PRESENT: Mayor Daniel Gubler, Council President Robert Geray, Council Member Michael Thompson, Council Member Peter Wadsworth, Council Member Evan Mann (via telephone), City Attorney Andrew Rawlings, Public Works Director Zech Prouse and City Clerk/Treasurer Keri West. ABSENT: None. VISITORS: Kirsti Cook, Rylea Farrens, Diana Estrada, Doug Rockwood, Ann Rockwood, Trent Guthrie, Myrna Guthrie, Trenton Guthrie, Bill Koester, Elizabeth Schaffer, Mark Schaffer and Carroll Perkes. Mayor Gubler welcomed everyone and led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. Mayor Gubler announced the Public Hearing that was advertised for the East Village Preliminary Plat has been canceled and removed from tonight's agenda. CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of November 21, 2023, were reviewed. Council reviewed the finance reports for the period ending November 30, 2023 (17% of the fiscal year elapsed). The City had $1,814,356.17 in the bank and routine bills had been paid, "Exhibit A". Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the consent agenda as presented. Council President Geray seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: Approval of Temporary Moratorium on Water Connections —Mayor Gubler stated he would like to declare a temporary Moratorium on Water Connections until the Facilities Planning Study (FPS) is complete. He continued and stated until that study is done, the City does not know the capacity of the water system. Mayor Gubler stated legally the temporary moratorium can only last up to 6 months, but the FPS will be done by then. Attorney Rawlings stated there are state statutes regarding this, but he would need to research them further, along with the City Code, to determine the proper course of action to accomplish this. Mayor Gubler stated he understands the Mayor can declare this if there is an emergency. However, he knows this is not an emergency and is therefore looking for approval from the City Council. Council President Geray said he agrees with not adding new connections until the capacity has been determined. Council Member Wadsworth stated he understands not adding full developments and subdivisions at this time, but he expressed concern for individual landowners that want to build a home on their existing property. He continued and stated if a subdivision is considered 2+ new lots, he suggested a moratorium on subdivisions. Clerk West asked for clarification regarding the term "water connection"because several approved subdivisions still have individual lots that have not paid to connect to the water system. Director Prouse stated those subdivisions have been approved and IONA CITY COUNCIL REGULAR MEETING—DECEMBER 19, 2023 therefore would not be captured under this moratorium. Clerk West agreed and suggested the wording of the motion to clarify this. Mayor Gubler stated the FPS will be completed in 4 months and the Department of Environmental Quality (DEQ) will take 6 weeks to review. Council Member Thompson asked if this is relevant considering the slow pace at which connections are happening. Council President Geray stated according to the Clerk's Report that is sent out monthly, the City only averages 2-3 connections each month. Mayor Gubler stated this is fiscally responsible and covers the City for future growth. Council Member Wadsworth agreed the City should not be adding additional subdivisions onto the water system until the FPS is completed, but he reiterated that individual homes should be allowed. Attorney Rawlings stated this could also be captured as a condition in any Development Agreement that is presented to the City during the moratorium. Mayor Gubler agreed. Clerk West asked if the Council will still be reviewing plats during the moratorium. Attorney Rawlings stated the City can still accept plats and go through the review process with the developer acknowledging the moratorium is in place. He continued and stated the Council can review a plat and issue a conditional approval for after the moratorium is lifted, and adequate capacity has been determined. Mayor Gubler asked if the Council gives him authorization to sign the moratorium immediately. All Council Members agreed. Attorney Rawlings stated he will get this drafted. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve a temporary Moratorium for Water Connections, that individuals may continue to come to the City on an individual basis and request hook-ups during the Moratorium timeframe. He also moved to authorize the Mayor to sign the Moratorium as discussed. Council President Geray seconded the motion. All in favor. Motion carried. Public Hearing — Ordinance to Amend Iona City Code § 6-4-10, pertaining to the installation of mailboxes in Public Rights of Way (Ord. 298-12-23) —Mayor Gubler stated the Council has been discussing an amendment to the City Code pertaining to mailbox construction and placement. He specified the distance required for mailboxes from the asphalt would change from 6" to 18". Mayor Gubler further clarified masonry would no longer be prohibited for mailboxes, but the construction would need to be approved by the Public Works Director. He continued and stated items that are not allowed need to be removed within 10 days. Council President Geray asked if the audience members that were interested in this topic have seen the revisions. Paper copies were distributed to audience members. Carroll Perkes of 5166 E. Tanner Drive approached the Council and asked, if the setback will be changing to 18" from the asphalt, are existing mailboxes grandfathered in or will all residents with mailboxes closer than that be required to move their mailboxes. Director Prouse stated as the current amendment is written, all existing non-conforming mailboxes would be required to be brought into conformity within 120 days. Mayor Gubler clarified all of those mailboxes would need to be moved. Mayor Gubler stated this is a Public Hearing and asked if anyone else from the audience would like to address the Council. No comments made. Mayor Gubler then closed the Public Hearing portion of this agenda item. Director Prouse stated he feels it would be difficult to enforce the aforementioned section and require all existing non-conforming mailboxes to be moved. He would suggest this section be 2 IONA CITY COUNCIL REGULAR MEETING—DECEMBER 19, 2023 amended. Council President Geray stated the main reason for the 18" is because of snow removal. He continued and asked if there are a lot of current mailboxes within that distance from the asphalt. Director Prouse stated he believes the setback is not as much of an issue as the construction material issue this amendment addresses. He would suggest editing § 6-4-10(G) to allow mailboxes that are non-conforming to the new setback requirement without requiring them to be brought into conformity. Attorney Rawlings stated § 6-4-10(G) is not necessary to enforce the Code, it is instead meant to offer a grace period for those in non-compliance. He continued and stated if the City wants to enforce individual sections of the Code, they can do so for non- compliance. All agreed to eliminate § 6-4-10(G). Director Prouse also suggested adding a section that references the City's Standard Drawings. He continued and stated this allows the City to have a Standard Drawing of construction for masonry mailboxes for residents that choose that type of mailbox. Mayor Gubler suggested tabling this approval until next month when all amendments have been captured. Council President Geray summarized the requested changes as: 1. Removing § 6-4-10(G) as currently written; 2. Adding new section that references the City's Standard Detail and Drawings; 3. Replacing the term "cement" with "concrete" in § 6-4-10(D), as suggested by the Planning&Zoning Commission. Mayor Gubler entertained a motion. Council Member Thompson made a motion to table Ordinance No. 298-12-23 until the changes that were proposed have been included. Council President Geray seconded the motion. All in favor. Motion carried. Approval of Resolution 2023-05: 2024 City Council Regular Meeting Dates —Mayor Gubler asked if anyone had concerns with any of the meeting dates that are proposed. He continued and stated the City Council Meetings will now be held on the fourth Tuesday of each month. Clerk West agreed and stated the meeting in December will be held on the third Tuesday because the fourth Tuesday is Christmas Eve. Council President Geray stated the proposed meeting date of Tuesday, May 28`h is right after the Memorial Day holiday. He asked if that would be an issue for anyone with limited time to review the packet. Clerk West stated she would get the packet out as soon as possible that month. Discussion took place regarding moving the May date to the third Tuesday. However, Clerk West determined elections will be taking place that day at the City Building. Council President Geray confirmed Bonneville County elections will be held on May 21st, which is the third Tuesday in May. He suggested keeping the date as the 28th with the packets being sent out one week earlier for the Council to review prior to the holiday weekend. Clerk West agreed. Mayor Gubler entertained a motion. Council President Geray made a motion to approve Resolution 2023-05: A Resolution specifying the dates in which the City Council will hold Regular Meetings during the calendar year 2024. Council Member Thompson seconded the motion. All in favor. Motion carried. Discussion of Iona City Code § 10-1-17: Requirements for Public Ways in the Iona Subdivision Ordinance; pertaining to updates to the City's Standard Specifications and Drawings — Director Prouse stated these amendments create a more cohesive Code with the newly approved percolation rate calculations and drawings for the drainage swales. Mayor Gubler stated this is just a discussion and will be an action item for approval at next month's 3 IONA CITY COUNCIL REGULAR MEETING—DECEMBER 19, 2023 meeting. Director Prouse stated the actual rates are captured in the City's Standard Specifications and Drawings, but are referenced in this section of the Code. Director Prouse stated this allows the City to update the drawings without repeatedly updating the Code. Mayor asked if anyone in the Council had any questions or concerns regarding this amendment. No comments made. Attorney Rawlings stated he will update the draft and have it ready for next month's meeting. General Fiber Discussion — Mayor Gubler stated this was discussed at the Work Meeting. Council President Geray stated they discussed a citizen's concerns regarding the installation of their fiber and what Direct Communications is doing to address those concerns. He continued and stated he has been happy with the feedback he has received from Direct Communications and is pleased with the City's choice for fiber installation. SUGGESTED AGENDA ITEMS: None. STAFF REPORTS: Council Members Wadsworth, Thompson and Mann stated nothing to report. Council President Geray stated he has been attending the Friends of the Iona Library (FOIL) meetings. He continued and stated the first meeting mostly focused on their bi-laws and he was able to clarify a few things and help them make adequate changes. He continued and stated they are continuing with their fundraising efforts and are planning their Daddy/Daughter dance in February, which is their most successful fundraiser each year. Council President Geray also stated the communication between FOIL and the Bonneville County Library District (BCLD) seems to be working well. Mayor Gubler stated the Mayor's Youth Advisory Council (MYAC) is a great group this year. He continued and stated they are currently doing the Angel Tree and those gifts will be delivered tomorrow. They have also already provided service to the Community Food Basket and are doing their first coat drive, which has received a fantastic response. He continued and stated the coats will be taken to the Idaho Falls Rescue Mission, which will then distribute them to the various shelters and organizations that need them. Mayor Gubler also stated the MYAC would like to have a Council Member come to one of their meetings monthly to talk to the youth individually. He continued and stated their meetings have become more proactive in teaching the youth about government. Meeting Adjourned at 7:47pm.
