ADDENDUM NUMBER 2
THIS ADDENDUM Number 2 to Contract Number 56-2004 is made and entered into
this 8th day of _October_, 2009, by and between Richmond, Indiana, a municipal
corporation through its Board of Public Works and Safety (hereinafter referred to as the
"City") and Burgess & Niple, 251 North Illinois Street, Capital Center, Suite 920,
Indianapolis, Indiana 46204 (hereinafter referred to as "Contractor").
WHEREAS, City and Contractor entered into an Agreement numbered 56-2004, on June 3,
2004, which Agreement is attached hereto as Exhibit "A" and incorporated by reference; and
WHEREAS, City and Contractor entered into an Addendum No. 1 to Contract No. 56-2004
on April 23, 2009, which Addendum is attached hereto as Exhibit "B" and incorporated by
reference; and
WHEREAS, City wishes to retain Contractor to provide certain additional services ancillary
to those within the scope of Agreement Number 56-2004 and its Addendum No. 1.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein
contained, including the above stated recitals, City and Contractor hereby agree as follows:
1. Contractor shall provide design IAC references and justifications.
2. Contractor shall provide calculations to Banning Engineering.
3. Contractor shall secure IDNR Hydraulic Model of Clear Creek.
4. Contractor shall calibrate WSP2 with HECRAS.
5. Contractor shall participate in two (2) conference calls in September of 2010.
6. Contractor shall conduct a field survey consisting of 4 cross -sections of Clear
Creek.
7. Contractor shall attend a pre -hearing meeting and a hearing in September
2010.
8. Contractor shall perform the above additional design activity services in a
manner consistent with Contractor's proposal, which is attached hereto, made
a part hereof and marked as Exhibit "C". Contractor shall perform all work
and services described on Exhibit "C".

9. Contractor shall be paid an additional sum not to exceed Eleven Thousand
Eight Hundred Thirty Dollars ($11,830.00) for all services described on
Exhibit "C".
10. City and Contractor expressly agree that all other terms, conditions and
covenants contained in Contract Number 56-2004 and its Addendum No. 1,
shall be applicable to the work performed pursuant to this Addendum, unless
such term, condition or covenant conflicts with this Addendum.
IN WITNESS WHEREOF, the parties execute this Addendum effective the day and year
first above written, although signatures may be affixed at different times.
