PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR QUINN Vice President Miller presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Absent was Bruce Wissel. Also present were: Hon. Sally Hutton, Mayor; Police Chief Kris Wolski; City Attorney Walt Chidester; City Controller Tammy Glenn; Director of Metropolitan Development Tony Foster; City Clerk Karen Chasteen; Superintendent of Parks and Recreation Bill Thistlethwaite; Majors Bob Hobson and Mark Connery, Richmond Police Department; Sanitary District Superintendent Sam Lahanis; Assistant City Attorney Kim Vessels; Blair Beach of Parks and Recreation; Monica Burns, Deputy City Clerk; Tim McClain of Osborn Industries; Kelly Hale, Realtor; Jerry Day and Kim and Dave Dorston of Richmond. APPROVAL OF MINUTES Councilor Pappin moved to approve the minutes of the meeting of August 17, 2009 and Memorandum of Proceedings for the Committee of the Whole August 25 & 26, 2009, supported by Councilor Parker. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS RESOLUTION NO. 7 -2009 — LOCAL RESOLUTION APPROVING THE COMMUNITY DEVELOPMENT BLOCK GRANT FUNDED PARKS & RECREATION MASTER PLAN Mr. Welch moved to adopt Resolution No. 7 -2009, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. RESOLUTION NO. 8 -2009 — A RESOLUTION AUTHORIZING THE MAYOR TO SIGN A DESIGNATION OF WAYNE COUNTY AS RECIPIENT OF ONE -HALF OF A FRACTIONAL AMOUNT OF CERTIFIED DISTRIBUTION OF ECONOMIC DEVELOPMENT INCOME TAX FUNDS Mr. Welch moved to adopt Resolution No. 8 -2009, supported by Mr. Parker. Upon a vote viva voce, the motion passed. RESOLUTION NO. 9 -2009 — AUTHORIZING THE ACCEPTANCE OF DONATION OF COMBAT MATERIAL Presented by Ms. Vessels, this Resolution would authorize the City of Richmond to receive a Huey Helicopter to be put on display in the Veteran's Memorial Park. Mr. Welch moved to adopt Resolution No. 9 -2009, supported by Ms. Pappin. Upon a vote viva voce, the motion passed. Common Council Minutes September 8, 2009 Page 2 of 5 PLAYFUL CITY DESIGNATION — Ms. Beach outlined the Playful City Designation for the City of Richmond. There is a direct line between play deficiencies and childhood obesity, childhood depression, the inability to interact with peers, etc. The Playful City task force is committee to "play." Kids who play more make well adjusted adults. The Kaboom organization designated Richmond a Playful City in July, 2009. There are 50 play spaces in Richmond. COMMUNICATION FROM THE MAYOR ■ There is also a plan for adults to enjoy Richmond Park activities ■ The Fall Festival will be held September 11 and 12 with the KidsFest Parade, activities on the Starr Gennett site, Dowtown Richmond, the Depot District and the Wayne County Museum. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the August 20 & 27, 2009 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS None MISCELLANEOUS BUSINESS Mr. Parker moved to strike Ordinance No. 46 -2009, supported by Ms. Pappin. Upon a vote viva voce, the motion passed. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 40, 41, 42, 43, 49, 52, 54, 55 & 56 -2009 on first reading by title only, supported by Councilor Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 40 -2009 — AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 2010 BUDGET The Clerk read Ordinance No. 40 -2009 on first reading by title only. The 2010 Budget Ordinance was presented by Ms. Glenn. Ordinance No. 40 -2009 was held on first reading until the Budget Adoption meeting on September 28, 2009. ORDINANCE NO. 41 — 2009 — AN APPROPRIATION ORDINANCE FIXING THE ANNUAL COMPENSATION OF ALL ELECTED CITY OFFICERS FOR 2010 The Clerk read Ordinance No. 41 -2009 on first reading by title only. Presented by Ms. Glenn, this Ordinance would set the annual compensation for all elected City officials for the year 2010. Ordinance No. 41 -2009 was held on first reading. Common Council Minutes September 8, 2009 Page 3 of 5 ORDINANCE NO. 42 -2009 — AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 2010 SALARY ORDINANCE The Clerk read Ordinance No. 42 -2009 on first reading by title only. Presented by Ms. Glenn, this Ordinance would set the annual compensation for all civilian City employees for the year 2010. Ordinance No. 42 -2009 was held on first reading. ORDINANCE NO. 43 -2009 — AN APPROPRIATION ORDINANCE AUTHORIZING PAYMENT FOR SERVICES FROM THE RICHMOND SANITARY DISTRICT, RICHMOND POWER & LIGHT, MOTOR VEHICLE HIGHWAY, AND PARK AND RECREATION DEPARTMENT FUNDS TO THE GENERAL FUND IN 2010 The Clerk read Ordinance No. 43 -2009 on first reading by title only. Ordinance No. 43 -2009 was held on first reading. ORDINANCE NO. 49 -2009 — AN APPROPRIATION ORDINANCE AUTHORIZING A REDUCTION IN APPROPRIATIONS FROM CERTAIN FUNDS The Clerk read Ordinance No. 49 -2009 on first reading by title only. Presented by Ms. Glenn, this Ordinance would authorize the 2009 budget be amended by reducing the amount in certain funds. Mr. Welch moved to advance Ordinance No. 49 -2009 to second reading and to suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 49 -2009 on second reading by title only. Council Vice President Miller declared Ordinance No. 49 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 49 -2009, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Mr. Welch moved to advance Ordinance No. 49 -2009 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 54 -2009 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Osborn International) The Clerk read Ordinance No. 54 -2009 on first reading by title only. Presented by Mr. Miller, this Ordinance is a request of Osborn Industries for a 10 -year tax abatement for equipment valued at Twelve Million Three Hundred Sixty Five Dollars and zero cents ($12,365,000.00) Mr. Welch moved to advance Ordinance No. 54 -2009 to second reading and to suspend the rules and read by title only, supported by Ms. Pappin. ORDINANCE NO. 55 -2009 -AN ORDINANCE REPEALING ORDINANCE NO. 3167 -1976 FIXING AND CODIFYING A POLICE RESERVE ORDINANCE FOR THE CITY OF RICHMOND, INDIANA The Clerk read Ordinance No. 55 -2009 on first reading by title only. Presented by Chief Wolski, this Ordinance would allow the Police Department to reinstitute the Reserve Officer Program. Mr. Elstro moved to advance Ordinance No. 55 -2009 to second reading and to suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. ORDINANCE NO. 56 -2009 — A GENERAL ORDINANCE CREATING CHAPTER 36 OF THE RICHMOND CITY CODE ESTABLISHING A MUNICIPAL MATRIMONY BUREAU The Clerk read Ordinance No. 56 -2009 on first reading by title only. Presented by Ms. Vessels, this Ordinance would authorize the Clerk to impose a fee to be paid to the City for performing marriage ceremonies. Mr. Welch moved to advance Ordinance No. 56 -2009 to second reading and to suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Mr. Parker moved to advance Ordinance No. 56 -2009 to third and final reading and suspend the rules and read by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Dissenting was Mr. Goodwin. ORDINANCES ON SECOND READING ORDINANCE NO. 52 -2009 — AN APPROPRIATION ORDINANCE AMENDING THE 2009 BUDGET (RPD) The Clerk read Ordinance No. 52 -2009 on second reading by title only. Presented by Chief Wolski, this Ordinance would transfer Fifty One Thousand Dollars ($51,000.00) from Fleet Gasoline and Oil to Overtime within the Police Department 2009 budget. This transfer would not require the expenditure of more money than the total amount set out in the 2009 budget. Mr. Parker moved to amend the title of the Ordinance to read 2009 in lieu of 2008, supported by Ms. Pappin. Upon a vote viva voce, the motion passed. Council Vice President Miller declared Ordinance No. 52 -2009 as amended on second reading and public hearing. Speaking against the Ordinance was Jerry Day. There being no comments for or the Ordinance, Ms. Cruse - Nicholson moved for engrossment of Ordinance No. 52 -2009, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Mr. Parker moved to advance Ordinance No. 52 -2009 to third and final reading and suspend the rules and read by title only, supported by Ms. Pappin. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 52 -2009 on third reading by title only. Ordinance No. 52 -2009 was adopted with a 7 -1 roll call vote. Dissenting was Mr. Quinn.
