City Manager "ool 1 ett requested approval of the May 3 and May 4 minutes be held over until the June 1 meeting. Councilman Dicka- son moved to approve the minutes of the Special Meeting of May 6 as mailed, Councilman Merritt seconded, the motion was carried unanimously. UNFINISHED BUSINESS: 6. ORDINANCE NO. 65 -154: 2nd read. Adding section relating to trash collection areas.. City Attorney Martin read title to Ordinance No. 65 -154 AN ORDI- NANCE OF THE CITY OF TEMPLE CITY ADDING MEW SUB-SECTION (c) TO SECTION 8504 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO TRASH COLLECTION AREAS. Councilman Tyrell moved to waive further read- ing of Ordinance No. 65 -154, Councilman Merritt seconded, the motion was carried unanimously. ORDINANCE NO. 65 -155: 2nd read. Amending County Ordinance tdo. 5560 Licensing Ordinance, to authorize the City Manager to con- sent or protest on behalf of the City Council. City Attorney Martin read title to Ordinance No. 65 -155 AN ORDI- NANCE OF THE CITY OF TEMPLE CITY ADDING SECTION 6205 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO THE ISSUANCE CF BUSINESS LICENSES. Councilman Dickason moved to waive further reading of Ordinance No. 65 -155, Councilman Tyrell seconded, the motion was unanimously carried. ORDINANCE NO. 65 -156: 2nd read. Amendment to County Ordinance No. 654.4 to authorize removal of vehicles from streets after 72 hours instead of 120 hrs. to conform with County amendment and request for us to do likewise. 'oollett advised this had been referred to the Planning Commission for review prior to the second reading. 10. ORDINANCE NO. 65 -159: 2nd read. Re-establishing Parking Commis- sion. City Attorney Martin read title to Ordinance No. 65 -159 AN ORDI- NANCE OF THE CITY OF TEMPLE CITY ADDING A NEW CHAPTER 3 TO AR- TICLE VII OF THE TEMPLE CITY MUNICIPAL CODE ESTABLISHING A PARK - ING COMMISSION. Councilman Merritt moved to waive further read- ing of Ordinance No, 65 -159, Councilman Nunamaker seconded, the motion was carried unanimously. ASSESSMENT HEARING FOR CURB & GUTTER: a. east side of Agnes, Olive to Howland, b. east side of Temple City Blvd. La Rosa to Sparklett. City Manager :Joollett requested this public hearing be re -set for 7 :30 P. M. June 1, 1965. Councilman Tyrell moved to re -set the public hearing for June 1, 1965, at 7:30 P. M., Councilman Nunamaker seconded, the motion was carried unanimously. NEW BUSINESS: 12. ORDINANCE NO. 65 -158: 1st read. codifying and amending sections of the Zoning Ordinances No. 63 -107 and 53 -112. City Attorney Martin read title to Ordinance No. 65 -158 AN ORDI- NANCE OF THE CITY OF TEMPLE CITY CODIFYING AND READOPTING SEC- TIONS 9100, 9100.1, 9100.2, 9100.3, 9100.4, 9100.5, AND 9100.6 AS NEW SECTIONS 1 2, 3, 4, 5, 6 AND 7 OF ARTICLE IX OF THE TEMPLE CITY MUNICIPAL CODE (t.1H I CH SAID ARTICLE IX I S HEREAFTER TO BE KN0' /N AS THE ZONING CODE OF THE CITY OF TEMPLE CITY) , ADD - ING NEW SECTION 1311 THERETO, AMENDING SECTIONS 24.00 AND 2501 THEREOF, AND CODIFYING ORDINANCE 63 -107. Councilman Tyrell moved to waive further reading of Ordinance No. 65 -153, Council- man Nunamaker seconded, the motion was carried unanimously. As this was the first reading of this ordinance no further actior . was taken. 13. RESOLUTION NO. 65 -476: Requesting $6030, for Engineering from State allocated gas tax funds for fiscal year 1965 -66. Asst. City Manager Koski advised this was the epproval of the budget proposal of $6000. for engineering funds for the 1965 -66 budget. Mr. Koski read title to Resolution No. 65 -476 RESGLUTIO OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING AND SUB- MITTING A BUDGET FOR EXPENDITURE OF STATE ALLOCATED (ENGINEERING FUNDS. Councilman Tyrell moved to adopt Resolution No. 65 -476, Councilman Merritt seconded, motion carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT; Councilmen -None RESOLUTION NO. 65 -475: Requesting $80,244. for Maintenance from State allocated gas tax fund for fiscal year 1965 -66. Asst. City Manager Koski read title to Resolution No. 65 -475 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPT- ING AND SUBMITTING A BUDGET FOR EXPENDITURE OF FUNDS ALLOCATED FROM THE STATE HIGHi'!AY FUND TO CITIES. Councilman Tyrell moved to adopt Resolution No. 65 -175, Councilman Merritt seconded, the motion was carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 14. REQUEST FROM SUPERVISOR BONELLI: Support of proposed 20 sales tax for County purposes. Mayor Harker presented the letter from Supervisor Bonelli in which he requests City support of his pro- posal for a County 20 sales tax to provide revenue for the Coun- ty and to help relieve the burden placed upon the County propert owner, 746 Council Minutes, May 13, 1965, page 3 tax payer. He also stated that the State was proposing a 1% additional sales tax which would provide an estimated $59,4 million for State revenue, This would make a total sales tax in the state of 50. He requested an expression of opinion of the Council as to whether they wish to take action or File the request. Following considerable discussion Councilman Nuna- maker moved to co on record as opposing this proposal, Council- man Tyrell seconded, roll call vote to carry the motion as Follows: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -done ABSENT: Councilmen -None 15. City Manager oollett presented a letter from the City Engineer recommending the Council approve and accept the work in the above named Tract #23607, and also that the Council cancel the faithful performance bond for construction of masonry walls, Principal Noel & Mary Rita Baldwin, Surety Glens Fails Insurance Co. in the amount of $800. Councilman Tyrell moved to approve the recommendations of the City Engineer, Councilman Dickason seconded, and the motion was carried by the following vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 16. PRESENTATION OF CERTIFICATE OF RECOGNITION: Jr. Chamber of Com- merce, Pres. Robert Garvin. City Manager ;°!oollett advised the Jr. Chamber of Commerce had requested this presentation be held over until June 1. Council- man Tyrell so moved, Councilman Nunamaker seconded, and the motion was carried unanimously. 17. CLAIM FOR PERSONAL INJURbES: McMahon & Arkley, Attys. City Manager'.loollett presented a claim For injuries sustained by Kathy Dale while participating in a program at Live Oak Park, This claim was filed.. by McMahon & Arkley, Attys. for Kathy Dale,, Councilman Merritt moved to deny the claim and refer it to the City insurance company, Councilman Nunamaker seconded, roll call vote to carry the motion as follows: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 13. PLANNING COMMISSION RECOMMENDATIONS: City Manager 'r!oollett presented the Planning Commission recomm mendation as follows: a. Planning Commission Resolution No. 65 -152PC recommends pre- zoning certain properties westerly of Rosemead Blvd. between Emperor and Callita to R -1 Potential C -2, and b. set a public hearing for 7 :30 P. M. June 1, 1965, and notify the property owners. Councilman Tyrell made a motion in accordance with the recommendations, Councilman Merritt seconded and the motion was carried unanimously. 1S. TRAFFIC COMMISSION RECOMMENDATIONS: Item 5. TraFfic Engineer Enva11 presented the recommendation that "No Stopping Between 7:00 and 5 :00 P. M. School Days Only" signs be placed at the following locations: 1. East side of Temple City Blvd. between Camino Real and Lemon Ave. and i5 ft. south of Lemon Ave. 2. South side of Lemon Avenue between 100 ft. east of Temple City Blvd, to Trelawney Ave. , 3. East and west sides of Trelawney Ave. between Lemon Ave. and Olema St, L }, North side of Lemon Avenue immediately east of Temple City Blvd. 100 ft. 5. High school frontages on west side of Temple City Blvd„ and north side of Lemon Ave. Following discussion Councilman Merritt moved to approve the re- commendation, Councilman Dickason seconded, and the motion was unanimously carried, 747 Council Minutes, May 18, 1965, page 4 Item 8. Rosemead Blvd. at Wedgewood and Live Oak: Engineer Envali stated the Commission recommend a "Not a Through Street" sign on the south side of Wedgewood at the west line of Rosemead with the Live Oak and Rosemead sign to remain the same. Councilman Tyrell moved to grant, Councilman Nunamaker seconded, and the motion was unanimously carried. Item 10. Recommend boulevard Stop signs at the east and west ap- proaches to Rio Hondo. Councilman Dickason moved to approve, Councilman Merritt seconded, the motion was unanimously carried. Item 11. Recommend placement of red curb markings on the north side of Las Tunas Dr. from curb return at Agnes to west driveway for a distance of 18 ft. westerly; placement of 9 ft. of red curb immediately west of the west driveway and 9 ft. immediately east of the second driveway. Councilman Merritt moved to approve, Councilman Dickason seconded, the motion was unanimously carried. 20. RESOLUTION NO. 65 -477: Warrants & Demands City Manager Woollett presented Resolution No. 65 -477, warrants and demands in the sum of $48,045.70, Nos. 6532 -6597. Councilman Merritt moved to adopt Resolution No. 65 -4477, Councilman Nunamaker seconded, motion carried by the following called vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 21. CORRESPONDENCE: a. City Manager Wooliett presented a request from Mr. Jacob Gunst to place street banners at Temple City Blvd. and Las Tunas Drive from July 15 to August 10 advertising a get together at the High School to raise money for the proposed Community Center. Council- man Merritt moved to approve subject to required insurance cover- age, Councilman Nunamaker seconded, the motion was carried unani- mously. 22. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mr. Alex Miller, of the Temple City Y's Mens Club spoke concerning the late filing of the application for a Fireworks stand. He ex- plained this was due to change of officers in the group. Also that they had stands the past several years and this was the main fund raising project for the year for the Temple City Y.M.C.A. which pays for the rent of their building and operation and re- quested approval of their late application. Following discussion Councilman Nunamaker moved to approve, Councilman Dickason second- ed, and the motion was carried. The permit will be granted. 23. MATTERS FROM CITY OFFICIALS: City Manager Woollett advised that since moving there were items which we no longer need including the glass drapes used in the front and back of the old City Hall. When we moved they were cleaned and placed in storage, and he recommended the Council de- clare them surplus and authorize the staff to determine what they should be sold for and accept bids. Following discussion Council- man Tyrell so moved, Councilman Nunamaker seconded, the motion wa, carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None City Manager Woollett presented a request for tree removal from Mrs. Cortise, 5027 Agnes, as the tree roots have gotten into the sewer pipe and stopped sanitation to the entire house. Inspection found a large elm which had raised the curb, the water meter and sidewalk. Mr. Woollett recommended the City remove and replace this tree. Councilman Tyrell so moved, Councilman Nunamaker seconded and the motion was carried; unanimously. The City Manager presented a notice from the Los Angeles County Boundary Commission re proposed annexation #38, west Arcadia, to the City of Arcadia. He explained this was the area left out of the proposed Annexation fro to Temple City. Councilman Tyrell mov- ed to receive and file, Councilman Nunamaker seconded, and the motion was unanimously carried. 748 Council Minutes, May 18, 1965, page 5 City Manager nloollett recommended the City Council appropriate $300. for necessary actuarialstudy for consideration of a retire- ment system. Councilman Tyrell so moved, Councilman Merritt se- conded, the motion was carried by the following roll call vote: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None City Manager !oollett recommended the City Council appropriate $500. to conduct the necessary survey on proposed annexation #8. Councilman Tyrell so moved, Councilman Nunamaker seconded, roll call vote to carry the motion as follows: AYES: Councilmen- Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None The City Manager presented a letter from the City Engineer re Tract #29569 recommending the (1) City Council find all work has been completed as required by the Subdivision Water System Agree- ment Form A -2C, and (2) release the subdivision Water System Agreement Form A -2C between the City and the Subdivider, and the Labor and Materials Bond for Tract #2G569, Bond #202619 in the amount of $3500. submitted by Dnal Developers, Inc., as principal. and National Automobile & Casualty Ins. Co. as surety. Council- man Tyrell moved in accordance to the recommendations, Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None City Attorney Martin presented Resolution No. 65 -478 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, FINDING AND DETER MINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY RE- QUIRE THE ACQUISITION OF THE FEE INTEREST IN AND TO CERTAIN REAL PROPERTY FOR PUBLIC BUILDINGS AND GROUNDS, TO WIT: OFF STREET PARKING FACILITIES. He explained this authorizes condemnation action on properties in Parking District No. 3 because of owner- ship. Councilman Tyrell moved to adopt Resolution No. 65 -478, Councilman Nunamaker seconded, the motion carried by the Following called vote: AYES: Councilmen- Dickason, Nunamaker, Tyrell, Harker ABSTAINING: Councilman- Merritt NOES: Councilmen.41one ABSENT: Councilmen »None The City Attorney presented a request from the Southern Calif. ,Water Co. for renewal of their water maintenance franchise which they have held with the County for some years. Their request is now submitted to the City rather than the County and proposed for Forty years. He recommended the request be acknowledged and referred to the City Manager for appropriate recommendations which the Council approved. Councilman Merritt asked the Traffic Engineer if the mast arms on the traffic signals were at maximum height advising one was hit and bent by a house moving company. Traffic Engineer Envall ad- vised they were and the City Manager also advised that movers had to have a permit and were also liable for any damage they in- curred. Councilman Tyrell felt the flashing amber traffic lights were holding up traffic and should be turned off as he felt the new signals were causing the problem until coordinated with the other signals. Following discussion Traffic Engineer Envall stated he would try to have this signalizing completed by June 1. Councilman Tyrell advised the Council that an assembly bill had been introduced to investigate the Lakewood Plan, in essence to determine if the contract cities are paying their just share of services rendered. This will be discussed at the Contract Cities Seminar in Palm Springs. Councilman Tyrell stated this should be handled through the Association and it will be on the agenda very shortly. 749 1 Council Minutes, May 18, 1965, page 6 Councilman Nunamaker advised that Parking District No. 2 is practically finished and they are going to have an opening day possibly next week and cut the ribbon. He requested everyone be ready to come when the notices are sent out. The Business & Industrial Committee is picking up the tab on this. 24. ADJOURNMENT: Councilman Nunamaker moved to adjourn to May 27, 1965, at 7:30 P. M. in the Council Chambers of the City Hall, 5938 Kauffman Ave., Temple City. Council adjourned at 8 :30 P.M.
