Check our website for updates at: www.moabcity.org Agenda Page 6 of 107 MOAB CITY COUNCIL REGULAR MEETING January 13, 2015 The Moab City Council held its Regular Meeting on the above date in the Council Chambers at the Moab City Center, located at 217 East Center Street, Moab, Utah. Mayor David L. Sakrison called the Pre -Council Workshop to order at 6:30 PM. In attendance were Councilmembers Heila Ershadi, Gregg Stucki, Kyle Bailey, Doug McElhaney and Kirstin Peterson. Also in attendance were City Manager Donna Metzler, City Recorder/Assistant City Manager Rachel Stenta, City Treasurer Jennie Ross, Assistant City Engineer Eric Johanson, Police Chief Mike Navarre, Public Works Director Jeff Foster and Community Development Director David Olsen. Mayor Sakrison called the Regular City Council Meeting to order at 7:00 PM and led the pledge of allegiance. Twenty-four (24) members of the audience and media were present. Councilmember Peterson moved to approve the Regular Council Meeting Minutes of November 25, December 5 and 9, 2014. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye. Under Citizens to Be Heard, Sharon Relph spoke on behalf of Four Corners Behavioral Health. Ms. Relph thanks the council for supporting the building of affordable housing three years ago and stated that the housing had opened in December and they were able to move two homeless individuals into the new housing. Ms. Relph extended her appreciation to the City for all of their help. A Community Development Department Update was not given. Under Engineering Department Update, Assistant City Engineer Johanson reported that the 500 West Road Reconstruction bids had been opened by the Utah Department of Transportation (UDOT) and that the Lions Park Project bid was about to be advertised. Assistant City Engineer Johanson also stated that the engineering firm of Hansen Allen and Luce were preparing the Storm Drain Master Plan and that there had been a lot of development review in progress. Under Planning Department Update, City Planner Reinhart stated that staff was still working on the Planned Affordable Development January 13, 2015 REGULAR MEETING & ATTENDANCE PRE -COUNCIL WORKSHOP REGULAR MEETING CALLED TO ORDER APPROVAL OF MINUTES CITIZENS TO BE HEARD COMMUNITY DEVELOPMENT UPDATE ENGINEERING UPDATE PLANNING UPDATE Agenda Page 1 of 4 Page 7 of 107 ordinance to include incentives to developers as well as working on the General Plan. City Planner Reinhart stated that applications had been approved for two hotels on Main Street and that Beehive homes had submitted an application for an assisted care facility. A Police Department Update was not given. Under Public Works Department Update, Public Works Director Foster stated that there had been a 500 West waterline break but that service had been restored. Public Works Director Foster then said that there would be a change order for the 500 West Waterline project but that the project was moving along quite well. Public Works Director Foster continued that Questar gas had completed their final walkthrough and that the Center Street Gym Roof specifications were coming together. Mayor Sakrison presented Brighton Torgerson with the Mayor's Student Citizenship of the Month Award for December 2014 for Helen M. Knight School. A presentation was made by Bo Call of the Department of Air Quality Regarding the Results of the Ozone Monitoring and Current Particulate Monitoring. Discussion followed. Councilmember McElhaney moved to approve a Class II Retail Beer License for Zachary Daniel Bynum, d.b.a. The Spoke LLC Located at 5 North Main Street to Conduct a Restaurant. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve Local Consent of a Full -Service Restaurant Liquor License for Zachary Daniel Bynum, d.b.a. The Spoke LLC Located at 5 North Main Street. Councilmember McElhaney seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve Local Consent of a Limited - Service Restaurant Liquor License for Devran Cengiz, d.b.a. Devran's Mediterranean Restaurant Located at 60 North 100 West. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye. Councilmember Ershadi moved to Award the City Prosecutor Services Proposal to the law firm of Cowdell and Wooley. Stenta for the Position of Interim City Manager. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve Proposed Resolution #01- 2015 — A Resolution Encouraging the State of Utah to Pursue a Comprehensive Transportation Funding Strategy. Councilmember McElhaney seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to Send Proposed Ordinance #2015-01 — An Ordinance Amending the City of Moab Classified Hourly Pay Rate Schedule and Exempt and Elected Officials' Salaries to Public Hearing. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Stucki moved to approve Proposed Resolution #03-2015 — A Resolution Approving an Agreement between the City of Moab and Public Employees Health Plan for the Provision of Health Insurance Services. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye. There was no Correspondence to be Read. Under Mayor And Council Reports, Councilmember Ershadi stated that she had attended a Conservation District Workshop and had found it very interesting. Mayor Sakrison read a letter from Moab Half Marathon Inc. regarding a donation of $1,000 to the City of Moab. Under Administrative Report, City Manager Metzler stated that the annual Visioning Workshop would be held on February 5 and 6, 2015 and that she and City Recorder/Assistant City Manager Stenta were working on a City Manager Transition Plan. Under Report on City/County Cooperation, Mayor Sakrison stated that he would contact County Council Chair Liz Tubbs to schedule a joint City/County Council meeting. Councilmember Bailey moved to pay the bills against the City of Moab in the amount of $440,082.34. Councilmember Stucki seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Peterson moved to Enter an Executive Session to Discuss Pending or Reasonably Imminent Litigation. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember McElhaney recused himself and left the meeting at 8:02 PM. An Executive Session was entered at 8:02 PM. Councilmember Stucki moved to close the Executive Session. The special event, park and beer permit fees provide revenue to the city, as does the sales tax generated by the purchase of goods and services by the participants of the event. Staff Presenter(s): Danielle Guerrero, Deputy Recorder Department: Recorder Applicant: Aaron McConnel/TransRockies US LP Background/Summary: Aaron McConnell/TransRockies US LP has submitted all of the required applications to hold the Moab Rocks Mountain Bike Stage Race and Social, utilizing Swanny City Park, the Moab Recreation and Aquatic Center and the City right-of-way. The applicant has coordinated with other local government entities as well as the Utah Department of Transportation and the Bureau of Land Management. The applicant has also submitted a comprehensive Proposal and Management Plan. Please note that several of the required/permits are contingent upon other approvals. The following approvals are needed: 1. Approval of a Special Business Event License 2. Approval of a Class IV Special Event Beer License 3. Approval of a Park Use Permit for Swanny City Park 4. Conditional Approval of a Park Alcohol Permit for Swanny City Park 5. Approval of Local Consent for a state -issued Special Event Beer Permit The City Special Events Committee has reviewed the applications for the required permits and licenses for the Aaron McConnell/TransRockies US LP. We have conferred with the coordinator for the event and are of the opinion that all issues have been or will be adequately dealt with. Approval of the Park Alcohol Permit should be conditioned upon securing state approval of the Special Event Beer Permit and submitting said permit and documentation to the City. 1 Agenda Page 11 of 107 Options: For each item, the Council may approve, approve with conditions, deny or postpone the item. Staff Recommendation: Staff recommend approval of all items with the following conditions: 1. Event staff should coordinate with the Parks Superintendant and Safety Officer on location of the Porta-potties. Porta-potties shall not be located on the grass. 2. All park fees need to be paid at least two weeks prior to the event. 3. Approval of the Park Alcohol Permit should be conditioned upon securing State of Utah approval of the Special Event Beer Permit and submitting said permit and documentation to the City. 4. This element is of the utmost importance, both from a safety perspective and to ensure optimal enjoyment for our participants. MARKING ELEMENTS Marking consists of a combination of elements on course including Flagging tape, wire pinflags, and coroplast arrows. Flagging tape is used on bushes and trees to mark turns, rape is placed before the turn to warn the rider of an upcoming junction, and after the turn as affirmation that they are on the right course. it is also used as verification for participants on long sections of the course where there are no intersections. Arrows are placed at potentially confusing intersections to ensure that participants make the correct turn and stay on the correct course. These are useful as some people occasionally miss the flagging marks. They are square foldable coroplast printed arrows that can be weighted to the ground with rocks placed under the signage, Coroplast arrows stapled to wooden survey stakes may also be used, however this may be challenging given the known ground cover in the Moab area. Pinflags may be used when wooden stakes do not work Coroplast signage will also be used to mark the start and finish of each Enduro Stage (timed descent). TransRockies U5 LP 14405 W. This includes course marshals where indicated, and specific action in the highlighted areas below. STAGE 1 HWY 191 CROSSING & SAND FLATS ROAD There is a Highway crossing at the start of this stage that will need to be controlled as per UDOT Right Of Way regulations. We will use the same format as stage 1 with a lead out for the first 3 miles, safely getting them outside the city. Race in Progress signs will also be placed along the roadway at strategic points to alert road users of the event in progress. STAGE 2 1 KLON ❑IKE "Race in Progress" signage will be needed on road to alert road users to an event in progress. Riders will be crossing the road at a number of points during this stage. The public hearing was held at the last Council meeting and no public comment was received. I've attached a summary of all budget adjustments with explanations. As previously mentioned, there are very few items that need to be included in the budget opening, affecting only the General Fund, the Recreation Fund and the Community Devleopment Fund. In the General Fund, we received several state grants for the Police Department in the amount of $24,498, so both revenues and expenditures should be adjusted by this amount. We also received two other donations —one for the Spyhop youth video/film program in the amount of $750, and one from the Beehive Community Grant in the amount of $1,000. Accordingly, the Film Commission budget shows and increase of $750 for the program, and there is a new line line item called Mayor's Grants to be used for disbursal of the Beehive Grant. Most other changes in the General Fund have to do with the increased cost associated with switching our health care insurance provider. Luckily, these additional costs may be covered by interdepartmental transfers and increased revenue. For the Recreation Department, the changes reflect the addition of the Dodgeball program in the amount of $400. The Community Development fund shows a decrease, due to having spent several items in last year's budget year that had been carried over to the current year budget. One item of note that was not previously mentioned was the adjustment to the Administrative budget of $37,120 in the Salaries and Wages line item. This increase is necessitated for the unbudgeted leave time cashout for the departing City Manager. The adjustment is being covered by a decrease in expenses in the Planning Department Professional and Technical Services for funds previously budgeted for a code update/GIS Services ($30,000), as well as revenue from the auction of surplus city property. Hydrology task order prepared by Hansen, Allen and Luce Engineers is needed to determine a proposed storm drain pipe size that the Red Rock Partners developers of the proposed Hoo Doo motel on 100 W (between Williams Way and Walnut Ln.) have agreed to install as part of their project. The pipe will connect to the new storm drain installed in 2010 at the east end of the hospital and run east in Walnut Ln. to 100 W. This will replace a severely undersized 12" pipe that was installed around 1950. Because of this deficient size, runoff from downtown that is already in pipes is forced to exit the pipes through a catch basin at 200 N and 100 W. This flow then goes north to Swanny City Park and further adds to the sometime severe flow in 400 N. Having this new pipe installed in Walnut Ln will thus get the downtown runoff for small to medium storm events to Mill Creek by a more direct underground route that minimizes liability caused by floods. Shortcutting the 400 N flow was originally envisioned by our previous City engineer, Dan Stenta. 1 Options: The construction cost will be the developer's. The City only has to provide the pipe size in coordination with our future storm drain master plan, which will probably be done next fiscal year by Hansen, Allen and Luce engineers. Some of the tiles were breaking and separating from the pool walls. Our pools were manufactured and installed by Myrtha Pools and CEM Aquatics and they were both contacted when the failure was first noticed. The initial tile and installation warranty had expired at the time the tiles had failed. Myrtha and CEM are very willing to work with the City to fix our tiles to maintain a good relationship with us and to help us maintain our pools for our customers. To that end, they have proposed a partial warranty intervention to fix the issues. Myrtha and CEM will cover the cost of the materials, estimated to be just under $25,000 and cover $30,000 of the labor costs, leaving a shared cost to the City of $28,000 — a not to exceed amount for the residual labor. Both Myrtha and CEM are not obligated to warranty this issue, but have chosen to do so for the reasons stated above. They have been responsive and professional in helping our staff to fix the issues to maintain our pools at the highest standards possible. This amount is over our purchasing limits and will require an exception to our purchasing policies. The manufacturer's material warranty on tile is one year and excludes labor. However, in addition to paying for the replacement merials, we can also offer to subsidize the cost of the labor for the replacement to minimize the impact to the City. The scope of the originally commissioned Sewer Impact Fee study included the Waste Water Treatment Plant only. This approval will include the entire conveyance system and identify critical components allowing for short term prioritization. Horrocks Engineering has also recently completed the Water Impact Fee Study which provides substantial background data that is applicable to this project as well. The salary to be paid to Davidson for her services as City Manager shall be One Hundred Fifteen Thousand dollars ($115,000.00) annually ("Base Salary"), which shall be paid periodically in the same manner as other employees of the City are paid. The City shall provide Davidson with an automobile for her use during her term of employment. The City shall be responsible for providing reasonably acceptable levels of insurance for Davidson's operation of the vehicle including liability coverage insuring Ms. Davidson for her operation of the vehicle. The City shall be responsible for maintaining and fueling the vehicle. The vehicle shall be used primarily by Davidson for the performance of her job duties; provided that she may take the car home during and use it for personal errands and business to a reasonable extent. By way of example and not limitation, Davidson may take the vehicle to the market or to private appointments during the course of her normal day, but Ms. Davidson may not take drive the vehicle on vacations out of the City or other similar extended personal trot h. Other. Davidson shall be entitled t an leave or financial benefits provided to other employees on an equal ba ontained in the City Personnel Manual as it may be amended from time -to -time. 5. Severance. a. Except as otherwise provided in this Section, if Davidson is terminated by the City Council during such time that Davidson is willing and able to perform the duties of the City Manager, the City agrees to pay Davidson a lump -sum severance payment equal to the greater of. the amount of her Base Salary remaining to be paid to her during the remaindSiWe term of this Agreement; or an amount equal to nine (9) months of the Base Sa ary eing paid to DavidsgVby the City at the time of termination. The severance payment described herein shall be a one-time payment and is not intended to be an extension of employment. Nothing in this Subsection (a) is intended to alter Davidson' lea is under e mily Medical Leave Act. b. If avidson terminated based on her conviction for a misdemeanor offense involving an act of violence against another person, fraud or a financial crime, or for any felony, the City has no obligation to pay the severance payment. C. avidson voluntarily resigns her position, as City Manager or Davidson is unwilling perform her job duties, Davidson shall not be entitled to the severance payment. d. At Davidson's option, her employment shall be deemed to have been terminated and she shall be entitled to severance as set forth in this Section 5 if any of the following events occur: i. The City fails to provide Davidson with a benefit set forth herein, after the City's receipt of written notice from Davidson of such failure and a reasonable time to cure. 6. Hours of Work. It is recognized that the City Manager must devote a great deal of her time outside normal office hours to the business of the City. Davidson shall be considered an exempt employee for purposes of the Fair Labor Standards Act, and shall not be entitled to overtime. 7. Professional Development. Subject to such amounts as ma be budgeted, the City, in its sole discretion, shall pay for expenses related to Davidson' continuing professional development, which includes attendance at various national or state conferences, seminars, and continuing education programs. The City shall reimburse Davidson' expenses for other reasonable memberships, registration, travel, meals or lodgingNn association with business - related conferences, education or other meetings, accor ' g to approved accounts in eh annual budget. r i 8. Performance Evaluations. Within thirty o he Effective Date, the City Council shall provide Davidson with a written docu etting forth the goals for Ms. Davidson, their priorities, and other relevant expectations fo first year as the City Manager (the "Goals and Expectations Document"). Within six (6) months of the Effective Date, the City Council shall provide Davidson with a performance evaluation, which shall include a review of how well Ms. Davidson is performing in rel 'on to the Goals and Expectations Document. Ms. Davidson shall be eligible for a ten percen 10 increase to her Base Salary based on the results of her performance evaluation, whi shall become effective as of the six-month anniversary of the Effective Date4ahereafter, t Council shall provide Davidson with a written performance evaluation at least once every twelve,#12) months on or before the twelve (12) month anniversary of the Effective Date. Davidson shall file a timely written response to each performance evaluation. Following such response, the Council and Davidson shall meet to discuss the nerf"amauce evaluation. 9. Indemn on. Davidson shall be defended and indemnified by the City for all actions or inactions unde n by her in her official capacity as the City Manager. 10. Bonding. T City shall bear the full cost of any fidelity or other bonds required of the City Manager under e law. 11. Miscellaneous. a. Governing Law and Venue. This Agreement shall be governed by the laws of the State of Utah. b. No Waiver. Delays in enforcement or the waiver of any one or more defaults or breaches of this Agreement by either party shall not constitute a waiver of any of the other terms or obligation of this Agreement. C. Integration. Third Parties. There are no intended third -party beneficiaries to this Agreement. e. Severability. If any provision of this Agreement is found by a court of competent jurisdiction to be unlawful or unenforceable for any reason, the remaining provisions hereof shall remain in full force and effect, and the severed provision shall be redrafted in such a manner so as to be lawful and enforceable and to effectuate the intent of the parties in the original provision. f. Modification. This Agreement may only be modified upon written agreement of the parties. g. Assignment.
