
expert testimony of the Engineer and the Street Superintendent,
it must also consider protests from the property owners and other
evidence presented at the hearing. This is the whole purpose of
holding a hearing.
Mr. Kramer also stated that the Council could have, if it so de-
sired, ordered the proposed modifications at its last meeting and
confirmed the assessment as modified. However, the Council wished
to give the matter further consideration and to permit the proper-
ty owners, especially those on Las Tunas, a further opportunity to
be heard. At the conclusion of tonicht's hearin:!, the Council may

Councilman Merritt stated in regard to spreading the assessment
he felt those Farther away should be less and for this reason he
would be in favor of the modification of the assessment spread.
Councilman Tyreil stated he was initially interested in a reduc-
tion of assessment on Temple City Blvd. as they already have con-
siderable parking. Also on Temple City Blvd, they cannot build
out to cover the entire lot which will be allowed on Las Tunas
Dr. with this new parking available. He felt the assessment as
modified is proper as long as we are going to have a parking dis-
trict. The Cityls contribution, which is tax dollars returned to
the area, is equivalent and in excess of the land owners contri-
bution. They will have more valuable property and more valuable
leases. The modifications should be approved and set by the
Council.
Councilman Nunamaker agreed with these two Councilmen. The value
received on Las Tunas Dr. is much greater than those on Temple
City Blvd. He is in favor kf this change in assessment.
Mayor Harker felt there is considerable difference between the
nature of business on Temple City Blvd, and on Las Tunas Dr. and
in recognition of this he felt the chances the Council has con -
sidered are equitable.
Councilman Nunamaker made the motion to adopt Resolution No. 65-
.65 A RESOLUTION OF THE CITY COUNCIL CF THE CITY OF TEMPLE CITY,
CALIFORNIA, ORDERING CERTAIN MODIFICATIONS AND CORRECTIONS IM THE
ASSESSMENT IN THE M!TTER OF VEHICLE PARKING DISTRiCT NO. 1 OF
SAID CITY, Councilman Merritt seconded, roll call vote to carry
as follows:
AYES: Councilmen- Merritt, Nunamaker, Tyrell, Harker
NOES: Councilmen -Hone
ABSENT: Councilmen-None
ABSTAINING: Councilman - Dickason
City Attorney Martin stated there would be a recess until the dia
gram could be corrected by the Assessment Engineer Krelle. Mayor
Harker so ordered, Council recessed at :40 P. M.
:50 P. M. Mayor Harker declared the Council re- convened.
\ssessment Engineer Krelle stated the modifications had been made
in accordance with the figures previously read to the Council.
City Attorney Martin stated Mr. Krelle had presented the correct-
ed diagram and it was ready for adoption.
Councilman Tyrell moved that all protests and objections, both
written and oral, made or filed in connection with the assessment
filed in the matter of Vehicle Parking District No. 1 be and the
same hereby are overruled and denied, except to the extent allow-
ed by the changes heretofore ordered, Councilman Nunamaker secor
ed, motion carried by the following roll call vote:

City Attorney Martin stated this completes the matter on Vehicle
Parking District No. 1 and the assessments have been confirmed as
modified.
PUBLIC HEARING: 7 :30 P. M. SIDEWALK CONSTRUCTION: Double Drive, west
side, Grand to Daines. Mayor Harker declared the public hearing
opened. Asst. City Manager koski stated pursuant to the petition
received the City has caused sidewalks to be constructed as per

the plans, the work is completed, and the assessment proposed is
for the work accomplished. He read the following, proposed assess

He stated these are computed at a cost of $1.54 per lineal foot
of sidewalk.
City Attorney Martin stated there were two matters only that were
germane, if properly installed and whether assessment is fair and
reasonable and commensurate for work that was done.
Mayor Harker asked if anyone wished to speak in favor or against
this assessment. No one came forward to speak.
Councilman Tyrell moved to close the public hearing, Councilman
Merritt seconded, carried by unanimous roll call vote.

Mayor Harker declared the public hearing open and asked if anyone
wished to speak in favor or against these assessments and no one
came forward to speak. Councilman Merritt moved to close the

assessments proposed and direct that property be so assessed,

City Manager':�:'oollett recommended the Council either set this for
decision at the next meeting May 12,, or consider adoption of an
ordinance which would allow you to hold a public hearing. City
Attorney Martin recommended adoption of an ordinance amending the
Municipal Code relating to appeals from the Planning Commission
to the City Council. Following discussion Councilman Tyrell movec
to set a hearing on this appeal for June 1 at 7:30 P. M., Council-
man Merritt seconded, motion carried unanimously.

15. ASSESSMENT HEARING FOR CURB & GUTTER CONSTRUCTION: a. east side
of Agnes, Olive to Howland, and b. east side of Temple City Blvc,
La Rosa to Sparklett.
The City Manager recommended an assessment hearing be set for May
18, 1965, at 7:30 P. M., Councilman Tyrell so moved, Councilman
Nunamaker seconded, and the motion was carried.

City Manager ,!`oollett reported on the recommendation of the Plana

Councilman Tyrell asked if an executive session was necessary con
cerning litigation and the City Attorney advised he had made a
recommendation that this be dropped concerning Brentwood Landscap
Co. Councilman Tyrell so moved, Councilman Dickason seconded,
carried by the following roll call vote:

Councilman Tyrell asked about the water problem and the City
Attorney stated he had taken defaults and in two weeks should be
able to report. (This concerns the south end of Kauffman Avenues
City Manager `.`oollett presented the final map for Tract #29673,
the Sawyer Tract, For consideration, and which map is ready for
recordation as all attached conditions have been complied with.
He recommended the Council approve the map, accept streets and
easements as offered for dedication on said map, approve and
accept work agreements and bonds after approval by the City Attor
ney, for installation of sanitary sewers with faithful performanc:
bond of $2800.00 and labor and materials bond for $1400.00, and
also an agreement guaranteeing settinc of survey monuments, tie
points & furnishinc tie notes and a Faithful performance bond of
$750.00. Also make a finding that Baldwin Builders, subdividers,
have in good Faith attempted to secure the signature of the East
Pasadena Water Co., easement holder, and has been unable to do so
and arrefusal to accept the map for recording would work an undue
hardship on the subdivider. Councilman Merritt moved to approve
the recommendations of the City Engineer with conditions as out-
lined, Councilman Nunamaker seconded, carried by roll call vote
as follows:

Mayor Harker presented a request to proclaim May as "Senior Citi-
zens Month ". Councilman Tyrell so moved, Councilman Merritt se-
conded, the motion was unanimously carried.
Mayor Harker presented a request relating to proclaiminc; United
Nations Day on October 24. Councilman Nunamaker so moved, Coun-
cilman Dickason seconded, roll call vote to carry as follows:

NOES: Councilmen- Merritt, Tyrell
ABSENT: Councilmen -None
City Attorney Martin advised the Council they should authorize
the City Manacer to file proposed anne;cation No. 8 with the Local
Agency Formation Commission. Councilman Nunamaker so moved, Coun
Gilman Merritt seconded, and the motion was unanimously carried.
The City Manager presented two proposed annexations from the Los
Angeles County Boundary Commission, #254., City of Rosemead, and
#35, City of San Gabriel. Councilman Tyrell moved to receive and
file, Councilman Merritt seconded, motion unanimously carried.

Councilman Tyrell moved to adjourn to May 11, at 8:00 P. M. in
the Council Chambers, seconded and carried. Council adjourned
