ORDINANCE NO. 1989 -24 AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF GREENCASTLE, INDIANA AREA III -A (FILLMORE ROAD) WHEREAS, the Common Council of the City of Greencastle, Indiana, has determined that it would be advantageous to the citizens of the City of Greencastle, Indiana and to the citizens of the proposed area sought to be annexed to annex such territory and to include the same within the boundaries ti of the City of Greencastle, Indiana, and; WHEREAS, the Common Council of the City of Greencastle, Indiana, has adopted by Resolution a written fiscal plan for such area, pursuant to law, NOW, THEREFORE, be it ordained by the Common Council of the City of Greencastle, Indiana, as follows: 1. That the Common Council of the City of Greencastle, Indiana hereby annexes the following described territory outside the City of Greencastle, Indiana, but adjacent e thereto, and within the County of Putnam and the same is declared to be a part of the City of Greencastle, Indiana, and is described as follows: The following described real estate located in Sections 13 and 24 of Greencastle Township, Putnam County, Indiana: A. SINCLAIR - FERRAND SUBDIVISION as recorded in Plat Book 5 at page 122 in the Office of Putnam County Recorder. B. SAN -MAR SUBDIVISION as recorded in Plat Book 5 at page 92 in the Office of Putnam County Recorder. C. A tract of real estate commencing at the Northwest corner of the San -Mar Subdivision; thence North 157 feet to the Southwest corner of the Sinclair - Ferrand Subdivision; thence East 180 feet along the southern boundary of the Sinclair - Ferrand Subdivision to the Southeast corner of the Sinclair - Ferrand Subdivision; thence South to the northern boundary of the San -Mar Subdivision; thence west along the northern boundary of the San -Mar Subdivision to the point of beginning. D. A part of the South East quarter of Section Thirteen (13), and a part of the North East quarter of Section Twenty -four (240), all in Township Fourteen (14) North of Range Four (4) West, of the Second ® Principal Meridian, more particularly described to wit: Beginning at the North East corner of the San -Mar Subdivision of a part of Section 13 and part of 1. Section 24, all in Township 14 North, Range 4 West, as said subdivision is recorded in the office of the e Recorder of Putnam County, Indiana; thence from said beginning point South 415.7 feet to the south East corner of said subdivision, said South Fast corner being in the centerline of Indiana State Road 240; thence South 77 degrees East 105 feet with the centerline of said road; thence North 0 degrees 40 minutes West 371.4 feet to a point; thence North 55 degrees West 119.3 feet to the point of beginning, containing 0.9 acres, more or less. E. A part of the Northeast quarter of Section 24, Township 14 North, Range 4 West of the Second Principal Meridian more particularly described, to- wit: Beginning at a point in the centerline of Indiana State Road #240, which point is South 77 degrees East 105 feet from the Southeast corner of the SAN -MAR Subdivision as said Subdivision is recorded in the office of the Recorder of Putnam County, Indiana; thence South 77 degrees East 100 feet with the centerline of said State Road #240,1 thence North 0 degrees 40 minutes West 393.9 feet to an iron pin; thence West 97.2 feet to an iron pin; thence South 0 degrees 40 minutes East 371.4 feet to the point of beginning, containing 0.862 acres, more or less. F. A part of the Northeast quarter of Section 24, Township 14 North, Range 4 West of the Second Principal Meridian more particularly described to wit: Beginning at the Northeast corner of Section 24, Township 14 North, Range 4 West; thence South 735.8 feet with the east line of said Section 24, • Township 14 North, Range 4 West, to a point; thence North 77 degrees West 1187.3 feet to the true point of beginning; thence North 0 degrees 40 minutes west 422.02 feet to a point; thence West 121.47 feet to a point; thence South 0 degrees 40 minutes east 393.9 feet to a point; thence South 77 degrees east 125 feet with the centerline of Indiana State Road 240 to the true point of beginning. 2. That the territory sought to be annexed is contiguous to the municipality and is presently not zoned. 3. That the territory sought to be annexed is contiguous to the municipality as required by Section 1.5 of I.C. 36- 4 -3 -1.5 in that the proposed territory for annexation has boundaries that are common with the existing corporation line amounting to 40% of the proposed area, thereby exceeding the 12.5% required by law. 4. That the territory sought to be annexed is eight- five percent (85 %) subdivided. 5. That upon annexation said territory shall be in the Second Ward. • 6. That the Common Council of the City of Greencastle, Indiana, has developed a written fiscal plan, by Resolution, as of the date of the passage of the annexation ordinance. 2. 7. That this ordinance shall be in full force and • effect from and after its passage and approval by the Common Council of the City of Greencastle, Indiana, legal publication and notification pursuant to law and passage of the time allowed by law for the filing of remonstrances against this Ordinance.
