ORDINANCE NO.2015-01
AN ORDINANCE AMENDING THE CITY OF MOAB CLASSIFIED HOURLY
PAY RATE SCHEDULE AND EXEMPT AND ELECTED OFFICIALS'
SALARIES
WHEREAS, the Moab City Personnel Policies and Procedures Manual allows that pay
ranges may be adjusted periodically to accommodate increases in the cost of living; and
WHEREAS, the Moab City Personnel, Policies and Procedures Manual calls for using
standard state and national measures to determine cost of living adjustments; and
WHEREAS, the Utah Bureau of Labor Statistics showed that the Cost of Living Increase
for the State of Utah from 2012-2013 was greater than 2%; and
WHEREAS, the 2014/2015 Fiscal Year Budget Shows a 2% Cost of Living Increase for
all employees covered by the Pay Rate Schedule; and
WHEREAS, the proposed "City of Moab Classified Hourly Pay Rate Schedule" is
attached to this resolution as Attachment A, respectively; and
WHEREAS, Moab Municipal Code Section 2.44.010 states that all salaries of the
elective and appointive officers of the City and the other employees of the City shall be
fixed by motion or resolution of the City Council as in accordance with existing law.
NOW, THEREFORE, WE, THE GOVERNING BODY OF THE CITY OF MOAB
RESOLVE TO ADOPT The City of Moab Classified Hourly Pay Rate Schedule
(Attachment A) and Exempt and Elected Official Salaries (Attachment B) as referred
herein effective July 1, 2014.

Applicant: Southeastern Utah District Health Department
Background/Summary: The Southeastern Utah District Health Department has
applied for use of Swanny City Park as well as a Special Business Event License to
conduct their weekly Farmer's Market at Swanny City Park on selected Thursday
evenings and selected Saturday mornings. The Health Department has taken over this
event from the Youth Garden Project. In previous years the weekly market has been
conducted with no major issues. This event does not require law enforcement or other
logistical support. The Special Events Committee has reviewed the application and
supporting material and recommends approval of the event and use of the park with
conditions.
Options: The Council may approve, approve with conditions, deny or postpone the
item.
Staff Recommendation: Staff recommends Approval of the Special Business Events
License and Special Use of Swanny City Park with the following conditions: 1)
Applicant will provide an updated vendors list each week one day prior to the event; 2)
Applicant will keep the event confined to the park area indicated on the submitted
application; 3) Applicant will actively inform participants and vendors of the Park Policy
regarding no dogs or other animals in Swanny City Park. 4) There will be no vehicles
parked on the lawn.
Recommended Motion: "I move to approve the Special Business Event License
and for the Moab Farmers' Market with the staff conditions as presented" and "I
move to approve the and Special Use of Swanny City Park for the Moab Farmers'
Market with the conditions presented by city staff."

APPLICATION FOR THE
SPECIAL USE OF CITY PARKS
Swanny Park, located, between 100 and 200 West from 30 to 400 North, is a non -reservation park that is meant to be open to the
public on a first -come, first served basis. Special Use of Swanny Park and other non -reservation parks within the City is subject to
approval by the Moab City Council. The City Council may approve use applications for events that provide clear benefits to the
community. Requests for usage by private businesses that serve a limited clientele will not be approved. This application must be
submitted, along with any special events license application, to the City Recorder's office at least six weeks prior to the scheduled
event. Upon approval of the application by the City Council, a Special Park Use Permit will be issued upon payment of the appropriate
fee, provided for in the Schedule of Fees.

This year I proposed that the Southeastern Utah District Health Department (SEUDHD)
take over sponsorship of the Moab Farmers Market after learning that the Youth Garden
Project was giving up sponsorship after the 2014 season.
I proposed that SEUDHD take over sponsorship of the Market because it is an asset to the
community and promotes the idea that healthy eating is key to a healthy community.
Through the market I hope to create an environment that promotes educational
experiences, healthy living and a welcoming environment to all demographics.
The Market will be open to the public. SEUDHD will only collect minimal fees from vendors
in an effort to break even at the end of the season.
I would like to ask the Council to consider waiving all fees associated with special events
and use of Swanny Park for the 2015 season. This waiver will greatly help the market.

Background/Summary: It is necessary to write off delinquent terminated
utility accounts from the Moab City accounting system. The debts are not
forgiven and are still pursued for collection. Customers have been sent monthly
billings since accounts were terminated. Letters were sent notifying customers
they had 15 days to pay balance of account or make payment arrangements,
otherwise, their account would be sent to our collection agency. The City Council
is authorized to write off accounts over $50.00.
Options: approve, deny or postpone.
Staff Recommendation: Approve.

WHEREAS, Resolution #10-2003 provided conditions for writing off delinquent

WHEREAS, pursuant to Resolution #10-2003, the City Council is authorized to write off

Background/Summary: The City opens the budget at mid -year each year. There are
very few items that need to be included in the budget opening, affecting only the
General Fund, the Recreation Fund and the Community Devleopment Fund. In the
General Fund, we received several state grants for the Police Department in the amount
of $24,498, so both revenues and expenditures should be adjusted by this amount. We
also received two other donations —one for the Spyhop youth video/film program in the
amount of $750, and one from the Beehive Community Grant in the amount of $1,000.
Accordingly, the Film Commission budget shows and increase of $750 for the program,
and there is a new line line item called Mayor's Grants to be used for disbursal of the
Beehive Grant. Most other changes in the General Fund have to do with the increased
cost associated with switching our health care insurance provider. Luckily, these
additional costs may be covered by interdepartmental transfers and increased revenue.
For the Recreation Department, the changes reflect the addition of the Dodgeball
program in the amount of $400. The Community Development fund shows a decrease,
due to having spent several items in last year's budget year that had been carried over
to the current year budget.
Options: Council can approve, table, or deny the proposed resolution.
Staff Recommendation: Staff recommends approval of the proposed resolution, after
the public hearing is held.
Recommended Motion: I move to approve Proposed Resolution #08-2015 — A
