A RESOLUTION OF THE GOVERNING BODY OF THE CITY OF MOAB
DECLARING REAL PROPERTY LOCATED AT 1339 POWEHOUSE LANE
OWNED BY THE CITY OF MOAB AS SURPLUS
WHEREAS, Moab City has the right and title to certain property listed below
and;
WHEREAS, the Governing Body of Moab City declares that at the present time,
it has no use whatsoever for said property.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF
MOAB CITY THAT:
1. The following described property is hereby declared as surplus:
1. LEGAL DESCRIPTION
A parcel of land in Section 8, T26S, R22E, SLM & B, Grand County Utah, more
particularly described as follows:
Beginning at a point which bears N 6° 05' E 7 ft from the West 1/a Corner Section 8,
T26S, R22E, SLM & B, and proceeding thence N89° 11' E 369.4 ft, thence along the arc
of a 231.2 ft radius curve to the right 104.3 ft (said curve has a cord which bears S 78°
23' W 105.3 ft), thence N 88°27' W 174.9 ft, thence along the arc of a 487.4 ft radius
curve to the right 92.2 ft (said curve has a cord which bears N 83f)01' W 92.1 ft) to the
Point of Beginning and containing 0.11 acres, more or less.
2. This resolution shall take affect immediately upon passage.
PASSED AND APPROVED in open Council by a majority vote of the Governing Body
of Moab City Council the 12th day of April, 2005.

Dear City Council,
Three years ago, I requested and received approval to realign a portion of Powerhouse
Lane in front of my home at 1339 Powerhouse Lane. The realignment was partially
located on my property and partially located on Moab City property. All costs associated
with the realignment were paid for by me. Moab City received a dedicated, 50' easement
from me where none had previously existed, traffic was slowed down and public health,
safety and welfare were enhanced. The project was planned, executed, and completed
without any public complaint, and with public approval.
I have recently purchased 10 acres adjacent to, and east of my home. Presently, there is
no dedicated public easement through this property to the boundary of the BLM property
on the East. I hereby formally propose, apply for, and ask approval for a road realignment
subject to the following conditions —
APPLICATION TO MOAB CITY TO
REALIGN PORTIONS OF POWERHOUSE LANE
1. Applicant, Thomas Johnson, is the owner of a parcel of property through which
approximately 1,050 feet of Powerhouse Lane pass.
2. Moab City lacks a dedicated right-of-way through this portion of property.
3. Applicant proposes to realign Powerhouse Lane, entirely at his own expense,
and to locate the new alignment partially on property owned by Moab City and partially
on property owned by applicant. The road alignment and easement shall be located as
drawn on the attached map.
4. All realignment work shall be performed by a licensed, bonded contractor and
be inspected and approved by the Moab City Department of Public Works. The finished
road grade shall not exceed 7% slope. The realigned road surface shall be consistent with
the present 20' wide gravel road on Powerhouse Lane.
5. Upon completion of the realignment work, applicant shall have the finished
roadway surveyed and dedicated to Moab City including a 50' wide easement whose
North Boundary is coincident with the North edge of the completed road.
6. Upon completion of the dedication, Moab City shall abandon road easement
rights to all portions of applicant's property that are not consistent with the dedicated
roadway. Moab City shall retain all present underground utility easement rights through
applicant's property.

property — covers 55,000 sq. ft. —1.26 acres (prior to this deeded conveyance
from Johnson, no dedicated easement to the Powerdam area existed)
Execute all work at Johnson's personal expense, to Moab City specifications
