HomeMy Public PortalAboutResolutions-2010-29CITY OF TIFFIN RESOLUTION NO. 2010-29 A Resolution Releasing any Lien or Cloud Upon Title For All Lots Including Lot 31, Arising From the Developers Agreement for Woodfield. Ridge Part One, Except For Sidewalks Requirements WHEREAS, the City of Tiffin entered into a Sub -divider's Agreement for Woodfield Ridge Part One (Revised June 2007) with Woodfield Ridge, L.L.C. the developer dated June 20, 2007, recorded in Book 4184, Page 265-304, records of the Recorder of Johnson County, Iowa. WHEREAS, the City Council of Tiffin passed and approved a resolution 2008-23 on the 10th day of September 2008 releasing any lien or cloud upon title for all lots except Lot 31, arising from the Developers Agreement and said resolution was recorded afthe Johnson County, Iowa Recorder in book 4350 and page 67-70. WHEREAS, Developer has sold and a signal family residence has been constructed on Lot #31. WHEREAS, Developer has compiled with the terms of the Sub -divider's Agreement with City except as sidewalk requirements and except as to the terms under Section 5 of the Agreement concerning -payment to the City for park equipment and designation of park land. The City desires to release all lots from any lien or cloud of title including Lot #31 from the terms under Section 5 of the Agreement. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Tiffin, Iowa, that the City releases Woodfield Ridge, L.L.C. from any lien or cloud upon the title placed arising from the Sub- dividers Agreement recorded in Book 4184, Page 265-304 and amended in Book 4350, Pages 67-70, including Lot #31 of Woodfield Ridge, Part One, Tiffin, Johnson County, Iowa. On the 9th day of June, 2010, at a regular meeting oof the Tiffin City Council, Tiffin, Iowa Councilperson Jim Bartels introduced A Resolution 2010-29 Releasing any Lien or Cloud Upon Title For All Lots Including Lot 31, Arising From the Developers Agreement for Woodfield Ridge Part One, Except For Sidewalks Requirements and made a motion for approval. The motion was seconded by Councilperson Mike Gericke. Ayes: Jim Bartels, Mike Gericke, Travis Weipert Nay:None Absent: Chris Ball, Mark Petersen WHEREUPON, Mayor Phillips declared that Resolution 2010-29 be adopted and signified his approval of the same by affixing his signature thereto.
